A RESOLUTION AUTHORIZING ACCEPTANCE OF A GRANT IN THE
AMOUNT OF $34,664.00 FROM THE ARKANSAS STATE POLICE ASSET
FORFEITURE FUND FOR THE PURCHASE OF AN UNDERCOVER DRUG
ENFORCEMENT VEHICLE AND A COVERT AUDIO/VIDEO RECORDER,
AND APPROVING A BUDGET ADJUSTMENT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes
acceptance of a grant in the amount of $34,664.00 from the Arkansas State Police Asset
Forfeiture Fund for the purchase of an undercover drug enforcement vehicle and a covert
audio/video recorder.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a
budget adjustment, a copy of which is attached to this Resolution as Exhibit "A".

Subject: 2012 Arkansas State Police Special State Asset Forfeiture Grant Award
PROPOSAL:
The Arkansas State Police (ASP) Special Assets Forfeiture grant award will be used by the Fourth
Judicial District Drug Task Force (DTF) to purchase an undercover drug enforcement vehicle and a covert
audio/video recorder. The DTF needs an additional investigator assigned to the Drug Task Force, but there is
no undercover drug enforcement vehicle for their use. Grant funds awarded ($25,000) for this vehicle are based
on the average of several currently available vehicles within our area that meet our operational specification,
and include the purchase of a portable radio with covert antenna, portable GPS, and window tinting. The covert
audio/video recorder uses current technology to gather indisputable evidence of drug activity for prosecution.
This piece of equipment is a key component in our overall drug operations. This grant funding will replace
outdated equipment that is inoperable and needs repair. The total cost, including freight and taxes, for the
covert audio/video recorder is $9,664 for a total grant award of $34,664.
RECOMMENDATION:
Staff recommends acceptance of the 2012 ASP Special Assets Forfeiture grant award for the purchase of
an undercover drug enforcement vehicle and a covert audio/video recorder, as well as approval of a budget
adjustment in the amount of $34,664. If you should have any comments or question regarding this grant award,

MEMORANDUM OF UNDERSTANDING
In accordance with Act 830 of the 2007 session of the Arkansas 86th General Assembly
the Arkansas State Police was charged with the responsibility of disbursing moneys from
the Special State Assets Forfeiture Fund and federal forfeitures.
Pursuant to the foregoing authority, the Arkansas State Police has established the Special
State Assets Forfeiture Fund Committee to award funds, which in the Committee's
opinion, will best facilitate drug enforcement operations.
In accordance with the foregoing a joint agreement between the Arkansas State Police
and the 4th Judicial District Drug Task Force is entered for a period of October 1, 2012
through May 31, 2013.
The recipient of the awarded funds agrees to maintain records and receipts for items
purchased with the grant funds and will furnish copies of all receipts to the Arkansas
State Police by the I0th day of the month following the expenditure.
Any modification or changes above 10% to the grantee's approved budget must be
authorized by the Arkansas State Police before expenditures for the changes can be made.
Any awarded funds not expended during the period set out in the preceding paragraph
and in accordance with grantee's budget or approved changes shall be refunded to the
Arkansas State Police by 4:30 p.m. May 31, 2013.
The awarded funds are subject to audit by the Arkansas State Police and/or the
Department of Legislative Audit. Misuse of these funds will result in the 4th Judicial
District Drug Task Force reimbursing the Arkansas State Police for the funds awarded.
The following items will NOT be considered for funding and any funds awarded should
not be used for these items:
■ Salaries, over time, fringe benefits related to salaries
■ Contractual services, and travel related expenditures
■ Electronic Immobilization Devices
■ Drug Court Programs
■ Real Estate
■ Vessel or Aircraft
■ Construction Projects
■ Buy Money
This MOU shall remain in full force and effect beginning on the date of signature and
continuing for the duration of the current agreement period.
