ENFORCEMENT FORFEITURE REVENUE RECEIVED DURING THE
FIRST QUARTER OF 2012 AND AUTHORIZING EXPENDITURES

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves a
budget adjustment, a copy of which is attached as Exhibit "A", in the amount of $43,366.00
representing state and federal law enforcement forfeiture revenue received during the first
quarter of 2012 and authorizing expenditures therefrom.

Subject: Law Enforcement State and Federal Forfeitures for Fayetteville Police Department
PROPOSAL:
The Fayetteville Police Department receives forfeitures as a result of civil proceedings concerning cash
or property seized during a criminal investigation. Most of the forfeitures we have received in the past are a
direct result from the efforts of the officers we assign to the 4th Judicial District Drug Task Force (4th DTF), the
IRS Task Force, and the local office of the Federal Drug Enforcement Agency (DEA). Use of federal forfeiture
funds must adhere to the Guide to Equitable Sharing of Federally Forfeited Property for State and Local Law
Enforcement Agencies. Use of state forfeiture funds must be used for law enforcement purposes. All purchases
utilizing these funds will follow the City of Fayetteville Purchasing Policy.
RECOMMENDATION:
Staff recommends approval of a budget adjustment to recognize state and federal forfeiture revenue
received during the first quarter 2012 and establish expense budget in the total amount of $43,366.
BUDGET IMPACT:
Increase expenses to correspond with state and federal forfeiture revenue received during first quarter
2012.
