A RESOLUTION APPROVING A BUDGET ADJUSTMENT IN THE
AMOUNT OF $133,320.00 REPRESENTING FEDERAL AND STATE LAW
ENFORCEMENT FORFEITURE REVENUE RECEIVED DURING THE
THIRD AND FOURTH QUARTERS OF 2012 AND ESTABLISHING A
CORRESPONDING EXPENSE BUDGET
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves a
budget adjustment, a copy of which is attached as Exhibit "A", in the amount of $133,320.00
representing federal and state law enforcement forfeiture revenue received during the third and
fourth quarters of 2012 and establishing a corresponding expense budget.

Subject: Federal and State Law Enforcement Forfeitures for Fayetteville Police Department
PROPOSAL:
The Fayetteville Police Department receives forfeitures as a result of civil proceedings concerning cash
or property seized during a criminal investigation. Most of the forfeitures we have received in the past are a
direct result from the efforts of the officers we assign to the 4th Judicial District Drug Task Force (4th DTF), the
local office of the Federal Drug Enforcement Agency (DEA), and the Internal Revenue Service (IRS) Financial
Crimes Task Force. By statute, federal and state forfeitures are to be spent for law enforcement purposes only.
All purchases utilizing these funds must follow the City of Fayetteville Purchasing Policy.
The federal forfeitures consist of Department of Justice funds which are drug related forfeitures and
Department of Treasury funds which are Internal Revenue Service related forfeitures. The requested budget
adjustment will recognize the following forfeitures: $26,790 from the Department of Justice; $98,388 from the
Department of Treasury; and $8,142 from state forfeitures.
RECOMMENDATION:
Staff recommends approval of a budget adjustment to recognize federal and state law enforcement
forfeitures revenue received during the third and fourth quarters of 2012 and increase expense budget in the
amount of $133,320.
BUDGET IMPACT:
Increase expenses to correspond with federal and state law enforcement forfeiture revenue received
during budget year 2012.
