BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby approves
amendment #2 to the engineering services agreement with McClelland Consulting Engineers,
Inc. in the amount of $247,013.00 for construction and design phase services for the Highway
265 water and sewer relocation project, a copy of which is attached as Exhibit "A".
Section 2. That the City Council of the City of Fayetteville, Arkansas hereby approves a
project contingency of $20,000.00.

HIGHWAY 265 (CROSSOVER ROAD) WATER & SEWER IMPROVEMENTS
The December 16, 2008 Agreement between the CITY OF FAYETTEVILLE and
McCLELLAND CONSULTING ENGINEERS, INC. is hereby amended to provide for
engineering services during the construction phase of Phase I of the Crossover Road Water and
Sewer Improvement Project from the vicinity of Mission Boulevard to the vicinity of Joyce
Boulevard (AHTD Job 040517) and to further provide engineering services during the design and
easement preparation phases of Phase II of the Crossover Road Water and Sewer Improvement
Project, from the vicinity of Joyce Boulevard to the vicinity of Albright Drive (AHTD Job
040518).
The Scope of Services for the Phase II (AHTD Job 040518, Joyce to Albright) Design
Services, Property Mapping and Easement Services, and Storm Water Pollution Prevention Plan
Services shall be as defined in Sections 2.2, 2.3 and 2.4 of the original Agreement for the Phase I
Project (AHTD Job 040517) with revisions as appropriate for the Phase II Project location.
The Scope of Services for the Phase I (AHTD Job 040517, Mission to Joyce)
Construction Phase Services shall generally include resident construction observation services,
conduct and attend a preconstruction conference, preparation and/or review of monthly progress
payments, construction administration assistance, periodic and final inspections, final punch list
preparation and follow up, preparation of record drawings, coordinate as appropriate with AHTD,
and project closeout.
The total estimated compensation for the previously approved engineering services,
including Amendment No. 1, and these additional services will be increased from $472,614.08 to
$719,627.08 as further defined in Appendix A, B, and C to this Amendment No. 2.
All other provisions, covenants, recitals, terms and conditions of the Agreement, which
are not expressly amended herein, shall remain in full force and effect.

RECOMMENDATION
Staff recommends approval of Amendment No. 2 to the engineering services agreement with McClelland Consulting
Engineers for $247,013, for construction and design phase services for the Hwy. 265 Water and Sewer Relocation project,
and approval of a $20,000 contingency.
BACKGROUND
The original design contract was awarded to McClelland Consulting Engineers in December, 2008 to design relocated
water and sewer lines as a result of the combined Arkansas Highway Department (AHTD) and City widening of Phase I
of Crossover Road (Hwy 265) between Mission and Joyce, upsizing the existing pipes and connecting a 36" transmission
line. Work includes installing a 36" and 24" transmission main along Crossover from Joyce to connect to the existing 24"
main on Crossover at Mission and to connect to the existing 36" main on Old Wire Road. This work will complete the
eastern portion of the loop that was initially constructed when the southern section of Crossover Road between Mission
and Huntsville was widened by the AHTD. The contract did not include construction phase services.
AHTD is now moving forward with Phase II of the widening of Hwy 265 from Joyce to Albright. This will require
relocating water and sewer lines on both sides of the highway.
DISCUSSION
This amendment covers two separate work tasks:
(1) Construction phase engineering services for the Highway 265 water/sewer relocations from Mission — Joyce, including
the 36" and 24" water lines, where construction starts this summer. This includes two full time construction observers due
to a short construction schedule (the contractor will almost certainly employ multiple construction crews), attending
preconstruction conferences, reviewing contractor schedules and submittals, monthly progress meetings, reports to the
City and the AHTD, partial pay requests, regular site visits, change order processing, final inspection, final pay request
review, developing as-builts, and related activities.
(2) The scope of work for design of the project for Hwy 265 from Joyce to Albright consists primarily of:
- Field surveys to confirm rights -of -ways and utility locations
- project cost estimating with AHTD and Fayetteville shares predicted
- right-of-way requirement identification and easement document development
- final engineering design
This contract does not include construction phase services for the Joyce — Albright section; that will be accomplished by
future amendment.
BUDGET IMPACT
The City's portion will be funded from Water and Sewer revenue bonds; the remainder will be paid by the AHTD. The
cost share split will be determined when the design is completed.
