CONTINGENT UPON RECEIPT OF GRANT FUNDING, AUTHORIZING APPLICATION AND ACCEPTANCE OF A GRANT FROM THE FEDERAL AVIATION ADMINISTRATION AND ARKANSAS DEPARTMENT OF AERONAUTICS TO FUND THE PROJECT, AND APPROVING A BUDGET ADJUSTMENT BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council of the City of Fayetteville, Arkansas hereby approves task order #4 to the contract with McClelland Consulting Engineers, Inc. contingent upon receipt of grant funding, and further authorizes application and acceptance of a grant from the Federal Aviation Administration and Arkansas Department of Aeronautics to fund the project. A copy of task order #4 is attached to this Resolution as Exhibit "A". Section 2. That the City Council of the City of Fayetteville, Arkansas hereby approves a budget adjustment, a copy of which is attached as Exhibit "B". PASSED and APPROVED this 15th day of February, 2011. SMITH, City Clerk/Treasurer TASK ORDER NO.4 RUNWAY 34 AVIGATION EASEMENT PREPARATION For FAYETTEVILLE EXECUTIVE AIRPORT, DRAKE FIELD FAYETTEVILLE, ARKANSAS STATE OF ARKANSAS COUNTY OF WASHINGTON This Task Order is written pursuant to the basic agreement entitled CITY OF FAYETTEVILLE, AGREEMENT FOR ENGINEERING SERVICES, executed on May 5, 2009. The referenced basic agreement pertains to proposed improvements to Drake Field, Fayetteville's Municipal Airport. This Task Order entered into and executed on the date indicated below the signature block, by and between the City of Fayetteville and McClelland Consulting Engineers (MCE) sets forth the project description, project schedule, and engineering fees for the preparation of Avigation Easements for the 34:1 Approach Surface to Runway 34, Drake Field. SECTION I - PROJECT DESCRIPTION The Owner and Engineer have completed an Obstruction Study for the Approaches into Drake Field with acceptance by the FAA. The results of this study and recommendations from FAA indicate that numerous easements acquisitions are required in order to control the height of objects or to mark obstruction with obstruction lights within the 34:1 Approach Surface to Runway 34 at Fayetteville Executive Airport, Drake Field. J:\DRAKE FIELD\CONTRACTS\2009-2013\Task Order 4.doc 1 The Owner wishes to obtain easements within the Runway Protection Zones, the Part 77 Surfaces, and for the 34:1 Non -Precision Approach to Runway 34 (South end) under a FAA Grant. SECTION II - PROJECT SCHEDULE From the time the City of Fayetteville issues the Notice To Proceed (NTP), McClelland Consulting Engineers, Inc. will endeavor to execute the project within the following time periods: Task Completion After NTP 1. Updated record search and Property Map. 45 Calendar Days 2. Additional Field Surveys and Easement Preparation. 135 Calendar Days SECTION III - SCOPE OF SERVICES McClelland Consulting Engineers, Inc. shall, generally, provide those services listed in the basic agreement which are applicable to this specific Task Order. Specifically, the Engineer will provide the following services necessary to provide Property Deeds, Property Ownership, complete property surveys, plats of survey and easement, as required to acquire the easement to meet FAA Criteria. Task 1: Record Search ; Perform an updated record search to determine present property boundary description, ownership, name and address. Develop a Property Map indicating parcels to acquire by avigation easement. Task 2: Boundary Surveys; Perform any additional field surveys to determine the property boundary for the approximately 38 avigation easement acquisition tracts. Prepare plats of survey for easement acquisition and a profile of easement tracts indicating the height limitations. Field staking for the property boundary corners and easement boundary corners. Task 3: Easement Preparation; Provide assistance to Appraisers, the Airport staff and City staff during the acquisition process. J:\DRAKE FIELD\CONTRACTS\2009-2013\Task Order 4.doc 2 Task 4: Project Management; Perform Project Management duties including meetings with Surveyors, Airport Appraisers, Airport Staff, City staff and FAA as required; provide letters to property owners; and overall project management for related ownership search, surveying and plat preparation activities SECTION IV - FEES AND PAYMENTS The compensation for services to be provided in Section III above shall be according to the following schedules: Task 1: Record Search; For development of the updated current property ownership deeds, names, addresses and development of property map indicating parcels designated to be acquired by avigation easement: a fee per parcel to be determined from actual time spent, in accordance with the attached Appendix "A". An estimated amount of $ 4,000.00 Task 2: Boundary Surveys; For the field surveying and office computation required to locate and determine property boundary corners for easement acquisition parcels, a fee per parcel to be determined from actual time spent, in accordance with the attached Appendix "A". Several separate parcels under the same ownership will be combined for acquisition purposes there by reducing the number of total easements and the total fee. An estimated amount of $17,500.00 Task 3: Easement Preparation; For the preparation of easement description and easement plats (2 per parcel required by FAA), a fee per parcel to be determined from actual time spent in accordance with the attached Appendix "A". An estimated amount of $21,000.00 Task 4: Project Management; For Project Management and assistance to acquisition consultants and Airport and City staff, a fee per parcel to be determined from actual time spent, in accordance with the attached Appendix "A". A estimated amount of $ 6,500.00 Task 5: For Reimbursement Expenses An estimated amount of $ 1,000.00 Total Not to Exceed $50,000. APPROVE RECEIPT OF GRANT FUNDING PROPOSAL: Task Order #4 will design Avigation Easements for Runway 34 at Drake Field. The Avigation Easements are required to protect the approaches to the airport. It was determined that no avigation easements had been purchased when we were working to remove obstacles south of the airport identified by the FAA during a flight standards survey in 2008. There are approximately 50 parcels that must be surveyed and appraisals conducted and offers to purchase easements above the ground made and the purchases closed. The Task Order is for $50,000.00 to do the surveys and prepare the easements. Tom Reed of Reed and Associates Appraisers estimated that the appraisals can be done for approximately $1,000.00 per parcel average plus $500.00 per parcel for review appraisals as required by the FAA. We estimate approximately $1,000.00 per parcel to purchase the easements from the property owners average. Request approval to apply for and receive the FAA and State Grants and once approved to award Task Order #4 to McClelland to get the project started. Paul Burns, FAA Program Manager, has stated that funds are in the budget for Drake Field and should be available when the Congress passes the budget. We will not accomplish any of the work until such time as grant funds are available. RECOMMENDATION: Approve Runway 34 Avigation Easement Project for Drake Field BUDGET IMPACT: Total Project cost estimated to be $200,000.00. This project is funded by the FAA at 95% and by Arkansas Aeronautics at 5%. Consistency with Local Plans. — The project is reasonably consistent with plans (existing at the time of submission of this application) of public agencies that are authorized by the State in which the project is located to plan for the development of the area surrounding the airport. Public Hearings. — In projects involving the location of an airport, an airport runway or a major runway extension, it has afforded the opportunity for public hearings for the purpose of considering the economic, social, and environmental effects of the airport or runway location and its consistency with goals and objectives of such planning as has been carried out by the community and it shall, when requested by the Secretary, submit a copy of the transcript of such hearings to the Secretary. Further, for such projects, it has on its management board either voting representation from the communities where the project is located or has advised the communities that they have the right to petition the Secretary concerning a proposed project. Air and Water Quality Standards. — In projects involving airport location, a major runway extension, or runway location it will provide for the Governor of the state in which the project is located to certify in writing to the Secretary that the project will be located, designed, constructed, and operated so as to comply with applicable and air and water quality standards. In any case where such standards have not been approved and where applicable air and water quality standards have been promulgated by the Administrator of the Environmental Protection Agency, certification shall be obtained from such Administrator. Defaults. - The Sponsor is not in default on any obligation to the United States or any agency of the United States Government relative to the development, operation, or maintenance of any airport, except as stated herewith: None 3. Possible Disabilities. - There are no facts or circumstances (including the existence of effective or proposed leases, use agreements or other legal instruments affecting use of the Airport or the existence of pending litigation or other legal proceedings) which in reasonable probability might make it impossible for the Sponsor to carry out and complete the Project or carry out the provisions of Part V of this Application, either by limiting its legal or financial ability or otherwise, except as follows: None 4. Consistency with Local Plans. — The project is reasonably consistent with plans existing at the time of submission of this application) of public agencies that are authorized by the State in which the project is located to plan for the development of the area surrounding the airport. In making a decision to undertake any airport development project under Title 49, United States Code, it has undertaken reasonable consultations with affected parties using the airport which project is proposed. Public Hearings. — In projects involving the location of an airport, an airport runway or a major runway extension, it has afforded the opportunity for public hearings for the purpose of considering the economic, social, and environmental effects of the airport or runway location and its consistency with goals and objectives of such planning as has been carried out by the community and it shall, when requested by the Secretary, submit a copy of the transcript of such hearings to the Secretary. Further, for such projects, it has on its management board either voting representation from the communities where the project is located or has advised the communities that they have the right to petition the Secretary concerning a proposed project. Air and Water Quality Standards. — In projects involving airport location, a major runway extension, or runway location it will provide for the Governor of the state in which the project is located to certify in writing to the Secretary that the project will be located, designed, constructed, and operated so as to comply with applicable and air and water quality standards. In any case where such standards have not been approved and where applicable air and water quality standards have been promulgated by the Administrator of the Environmental Protection Agency, certification shall be obtained from such Administrator. Notice of certification or refusal to certify shall be provided within sixty days after the project application has been received by the Secretary. Exclusive Rights — There is no grant of an exclusive right for the conduct of any aeronautical activity at any airport owned or controlled by the Sponsor except as follows: None 10. Land. — (a) The sponsor holds the following property interest in the following areas of land* which are to be developed or used as part of or in connection with the Airport subject to the following exceptions, encumbrances, and adverse interests, all of which areas are identified on the aforementioned property map designated as Exhibit "A": None. The project includes surveying and appraisal for the purpose of acquiring avigation easements over privately - owned properties. See Exhibit "A" map of the vicinity of the proposed avigation easement acquisitions. The Sponsor further certifies that the above is based on a title examination by a qualified attorney or title company and that such attorney or title company has determined that the Sponsor holds the above property interests.
