That the City Council of the City of Fayetteville, Arkansas hereby approves an amendment to the jail services interlocal agreement with Washington County, Arkansas, setting fees at $55.00 per booked prisoner for calendar year 2011. Code Ann. §14-14-910, by and between the County of Washington, Arkansas (hereinafter referred to as the "County"), and the City of Fayetteville, Arkansas, (hereinafter referred to as the "City"), herein collectively known as the "Parties". WITNESSETH: WHEREAS, the Parties entered into an Interlocal Agreement for Jail Services dated October 19, 2004, which was supplemented by an Addendum on April 19, 2005, and amended on January 10, 2006; and, WHEREAS, the Parties desire to further amend the Agreement. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS AND OBLIGATIONS OF THE PARTIES CONTAINED HEREIN, BE IT AGREED: 1. Effective January 1, 2011, Section 5 of the Interlocal Agreement for Jail Services, as amended January 10, 2006, is further amended to read as follows: "5. DURATION. The initial term of this Agreement shall commence January 1, 2011, and shall expire on December 31, 2011. The County further agrees to make jail space for City prisoners an operational priority during the initial term and any subsequent term of the Agreement." 2. Effective January 1, 2011, Schedule A of the Interlocal Agreement for Jail Services, as amended January 10, 2006, is further amended to read as follows: "SCHEDULE A The current cost of keeping a County Prisoner in jail has been determined to be Sixty Five Dollars ($65.00) per day, however, due to the fact that citizens of the City are paying a one quarter percent ('/a%) sales and use tax, and due to the long and ongoing history of sharing resources between the Washington County Sheriff and the Fayetteville Police Department, the County shall charge the City Fifty -Five Dollars ($55.00) per booked prisoner. Beginning in January, 2011 and each year thereafter, the cost per booking will be based on the number of prisoners booked the preceding month. The per diem amount shall be adjusted to reflect increases in the actual cost based on the actual number of bookings for the preceding month. County 1 shall provide detailed information to City to justify said costs, but in any event, the rate per booking shall not be increased by more than ten percent (10%) per year. *Payments beginning in 2010 will be billed monthly. *Note: The ten percent (10%) increase for 2011 is reflected in this amended schedule." This agreement allows that Washington County will provide jail space for City of Fayetteville prisoners in exchange of the City paying a set price for each booked prisoner. It is the desire of both Washington County and the City of Fayetteville to amend Section 5 of the Interlocal Agreement for Jail Services to extend the term of this agreement to include the 2011 calendar year and Schedule A to set a price of $55.00 per prisoner booking. The 2011 prisoner booking fee of $55.00 is a ten percent (10%) increase over the 2010 rate of $50.00 which is consistent with the Interlocal Agreement for Jail Services that specifies "the rate per booking shall not be increased by more than ten percent (10%) per year. The last rate increase on the per prisoner booking fee occurred in 2008. RECOMMENDATION: Staff recommends approval of a resolution amending the Washington County Jail Services Interlocal Agreement for the 2011 calendar year and setting the jail fees at $55.00 per booked prisoner. BUDGET IMPACT: This rate increase will add a projected $22,500 to our expenses for jail services, however, staff included the anticipated booking fee increase in the approved 2011 budget.
