FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes
the application for and acceptance of a 2011 Assistance to Firefighters matching grant in an
amount up to $800,000.00 with a twenty percent (20%) city match in an amount up to
$160,000.00.

Subject: Staff requests a resolution for approval to apply for the 2011 Assistance to Firefighters Grant
program. The amount to be requested will be $800,000.00 for the purchase of a 75' aerial fire apparatus. The
city's obligation under this grant program is a 20% matching contribution of $160,000.00 if awarded.
PROPOSAL:
The City of Fayetteville Fire Department is requesting approval to apply for a grant to purchase a 75' aerial
apparatus. This apparatus would be used to replace a 1997 KME engine/pumper that currently serves as a
reserve unit. The current apparatus has served the department well, but is reaching a point at which it is
becoming a mechanical liability. It has been repaired numerous times, but now is showing signs of inevitable
catastrophic failure of the motor. Due to the condition of the department's fleet, it is used as a reserve unit more
often than was initially planned.
If the Fayetteville Fire Department is awarded the grant being requested, this unit would be removed from the
fleet. The new apparatus would be moved to a front line status. A current front line 75' aerial that is a 2002
model would then be used as a reserve unit. This would still afford the department the ability and flexibility to
use this apparatus as both an aerial and an engine. With the age of the department's fleet, and the increased call
volume, it will be even more important for a solid and trusted reserve to be in place.
RECOMMENDATION:
Staff requests a resolution for approval to apply for the 2011 Assistance to Firefighters Grant program. The
amount to be requested will be $800,000.00 for the purchase of a 75' aerial fire apparatus. The city's obligation
under this grant program is a 20% matching contribution of $160,000.00 if awarded.
BUDGET IMPACT:
Funds for the City's 20% match contribution are available in Project 03047 Fire Department Act 833 Revenue
and Project 03019 Fire Apparatus Purchases.

The City of Fayetteville Fire Department, located in
Northwest Arkansas, serves and protects the citizens
and visitors of the 55 square miles that make up the city.
This is accomplished by the 110 (career) uniformed
personnel that operate seven stations, six engines, three
ladders, one aircraft rescue, one brush unit, and multiple
support/staff vehicles. Three civilian personnel assist
with fire safety education, administrative assistance and
coordination/documentation of the financial activities of
the department.
Members of the department are tasked with the usual
variety of responsibilities that the fire service has
becomeaccustomed to handling. Fire suppression,
public education, specialized rescue, hazardous
materials mitigation, fire safety codes, origin/cause
investigations and medical assistance round out the
short list of duties that personnel are tasked with. All
uniformed personnel are trained to the level of
Emergency Medical Technician. Medical transport and
advanced life support is provided by a regional
ambulance authority based in the city.
Fayetteville has partnered with neighboring cities and
departments in order to establish automatic and mutual
aid agreements. Not only does this benefit the
departments, but it enhances the service that each
agency can provide to the people that we serve.
Fayetteville's population of 73,580 citizens increases
when the students return to the University of Arkansas
every school year. The University represents an
increase in population to the city of approximately
20,000 to 23,000 additional customers. Not only does
the University provide for higher education, avenues for
research and sporting events — it is host to multiple

camps, conferences and meetings. One of the biggest
groups to come to the campus is the Walmart
Shareholder's Meeting. Approximately 14,000 visitors
from all around the world come to Fayetteville to attend
the meeting and participate in the activities.
Due to the diversity of the landscape and attractions,
Fayetteville becomes the destination of more than
students and corporate event participants. The natural
beauty of the hills, streams and lakes in Northwest
Arkansas bring people from all points of the map to our
city. Scenic beauty is not the only attraction that keeps
the city active. Fayetteville offers a multitude of options
to keep both citizens and visitors occupied. The
entertainment district of the Dickson Street area, just
south of the University campus, offers restaurants,
clubs, theatres and shops. In the fall of the year this area
is the focus point for the third largest biker rally in the
United States. Bikes, Blues and BBQ hosts
approximately 400,000 visitors ready to ride the roads of
Fayetteville and northwest Arkansas, and take in the
patchwork of colors that Fall in the Ozarks has to offer.
The personnel of the Fayetteville Fire Department are
dedicated servants that stand vigilant to provide
assistance and safety to all who need it in Fayetteville
and surrounding areas.

In the City of Fayetteville, funding for
essential services is generated from sales
tax revenue. The Fire Department is in
constant competition with other City
divisions for the same resources. With the
amount of growth experienced over the past
few years, coupled with the current
economic downturn, the needs of many of
the City department's far outpace the
resources available. According to the U.S.
Census Bureau, in 2000 the population of
Fayetteville was 58,000. The 2010 Census
listed Fayetteville's population as 73,580.
That is an increase of 15,580 in ten years.
By the year 2025, the population is
expected to increase by an additional
40,000 people. In spite of the level of growth
experienced, the Fire Department has only
added two new stations since 1979.
The City of Fayetteville experienced a
challenging fiscal year in 2010 and those
challenges have continued into 2011. Sales

tax for city-wide operations and capital have
steadily declined. The Fire Department's
operating budget has suffered a 1.3%
decrease in 2011 from 2010 due to the need
for reductions originating from declining
sales tax revenue. Actual spending has
outpaced budgetary projections over the
past few years due to an increase in the
number of personnel, rising fuel costs and
rising health care costs. Meeting the
personnel cost burden has and will continue
to be a challenge for the Fire Department.
For this reason, funds are decreasing for
normal operating expenses and non-
existent for equipment. Funding to support
the purchase of this life-saving equipment is
far beyond our fiscal capabilities for the
foreseeable future.
We have approached the local government
officials for assistance to purchase this
truck. The department's fleet is aging and
managing mechanical issues, while
providing apparatus for personnel to
respond in, is a daily issue. Sales tax is
down and unemployment is up. The money
is not available to fund a new aerial which
will allow the department to move a current
aerial into a reserve status. This grant will
afford the department the means to have a
dependable reserve aerial apparatus. The
City realizes that we need this apparatus
and have pledged to fund the 20% matching
if we are successful in receiving the grant.
We have also made an added effort to
extend the operation life of our current fleet.
However, within the next five years we will
have to replace, or refurbish, two to three
engines and one ladder truck. Revenue
shortfalls in the city's sales tax still loom for
the end of 2011. This will further delay our
ability to purchase the proposed aerial
apparatus.
Funding of this request will solve the
deficiencies identified. It will have a long
range and a positive lasting effect on the
Fayetteville Fire Department.
Implementation of this project will directly
benefit the citizens of our community and
the surrounding area, address fundamental
safety and operational issues within the
department, and benefit the adjoining
automatic/mutual aid fire departments.
We feel that we are the type of department
that the Assistance to Firefighter's Grant is
designed and intended to help. The
demands on our department are increasing

we do not have the resources to supply our
firefighters. with the training and equipment
they need. We appreciate your support and

The City of Fayetteville is not an island. The request for the grant to purchase an aerial apparatus will not only
serve the citizens of Fayetteville, but will also help to serve the department's mutual/automatic aid partners. It is
the practice of the department, and its partners, to send the equipment requested if available. If it is not
available, it is sent as soon as it becomes available and there is still a need.
Most of the neighboring departments do not have aerial apparatus in their fleets. If the incident dictates the
request of an aerial device, departments that can fill this request, do so. However, due to the current state of
Fayetteville's fleet, it becomes an issue of leaving our city vulnerable while assisting another. This loss of
flexibility, in the long run, could have catastrophic consequences. The times that the department has a reserve
aerial, which could be put in service if one of the front line apparatus are out of service, has become marginal.
However, the department's stance is to handle the task at hand, and to worry about "what could happen" when
and if it does.
Fayetteville's ladder companies do not function solely as suppression companies. The ladder companies are
also tasked with vehicle extrication and specialized rescue. This duality of responsibility, suppression and
rescue, further increases the value of these apparatus. Elevated waterways and access to structures is only a
small facet of the ladder company's capabilities. It is not uncommon to see ladder companies assisting on fires
and extrications, but also in rural areas where reach and access is limited by what an engine company's tool
cache can offer.
The department's ladder companies have successfully completed more than one rescue with our partners by the
use of our aerial devices. The department philosophy is that the aerial is a tool — not to be used only in special
circumstances, but when it can make a difference. The department has even responded to specialized incidents
in cities that are not mutual/automatic aid partners and even into adjacent counties in which we could make a
difference.
Fayetteville has not cornered the market in regard to "hard times". Most departments are working to maintain a
standard level of service with Iess..Due to this, it is even more important that departments work together to share

As the duly authorized representative of the applicant I certify that the applicant:
1. Has the legal authority to apply for Federal assistance and the institutional, managerial and
financial capability (including funds sufficient to pay the non -Federal share of project costs) to
ensure proper planning, management and completion of the project described in this
application.
2. Will give the awarding agency, the Comptroller General of the United States, and if
appropriate, the State, through any authorized representative, access to and the right to
examine all records, books, papers, or documents related to the award; and will establish a
proper accounting system in accordance with generally accepted accounting standards or
agency directives.
3. Will establish safeguards to prohibit employees from using their positions for a purpose that
constitutes or presents the appearance of personal or organizational conflict of interest, or
personal gain.
4. Will initiate and complete the work within the applicable time frame after receipt of approval of
the awarding agency.
5. Will comply with the Intergovernmental Personnel Act of 1970 (42 U.S.C. Section 4728-4763)
relating to prescribed standards for merit systems for programs funded under one of the
nineteen statutes or regulations specified in Appendix A of OPM's Standards for a Merit
System of Personnel Administration (5 C.F.R. 900, Subpart F).
6. Will comply with all Federal statutes relating to nondiscrimination. These include but are not
limited to: (a) Title VI of the Civil Rights Act of 1964 (P.L. 88-352) which prohibits
discrimination on the basis of race, color or national origin; (b) Title IX of the Education
Amendments of 1972, as amended (20 U.S.C. Sections 1681-1683, and 1685-1686), which
prohibits discrimination on the basis of sex; (c) Section 504 of the Rehabilitation Act of 1973,

7. Will comply, or has already complied, with the requirements of Title II and Ill of the Uniform
Relocation Assistance and Real Property Acquisition Policies Act of 1970 (P.L. 91-646) which
provide for fair and equitable treatment of persons displaced or whose property is acquired
as a result of Federal or federally -assisted programs. These requirements apply to all interest
in real property acquired for project purposes regardless of Federal participation in
purchases.
8. Will comply, as applicable, with provisions of the Hatch Act (5 U.S.C. §§1501-1508 and 7324-
7328) which limit the politicalactivities of employees whose principal employment activities
are funded in whole or in part with Federal funds.
9. Will comply, as applicable, with the provisions of the Davis -Bacon Act (40 U.S.C. §§276a to
276a-7), the Copeland Act (40 U.S.C. §276c and 18 U.S.C. §874), and the Contract Work
Hours and Safety Standards Act (40 U.S.C. §§327-333), regarding labor standards for
federally -assisted construction subagreements.
10. Will comply, if applicable, with flood insurance purchase requirements of Section 102(a) of
the Flood Disaster Protection Act of 1973 (P.L. 93-234) which requires recipients in a special
flood hazard area to participate in the program and to purchase flood insurance if the total
cost of insurable construction and acquisition is $10,000 or more.
11. Will comply with environmental standards which may be prescribed pursuant to the following:
(a) institution of environmental quality control measures under the National Environmental
Policy Act of 1969 (P. L. 91-190) and Executive Order (EO) 11514; (b) notification of violating
facilities pursuant to EO 11738; (c) protection of wetlands pursuant to EO 11990; (d)
evaluation of flood hazards in floodplains in accordance with EO 11988; (e) assurance of
project consistency with the approved State management program developed under the
Coastal Zone Management Act of 1972 (16 U.S.C. §§1451 et seq.); (f) conformity of Federal
actions to State (Clean Air) Implementation Plans under Section 176(c) of the Clean Air Act
of 1955, as amended (42 U.S.C. §§7401 et seq.); (g) protection of underground sources of
drinking water under the Safe Drinking Water Act of 1974, as amended (P.L. 93-523); and,
(h) protection of endangered species under the Endangered Species Act of 1973, as
amended (P.L. 93-205).
12. Will comply with the Wild and Scenic Rivers Act of 1968 (16 U.S.C. Section 1271 et seq.)
related to protecting components or potential components of the national wild and scenic
rivers system.
13. Will assist the awarding agency in assuring compliance with Section 106 of the National
Historic Preservation Act of 1966, as amended (16 U.S.C. 470), EO 11593 (identification and
protection of historic properties), and the Archaeological and Historic Preservation Act of
1974 (16 U.S.C. 469a-1 et seq.).
14. Will comply with P.L. 93-348 regarding the protection of human subjects involved in research,
development, and related activities supported by this award of assistance.
15. Will comply with the Laboratory Animal Welfare Act of 1966 (P.L. 89-544, as amended, 7
U.S.C. 2131 et seq.) pertaining to the care, handling, and treatment of warm blooded animals
held for research, teaching, or other activities supported by this award of assistance.
16. Will comply with the Lead -Based Paint Poisoning Prevention Act (42 U.S.C. Section 4801 et
seq.) which prohibits the use of lead based paint in construction or rehabilitation of residence
structures.
17. Will cause to be performed the required financial and compliance audits in accordance with
the Single Audit Act Amendments of 1996 and OMB Circular No. A-133, "Audits of States,
Local Governments, and Non -Profit Organizations."
18. Will comply with all applicable requirements of all other Federal laws, executive orders,
