BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby awards Bid
#11-41 and approves a five (5) year airport hay field lease with Donnie Sams of West Fork,
Arkansas in the total rental amount of $12,805.00.

RECOMMENDATION: Approve with the Mayor and City Clerk's signatures the Airport Hay Field Lease Agreement
with Donnie Sams, 238 Doke St., West Fork, AR 72774, ph. 479-839-2915.
BACKGROUND: The Airport has established certain areas of the Airport to be leased for hay removable. The Lease
explains the regulations for removing hay, care of the fence rows, fertilizing, no livestock, and no hunting.
DISCUSSION: The Hay Field Lease was bid out through the City of Fayetteville as Bid 11-41, and Mr. Sams was
awarded the bid on June15, 2011.
BUDGET IMPACT: Lease is for five years for a total sum of $12,805.00, to be paid in annual amounts of $2,561.00.

This Agreement executed this l 1 day of Ju , 2011 , between the City of
Fayetteville, Arkansas, a municipal corporation, hereinafter called "Fayetteville" and Donnie Sams of
238 Doke St, West Fork, AR, 72774 479-839-2915 , hereinafter called "Donnie Sams".
1. Premises. Fayetteville hereby leases to Donnie Sams, and Donnie Sams hereby leases from
Fayetteville, the following described property situated in Washington County, Arkansas:

Approximately 90 acres, more or less, or that portion of the Drake Field / Fayetteville Municipal
Airport property marked on the map entitled, "Exhibit A", attached hereto and made a part
hereof.
2. Term. This Lease shall be for a term of five (5) years commencing on the 15th day of
June_., 2011 and ending on the 14th day of June , 2016.
3. Consideration. In consideration of Fayetteville leasing the above described property to Donnie Sams
for the aforesaid term, Donnie Sams agrees to pay Fayetteville a total sum of $ 12,805.00 dollars,
payable as follows: Upon execution of this agreement, Donnie Sams shall pay Fayetteville $ 2561.00
dollars annually, on or before the _1st day of July_ of this year and each succeeding year while
this lease is in effect.
4. Airport Minimum Standards The document titled The Minimum Standards for Fayetteville Municipal
Airport Drake Field is hereby attached in its entirety and made part of this agreement.
5. Conditions. This lease shall be subject to the following conditions:
a. This lease shall be for the sole purpose of removing hay from any or all of the above described
property as marked as hayfield(s) on Exhibit A.
b. Donnie Sams agrees that livestock shall not be permitted to enter upon any land at Fayetteville
Municipal Airport -Drake Field.
c. Donnie Sams shall keep and maintain the property covered by this lease in a good condition; that
he/she will keep all fence rows and drains free and clear of weeds, underbrush and obstructions
at all times.
d. Donnie Sams shall fertilize said lands annually. Additionally, Donnie Sams shall administer the
fertilizer in accordance with the Airport's nutrient reduction plan.

e. Donnie Sams shall brush -hog or otherwise keep the brush cut annually from all areas not mowed
for hay.
f. Donnie Sams shall not erect any structures of any nature whatsoever on said property including
additional fences or gates without explicit written permission from the Airport Manager.
g. Donnie Sams shall not permit any public nuisance to exist on said lands.
h. Donnie Sams shall not cut, remove, or carry off nor allow to be cut, removed, or carried off,
from said above described lands any tree, soil, rock, or minerals of any kind whatsoever, except
for hay. Furthermore, Donnie Sams specifically agrees that he/she will not hunt, or allow
hunting by any person or persons on said property.
i. Donnie Sams agrees that Fayetteville, or its agents, shall have the right at all times to enter upon
said property for the purposes of inspecting same.
j. Fayetteville shall have the right of granting easements for any purpose on, over, and across said
property.
k. Fayetteville shall have the right to enter upon said land for the purpose of constructing and/or
maintaining anything that Fayetteville in its own judgment may require without the necessity to
notify, or of having to pay any compensation to the Donnie Sams as damages by reason of the
exercise of any of these rights and privileges.
1. Donnie Sams agrees to procure liability insurance as specified in The Minimum Standards for
Fayetteville Municipal Airport Drake Field. Donnie Sams agrees to submit annually a valid
Certificate of Liability Insurance.
m. Donnie Sams hereby agrees to hold harmless and indemnify Fayetteville from any and all claims
or damages occasioned by or arising from Donnie Sams's activities upon the above described
property.
n. Donnie Sams shall not assign this Lease or sublet any part of the above described property
without first obtaining the written consent of Fayetteville.
o. This Agreement may be terminated by either party upon sixty (60) days written notice of
termination to the other party.
p. Notice as provided for herein shall be sufficient if sent by Certified Mail, postage prepaid,

6. Standard Federally Required Conditions. Under no circumstances is this lease an exclusive right to
provide this service. Fayetteville is prohibited by Federal Regulation/Grant Assurances V, Item C,
Sponsor Certification 22 and 23, from granting exclusive privileges to provide services or conduct
business. Donnie Sams shall furnish services on a fair, equal and not unjustly discriminatory basis to all
users of the service provided.
