WHEREAS, the City of Fayetteville understands Federal -Aid Recreational Trails Funds are available at 80% federal participation and 20% local match to develop or improve the Lake Fayetteville Trail on the south side of the lake to Veterans Memorial Park; and, WHEREAS, the City of Fayetteville understands that Federal -Aid Funds are available for this project on a reimbursable basis, requiring work to be accomplished and proof of payment prior to actual monetary reimbursement; and, WHEREAS, the City of Fayetteville understands that there will be no reimbursement for any work accomplished prior to the issuance by the Arkansas State Highway and Transportation Department of an official Notice to Proceed; and, WHEREAS, this project, using federal funding, will be open and available for use by the general public and maintained by the applicant. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City of Fayetteville, Arkansas, will participate in accordance with its designated responsibility, including maintenance of this project. Section 2. That the Mayor is hereby authorized and directed to execute all appropriate agreements and contracts necessary to expedite the construction of the above stated project. Section 3. That the City Council of the City of Fayetteville, Arkansas, pledges its full support and hereby authorizes the City of Fayetteville to cooperate with the Arkansas State Highway and Transportation Department to initiate action to implement this project. RECOMMENDATION: The Recreational Trails Grant is administered through the Arkansas Highway and Transportation Department and has been the most substantial grant program for trail funding over the years (see history below). For the 2110 recreational trail grant application, staff has selected the 1 -mile. long section of paved trail to complete the paved loop around Lake Fayetteville to Veterans Memorial Park. With the high number of trail users at Lake Fayetteville and the strong connectivity to recreational amenities, this trail project will complement the requirements of the grant and should be successful for funding. Summary of the Recreational Trails Grant awards to the City of Fayetteville: • 1997 Recreational Trails Grant (040271) - $20,000 - Three trailhead kiosks at Lake Fayetteville Status: Complete • 2002 Recreational Trails Grant (040401)- $51,247 - Used for the Lake Fayetteville Spillway Bridge Status: Complete • 2003 Recreational Trails Grant (040425) - $20,000 - Was combined with the 2002 funds into one project and used for the Lake Fayetteville Spillway Bridge Status: Complete • 2007 Recreational Trails Grant (040507) - $33,600 - Project underway to replace and existing narrow trail bridge on Mud Creek Trail and bring the trail into compliance with ADA. Status: Complete • 2008 Recreational Trails Grant (040530) - $60,000 - Project to extend Mud Creek Trail under and across the Old Missouri Road to connect to Sweetbriar Drive. Status: Complete • 2009 Recreational Trails Grant (040558) - $116,534 — Oak Ridge Trail construction from Frisco Trail west to the University of Arkansas Campus. Status: Final Design. THE CITY OF FAYETfEVILLE, ARKANSAS BUDGET IMPACT: If approved by City Council, the grant application will be submitted for a total amount of $180,000.00. The terms of this grant require a local sponsor or municipality to provide funding for 20% of the total project cost, or $30,000.00. Upon receipt of an official Notice to Proceed from the Arkansas Highway and Transportation Department, the project would be reimbursable at a rate of 80%, which for this project would be a total reimbursement of $150,000.00, if fully funded by the grant. Sufficient funding not to exceed $30,000.00 for the City's portion of this project will need to be budgeted for 2011 in the Trail Development Project, within the Sales Tax Capital Improvement Fund. This phase of trail will complete the 5.5 mile paved loop around Lake Fayetteville. The trail will be constructed by the City's in-house transportation crew. RECOMMENDATION: Staff requests approval of the attached contract with the Arkansas State Highway and Transportation Department for the implementation of Lake Fayetteville Trail (Job 040613) by the City of Fayetteville through the Arkansas Recreational Trails Program. An Agreement of Understanding was approved on December 20th, 2011 by resolution 219-11 to utilize $80,000 in federal -aid funds for the extension of the Lake Fayetteville Trail between the Botanical Gardens and Veterans Memorial Park. A willingness to apply for this grant was approved on May 18th, 2010 by resolution 81-10. Since the allocation of funds has previously been approved by the City Council, no Council action is needed for this item. This contract simply formalizes the method by which the project will be constructed and sets forth the specifications to be followed during construction by the City crews. BUDGET IMPACT: The terms of this grant require a local sponsor or municipality to provide funding for 20% of the total project • cost, or $20,000.00. Upon receipt of an official Notice to Proceed from the Arkansas Highway and Transportation Department, the project will be reimbursable at a rate of 80%, which for this project would be a total reimbursement of $80,000.00. Sufficient funding for the City's portion of this project has been budgeted for 2012 in the Trail Development Project, within the Sales Tax Capital Improvement Fund. The City of Fayetteville (hereinafter called "the Sponsor") will construct said project under the conditions set forth in the Agreement of Understanding executed between the Sponsor and the Arkansas State Highway and Transportation Department (hereinafter called "the Department"). The fixed completion date for the project is December 31, 2013. The total federal share of the cost of this project will be $80,000. This will be matched by $20,000 or greater to be provided by the Sponsor. This is a lump sum contract. Expenses incurred by the Sponsor for the implementation of this project will be reimbursed to the Sponsor by AHTD based on amounts contained in the enclosed Contract Schedule of Prices. The Sponsor can claim reimbursement upon completion of the project or prior to completion of the project. Two progress reimbursements are allowed, one at 30% of completion and another at 60% of completion. The final 40% of federal funds will be withheld until the project is complete. Each reimbursement will be preceded by a visual verification conducted by the Department. The Sponsor will be responsible for all day-to-day construction inspection and will be responsible for certifying to the Department that all construction has been accomplished in accordance with the enclosed Plans and Specifications. The Sponsor will maintain all records pertaining to claims, billings, time sheets, materials invoices, and other pertinent records as per requirements outlined in the Agreement of Understanding, executed between the Sponsor and the Department.
