HomeMy WebLinkAbout207-10 RESOLUTIONRESOLUTION NO. 207-10 A RESOLUTION AUTHORIZING ACCEPTANCE OF A NON-MATCHING ARKANSAS STATE POLICE SPECIAL STATE ASSET FORFEITURE GRANT IN THE AMOUNT OF $19,302.00 FOR THE PURCHASE OF AN UNDERCOVER LAW ENFORCEMENT VEHICLE, AND APPROVING A BUDGET ADJUSTMENT BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes acceptance of a non-matching Arkansas State Police Special State Asset Forfeiture Grant in the amount of $19,302.00 for the purchase of an undercover law enforcement vehicle. Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget adjustment, a copy of which is attached as Exhibit "A," recognizing the revenue. We currently have one unmarked investigative vehicle that is a high mileage vehicle with on-going maintenance issues that is in need of replacement. We plan to purchase a pick-up truck with this funding to increase efficiency and handling of evidence gathered by our criminal investigations unit. Our Internet Crimes Against Children, Sex Offender, and Highway Interdiction programs generate a large amount of evidence that cannot be easily transported in our current sedans. RECOMMENDATION: Staff recommends approval of the 2010 ASP Special Assets Forfeiture Grant award in the amount of $19,302.00 for the replacement of an unmarked investigative vehicle. Phillips Date Director Agency • Date Arkansas State Police Special State Assets Forfeiture Fund 1 State Police Plaza Drive Little Rock, AR 72209 MEMORANDUM OF UNDERSTANDING In accordance with ACA 5-64-505 the Arkansas State Police was charged with the responsibility of disbursing moneys from the Special State Assets Forfeiture Fund and federal forfeitures. Pursuant to the foregoing authority, the Arkansas State Police has established the Special State Assets Forfeiture Fund Committee to award funds, which in the Committee's opinion, will best facilitate drug enforcement operations. In accordance with the foregoing a joint agreement between the Arkansas State Police and the Fayetteville Police Department is entered for a period of July 1, 2010 through March 31, 2011. The recipient of the awarded funds agrees to maintain records and receipts for items purchased with the grant funds and will furnish copies of all receipts to the Arkansas State Police by the 10th day of the month following the expenditure. Any modification or changes above 10% to the grantee's approved budget must be authorized by the Arkansas State Police before expenditures for the changes can be made. Any awarded funds not expended during the period set out in the preceding paragraph and in accordance with grantee's budget or approved changes shall be refunded to the Arkansas State Police by 4:30 p.m. March 31' 2011. The awarded funds are subject to audit by the Arkansas State Police and/or the Department of Legislative Audit. Misuse of these funds will result in the Fayetteville Police Department reimbursing the Arkansas State Police for the funds awarded. The following items will NOT be considered for funding and any funds awarded should not be used for these items: • Salaries, over time, fringe benefits related to salaries • Contractual services, and travel related expenditures • Electronic Immobilization Devices • Drug Court Programs • Real Estate • Vessel or Aircraft • Construction Projects • Buy Money This MOU shall remain in full force and effect beginning on the date of signature and continuing for the duration of the current agreement period.
