That the City Council of the City of Fayetteville, Arkansas hereby approves Change Order #3, a copy of which is attached as Exhibit "A," to the contract with Sweetser Construction, Inc. in the amount of $66,668.00 for the construction of phase three of Bryce Davis Park. The project will include the addition of approximately 386 linear feet of concrete sidewalk, installing a second pavilion donated by Ozark Natural Foods, 5 benches, 5 tables, an electrical extension, 15 trees and a 24 space parking lot. The type of work required with the addition of this phase is consistent with the work already performed by Sweetser Construction, Inc. while constructing the dog park. The project is funded with Park Development funds from Park Land Dedication Northwest Quadrant. Park Land Dedication funds must be spent within three years of receipt. The approval of this change order will ensure the required funds for this quadrant are spent this year. Additional Time Requested: 60 Calendar Days Dated this 12 day of October 2010. PROPOSAL: Bryce Davis Park is located at 1595 N. Dartmouth Dr. Approximately 17 acres were added to the existing 9.2 acre park in 2008. The park now serves as a community park for the northwest quadrant of the City. A master plan for the park has been developed and is being constructed in phases. Phase one included the addition of a restroom which is complete. The second phase included the construction of lams Dog Park which was opened on October 14th and the third phase includes an additional pavilion, picnic areas, benches and tables and parking area. On February 16, 2010 City Council passed Resolution No. 33-10 awarding Bid # 10-15 and aproving a contract with Sweetser Construction, Inc, in the amount of $122,027 for the construction of lams Park at Bryce Davis. Staff has submitted a phased Site Improvement Plan for phase three of the park development. The first phase will include the addition of approximately 386 linear feet of concrete sidewalk, installing a second pavilion donated by Ozark Natural Foods, 5 benches, 5 tables, an electrical extension, 15 trees and a 24 space parking lot. The second phase will include the parking lot and associated landscaping which will be constructed in 2011. The type of work required with the addition of the first phase is consistent with the work already performed by Sweetser Construction, Inc. while constructing the dog park. RECOMMENDATION: Staff recommends approving change order # 3 with Sweetser construction to construct concrete sidewalk and set a pavilion, picnic tables and benches in the amount of $66,668. A project contigency balance of $1,643 remains. BUDGET IMPACT: The project is funded with Park Development funds from Park Land Dedication Northwest Quadrant. Park Land Dedication funds must be spent within three years of receipt. The approval of this change order will ensure the required funds for this quadrant are spent this year.
