A RESOLUTION APPROVING THE TRANSPORTATION DIVISION
OVERLAY/SIDEWALK PROJECTS LIST FOR 2009.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS•
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby approves
the Transportation Division Overlay/Sidewalk Projects list for 2009. A copy of the 2009
Overlay/Sidewalk Projects list, marked Exhibit A, is attached hereto and made a part hereof.

2009 Overlay/Sidewalk Projects
Recommendation: Approval of 2009 Overlay/Sidewalk Projects
Background: Each year the Transportation Division reviews the need for street overlays
based on existing conditions of streets. The In -House Pavement Improvements program
includes asphalt, curb and guttering, pavement striping, and preparation costs for the
overlays. The Sidewalk Improvements program improves the connectivity of the
sidewalk system by constructing new sidewalk and replacing or repairing sidewalks
throughout the City. This project also includes funding for ADA accessible ramps
required for the In -House Pavement Improvements.
Discussion: The 2009 project list proposes a total of 60,172 linear feet or 11.3 miles
summarized by ward as follows:

The 2009 project list was presented to the Street Committee on January 12, 2009. The
Street Committee requests the final street overlay list be presented to the City Council for
its approval by Resolution in accordance with Ordinance No. 5173.
Budget Impact: Funds for labor, equipment, materials, and services are budgeted in the
In -House Pavement Improvements ($2,136,900) and Sidewalk Improvements ($787,000)
capital projects.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby approves
the Transportation Division Overlay/Sidewalk Projects list for 2009. A copy of the 2009

ORDINANCE NO. 5173
AN ORDINANCE TO AMEND THE CODE OF FAYETTEVILLE
TO ESTABLISH THE PROCEDURES FOR THE USE OF FUNDS
BUDGETED FOR THE IN-HOUSE STREET OVERLAY PROJECTS
WHEREAS, the Transportation Department reviews the need for street overlays (including curb
and gutter work) in the latter part of each year and presents a recommended list of sections of streets for
overlays or other construction to the Street Committee; and
WHEREAS, the Street Committee discusses these proposed projects, plus any other street
sections that might need to be considered and votes approval of the final list and
WHEREAS, the Street Committee desires that the final street overlay list of approved projects
(including curb and gutter work) should be presented to the City Council for its approval by Resolution;
and
WHYREAS, if the administration desires any additional street overlay projects or additional curb
and gutter projects during the year, it should present such project or projects to the Street Committee for
approval and seek an amendment to the authorizing Resolution prior to expending funds for such
additional project or projects.
NOW, ilitREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas, hereby amends Chapter 33
Departments, Boards, Commissions and Authorities of Title HI of the Code of Fayetteville by
enacting a new Article XVII entitled Transportation Division as shown below:
"ARTICLE XVII TRANSPORTATION DIVISION
"33.301 Establishment
"The Transportation Division (formerly !mown as the Street Department)
has long been established in Fayetteville to maintain and improve city
streets, curbs, gutters and sidewalks and to perform related services for
our citizens. The Transportation Division works under the supervision of
the Mayor and the budgetary authorization of the City Council.

"33.302 City Overlay Program
"(a) In the early 1990s, the City began its in-house overlay program with
a stated goal to pave every City street for which public right-of-way existed.
Later, the overlay program also began milling and overlaying various
important, but deteriorating city streets.
"(b) In the early 2000s, the Mayor and City Council enlarged the overlay
program to maintain and overlay city streets on a regular and rotating basis
so that city streets would not deteriorate to such an extent that a full
reconstruction would be necessary.
"(c) The procedure to determine which city streets will be funded to be
overlaid and/or have curb and gutter work shall be as follows:
"(1) The Transportation Division shall report to the City Council
Street Committee during its first meeting of the year the results of the
previous year's overlay program and propose a recommended list of
sections of streets to be overlaid (and any planned curb or gutter work)
during the new year.
"(2) The Street Committee can propose additions or deletions to this
list and will recommend it to the City Council. '
"(3) The City Council after consideration and any amendments
shall approve by Resolution the approved overlay, curb and gutter
program.
"(4) If the administration wishes to amend the overlay, curb and
gutter program during the construction year to add an additional
project, it shall request the Street Committee to approve such
additional project and the City Council to amend the Resolution
with possible necessary budget adjustment to allow any such
addition to the program."
