A RESOLUTION TO APPROVE A CONTRACT WITH MARK GRANT D/B/A
PORKY CHICKS BBQ & CATERING TO OPERATE THE CONCESSION
STANDS AT WILSON PARK SWIMMING POOL, GARY HAMPTON
SOFTBALL COMPLEX, LEWIS STREET SOCCER COMPLEX AND LAKE
FAYETTEVILLE SOFTBALL COMPLEX.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section I: That the City Council of the City of Fayetteville, Arkansas hereby approves
the contract with Mark Grant d/b/a Porky Chicks BBQ & Catering (attached as Exhibit "A") to
operate concession stands at four city parks for a fee of 7% of gross sales.

Contract
THIS AGREEMENT made and entered into this 3rCiday of F b ru 0 t'y , 2009, by and between the
City of Fayetteville for the use and benefit of the Fayetteville Parks and Recreation Division, hereinafter called
CITY, and Porkv Chicks BBQ & Catering, Witnessed:
1. Leased Premises. For and in consideration of the rents, covenants, and agreements herein entered
into and agreed upon by Porky Chicks BBQ & Catering as obligations to the City, the City lets, leases and
demises unto Lessee, subject to the terms and conditions contained herein the following described property: the
concession stands (building and equipment) located at Gary Hampton Softball Complex, Lewis Street Soccer
Complex, Lake Fayetteville Softball Complex, and the Wilson Park Swimming Pool in Fayetteville, Arkansas.
To have and to hold said premises unto the said Lessee for and during the term herein stated, subject to
the covenants, terms, and conditions herein contained.
2. Term. This lease shall commence on February 1, 2009 and shall extend for a period of ten (10)
months, ending on November 30, 2009. Upon agreement of both parties, the lease shall automatically renew
for two more consecutive terms to commence on February 1, 2010 and end November 30, 2010 and to
commence on February 1, 2011 and end November 30, 2011.
3. Rent/Report. Porky Chicks BBQ & Catering agrees to pay City an amount equal to 7% percent of
all gross sales of food, beverages and refreshments no later than ten (10) working days following the close of
each month. In addition to the rental payment, Porky Chicks BBQ & Catering shall file a monthly report on the
form supplied by the City. The rental payment and monthly report shall be delivered to the Parks and
Recreation Offices at 1455 Happy Hollow Road, Fayetteville, AR 72701. Any payments to City not made
when due shall bear interest after maturity at the maximum effective agreement rate which may be lawfully
charged.

4. Records. The City shall have the right at all times to examine Porky Chicks BBQ & Catering's
books and records and verify rental paid. Any errors or omissions shall be adjusted.
5. Use. The lease premises shall be used only for the purpose of selling food, beverages, and such
refreshments as are usually incidental to a restaurant, cafe, or soft drink concession, but specifically excluding
any alcoholic beverage or tobacco products. Further, Porky Chicks BBQ & Catering shall not use or permit the
stand to be used for any unlawful, improper or offensive purpose whatsoever.
6. Maintenance. The City will perform all major and minor repairs in each of the concession stands
leased by the Porky Chicks BBQ & Catering; and will, in its sole discretion, make any such repairs as are
necessary for the preservation of the said stand(s). Porky Chicks BBQ & Catering shall promptly notify the
Parks and Recreation Division of any needed repairs.
7. Insurance. Porky Chicks BBQ & Catering shall provide proof of worker's compensation as required
by Arkansas Statute and liability insurance with a minimum coverage of:
$300,000 for one person involved in death or injury
$500,000 for two or more persons involved in death or injury
8. Bond. Porky Chicks BBQ & Catering shall provide a $5,000 bond for performance and payment of
items in relation to this contract.
9. Rights and Duties of Concessionaire. Porky Chicks BBQ & Catering agrees to:
A. Conduct said business as not to interfere with other uses or activities on the property.
B. Open and staff the concession stand anytime the City has scheduled activities, unless
otherwise stipulated by the Parks and Recreation Division staff.
C. Open each day, at least fifteen (15) minutes prior to the first scheduled game, and shall
remain open until the last game has concluded, unless otherwise stipulated by the Parks and
Recreation Division staff.
E Comply with all local, state and federal laws, rules, regulations, orders, guidelines, and/or
directions, including, but not limited to, sales tax, HMR tax, payroll tax and the Arkansas

Department of Health guidelines regarding food preparation.
F. Maintain, protect, and secure the concession building, equipment and leased premises.
G. Porky Chicks BBQ & Catering is responsible for replacing concession equipment if
equipment is damaged beyond normal wear. City equipment cannot be loaned or removed from
the park premises without permission from Park staff. An equipment inventory is attached
hereto.
H. Clean premises daily of all debris.
I. Surrender leased premises at the end of each term in the same condition (except for normal
wear) as received, including, but not limited to removal of all refuse.
J. Leased premises must be cleaned and returned to Fayetteville Parks & recreation within five
working days after the last event per location. All items remaining after five days will be
considered the property of Fayetteville Parks and Recreation.
10. Rights and Duties of the City. The City shall:
A. Provide and pay for the water and electrical service.
B. In its sole discretion, replace depreciated concession equipment that is no longer usable.
C. Have the right to inspect the stand at any reasonable time during the term of the agreement
D. Have the right to screen for felony convictions by Fayetteville Police Department.
11. Default/Termination.
If Porky Chicks BBQ & Catering defaults in the payment of rent, or if it violates any other
covenants of this agreement, the City may terminate this contract, and the City may immediately enter and
retake possession of the concession. In the event that Porky Chicks BBQ & Catering should default in the
prompt payment or performance of any obligations as set forth herein, and in the event that it should become
necessary for City to collect any past due payments or to enforce the other obligations of Porky Chicks BBQ &
Catering as set forth herein, by suit or otherwise, City shall be entitled (in addition to all other remedies to
which it is entitled) to recover the costs and expenses of litigation. This contract may be canceled by either

party with a 30 day written notice. Legal jurisdiction to resolve any disputes must be Arkansas with Arkansas
law applying to the case.
12. Miscellaneous.
A All actions, whether sounding in agreement or in tort, relating to the validity, construction,
interpretation, and enforcement of this agreement shall be instituted and litigated in the courts of the State of
Arkansas.
B. Porky Chicks BBQ & Catering hereunder shall not sell, sublet or assign this agreement or
any portion thereof to any other person or persons.
C. Upon agreement by both parties, any part of this agreement may be changed which will
benefit the operation of concession. This agreement shall be amended only upon mutual written agreement
signed by all parties
D. Freedom of Information Act. City contracts and documents prepared while performing city
contractual work are subject to the Arkansas Freedom of Information Act. If a Freedom of Information Act
—request is presented to the City of Fayetteville, the (contractor) will do everything possible to provide the
documents in a prompt and timely manner as prescribed in the Arkansas Freedom of Information Act (A.C.A.
§25-19-101 et. seq.) Only legally authorized photocopying costs pursuant to the FOIA may be assessed for this
compliance.
E. Changes, modifications, or amendments in scope, price or fees to this contract
shall not be allowed without a prior formal contract amendment approved by the Mayor and the
City Council in advance of the change in scope, cost or fees.

RECOMMENDATION
Approval of a resolution approving contract with Mark Grant, of Porky Chicks BBQ, for
the operation of concession stand at Wilson Park Swimming Pool, Lewis, Gary Hampton,
and Lake Fayetteville Parks.
BACKGROUND
Parks and Recreation leases the operations of the Concession Stands at Gary Hampton
Softball Complex, Lake Fayetteville Softball Complex, Lewis Soccer Complex and
Wilson Park Swimming Pool. The City posted a request for proposal in which three
proposals were submitted. The Professional Selection Committee, consisting of Brenda
Thiel, Vicki Deaton, Kristen Atha, Chase Gipson and myself, chose to lease the operation
of the Concession Stands to Mark Grant of Porky Chicks BBQ & Catering. Mr. Grant
agreed to pay the City seven percent of gross sales. Upon mutual agreement of the City
and operator, the contract may be renewed for two additional years.
DISCUSSION
Mr. Grant understands the many hours of operations, the number of citizens/customers
served on a daily basis and the importance of maintaining a level of excellent customer
service. Parks and Recreation Staff believe Mr. Grant will be a very suitable
representative for both his operation and the City of Fayetteville. The contractor is
required to pay all state, county and local taxes, including the hotel motel restaurant tax
(HMR). In addition, the contractor and contractor's employees are required to pass a
background security check.
BUDGET IMPACT
In previous years the concession stands generated $20,000 to $24,000 in gross revenues
in which produced S3,400 to $4,100 to the City of Fayetteville In the 2009 Parks
Admin/Recreation Programs Budget Parks budgeted an estimated $3,600 in revenue to be
received through the concession contract.

increase the menu .Open early giving everyone coming in a chance to make a purchase
prior to start time.Stay open late giving everyone the opportunity to feed there Family
before going home.During the tournaments I would like to offer BBQ on the Menu.My.
Goal is to increase sales by offering a Combo Special to get the Customers coming in
and hopefully Maintain them for Seasons to come.Serving good Quality Food at a fair
price.these are Family events and I would like to bring a Family atmosphere so the
Families will want to eat with us at these locations instead of going somewhere else to
eat before going home.

RE: RFP 09-02, Concession Services
• RFP 09-02, has the following modifications and clarifications:
1.) REMINDER. Each submitted proposal shall list the percentage of gross sales the City will receive.
Percentage proposed to the City of Fayetteville will cover the expenses for rent/lease & utilities.
THIS PERCENTAGE DOES NOT INCLUDE TAXES.
2.) Concession sales are subject to taxes including HMR taxes. Current tax rate is 11.25%.
3.) Each proposal shall include an anticipated menu of food and drink items The City of Fayetteville
reserves the right to approve the final menu.
4.) The following concession locations are included with this RFP:
1.) Gary Hampton Softball Complex
2.) Lewis Street Soccer Complex
3.) Lake Fayetteville Complex
4.) Wilson Park Swimming Pool
5.) Anticipated schedule is listed below. The schedule is subject to change depending on games,
tournaments, etc.
1.) Gary Hampton Softball Complex:
o Adult Softball: April 7 —August: Tuesday & Wednesday from 5:45 PM — 10:30 PM
August — November: Monday -Thursday from 5:45 PM — 10:30PM
o Youth Softball: April 27 — June 22: Mondays and Thursdays from 5:30 PM — 9:00

2.) Lewis Street Soccer Complex:
Soccer. February 28 - April 18 AND August 28 — October 17: Monday, Tuesday, and
Thursday from 5:30 PM — 7:00 PM & Saturday from 8:45 AM —1:00 PM

3.) Lake Fayetteville:
o Softball: April 7 — First week of November (depending on rainouts): Monday through
Thursday with make up games on Fridays from 5:45 PM — 10:30 PM
4.) Wilson Park Swimming Pool:
o .June 6 — August 15: Open 6 days a week (closed Mondays) from 1:00 PM — 5:45
