BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget adjustment for the Fayetteville Police Department in the amount of $11,043.00 to recognize revenue from Municipal Court lab fines for the purchase of alcohol testing equipment and supplies. This BAC machine was tested and selected by the State which recommends updating all BAC machine throughout the State. PBT's are used by patrol officers, school resource officers, and bar patrol to quickly and efficiently evaluate the level of intoxication of a suspect. These devices are necessary equipment for each of our officers in these areas of work and currently we only have a few PBT's that are shared between all officers. Justification of this Decrease: Municipal Court lab fines were collected for the purchase of alcohol testing equipment per state statute. Background By State Statute, the Municipal Court collected Lab fines for the sole purpose of purchasing alcohol testing equipment for law enforcement. The Municipal Court no longer collects these fines, but has a Lab fine escrow balance of $11,043 to be used for alcohol testing equipment. Discussion The Fayetteville Police Department plans to purchase a new Breath Alcohol Content (BAC) machine in the amount of $8,232 and the balance going toward the purchase of several Portable Breath Test (PBT) devices and supplies. The BAC machine is used during the jail booking process of DWI arrestees for the purpose of accurately determining their level of intoxication. The Arkansas Department of Health has mandated that all BAC machines used in law enforcement be standardized to the Intoximeter (model ECRIR2N) BAC machine by 2010. This upgrade replaces the Datamaster BAC machine which has been the system of choice by the Health Department for the past 18 years. The PBT's are used by patrol officers, school resource officers, and bar patrol to quickly and efficiently evaluate the level of intoxication of a suspect. These devices are necessary equipment for each of our officers in these areas of work and currently we only have a few PBT's that are shared between all officers. Budget Impact None RESOLUTION NO.
