A RESOLUTION AMENDING THE 2009 CITY BUDGET BY APPROVING A
BUDGET ADJUSTMENT TO RECOGNIZE U.S. DEPARTMENT OF THE
TREASURY/INTERNAL REVENUE SERVICE FORFEITURE REVENUE
FOR THE THIRD AND FOURTH QUARTERS OF 2009 IN THE AMOUNT
OF $36,536.00 FOR USE BY THE FAYETTEVILLE POLICE DEPARTMENT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby amends the
2009 city budget by approving a budget adjustment, a copy of which is attached to this
Resolution and incorporated herein as if set out word for word, to recognize U.S. Department of
the Treasury/Internal Revenue Service forfeiture revenue for the third and fourth quarters of
2009 in the amount of $36,536.00 for use by the Fayetteville Police Department.

Re: Approval of a Budget Adjustment to recognize IRS/Treasury Forfeitures
Background
The Fayetteville Police Department receives forfeitures as a result of civil proceedings
concerning cash or property seized during a criminal investigation. The forfeitures we have
received are a direct result from the efforts of the officer we assign to the IRS Financial Crimes
Task Force.
Discussion
We must follow the Guide to Equitable Sharing of Federally Forfeited Property for State
and Local Law Enforcement Agencies to spend IRS/Treasury forfeitures. All purchases utilizing
these funds will follow the City of Fayetteville Purchasing Policy.
Recommendation
Staff recommends approval of a budget adjustment to record IRS/Treasury forfeiture
revenue received during fiscal year 2009 and appropriate expenses in the amount of $36,536.
Budget Impact
Increase expenses to correspond with IRS/Treasury forfeiture revenue received during
fiscal year 2009.
