BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves a
contract in the amount of $24,895.00 with Evans Construction and Remodeling, LLC for
rehabilitation of a CDBG eligible residence.

RECOMMENDATION
Staff recommends approval of Purchase Order for this Project.
BACKGROUND
2009 CDBG TIMELINE
• CDBG 2009 Action Plan Submitted to HUD November 15, 2008
• CDBG Award Letter from HUD - June 25, 2009
• Resolution 71-09 CDBG Grant Agreement Approval for $649,821.00
• Resolution 183-09 CDBG Additional Grant Funding of $13, 891.00
Project Specific
The property owned and occupied by a husband and wife, meets program requirements. The
homeowners fall within the 2009 Very Low - Mod Income guidelines that were established by
Housing and Urban Development (HUD). The improvements needed are listed below.
• Install New Windows throughout home
• Remove and replace exterior doors
• Install Gutters, and a new Heating Unit
• Remove and replace existing Roof
• Minor Electrical, Siding. And Soffit & Fascia repairs
DISCUSSION
The housing Program provides housing — related services to qualified low -to -moderate income
families and individuals in order to preserve and improve their homes — creating a more livable
home — environment while promoting housing that is safe, healthy, and energy — efficient.

SPECIALTNRMS AND CONDITIONS
1. All bids shall be submitted in a sealed envelope and must be submitted on forms provided by the
city. No employees of the Community Services and Code Compliance Division are allowed to
fill out bid sheets for Contractors.
2. The company or contractor name and project # shall be stated on the face of the scaled bid
envelope.
3. Bidders shall include all applicable local, state, and federal sales tax in the bid. The
responsibility of payment shall remain with the successful bidder.
4. Prices shall include all labor, materials, profit, insurance, etc., to cover the furnishing of the
items of the bid.
5. Bids received after the date and time set for receiving bids will not be considered.
6. The Owner reserves the right to accept or reject any and all bids, waive formalities in the
bidding and make a bid award deemed to be in the best interest of the Owner. The Owner shall
be able to purchase more or less than the quantity indicated subject to availability of funds.
7. The bid price shall remain good and firm for a period of thirty (30) calendar days from bid
opening date; however, the prices may remain firm for a longer period of time if mutually
agreeable between bidder and the Owner.
8. All products delivered shall comply with applicable standards of quality.
9. Any exceptions to the requirements of the City of Fayetteville must be noted on the Bid Form or
on an attached form.
10. In the event of two or more identical low bids, the contract may be awarded arbitrarily or for
any reason to any such bidders, at the discretion of the Owner.
11.The Contractor is to supply the City with evidence of the following:
1) Current and valid Certificate of Liability Insurance that includes coverage for
a) Workman's Compensation and Employer Liability in accordance with the
laws of the State of Arkansas, b) Commercial GencralLiability that covers
public liability and property damage and c) Automobile Liability, if
applicable. All premiums and costs shall be paid by the Contractor. In no

12. Specifications furnished with this invitation are intended to establish a desired quality or
performance level, or other minimum dimensions and capacities, which will provide the best
product at the lowest possible price. Other than designated brands and/or models approved as
equal to designated products shall receive equal consideration.
13. The City reserves the right to request any additional information it deems necessary from any or
all bidders after the submission deadline.
14. Quality, time and probability of perfonnance may be factors in making an award.
15. Any ambiguity in any bid as a result of omission, error, lack of clarity or non-compliance by the
bidder with specifications, instructions, and all conditions of bidding shall be construed in"the
light most favorable to the Owner.
16. Bidders must provide the City with their bids signed by an employee having legal authority to
submit bids on behalf of the bidder.
17. The request for bid is not to be construed as an offer, a contract, or a commitment of any kind;
nor does it commit the city to pay for any costs incurred by bidder in preparation of bid.
18. Bids must be hand delivered or received by mail in the Community Services Office, 125 West
Mountain St. Fayetteville, and AR. 72701, on or before the time of closing listed on the Bid
Form. Under no circumstances will faxed bids be allowed.
19. The successful bidder will be required to enter into a contract with the Owner and shall provide
a certificate of insurance to the Community Services Division within ten (10) days of notice of
bid award.
20. In the event a contract is entered into pursuant to the "Invitation to Bid", the bidder shall not
discriminate against any qualified employee or qualified applicant for employment because of
race, sex, color, creed, national origin, or ancestry. The bidder must include in any and all
subcontracts a provision similar to the above.
21. The contractor must be prepared to commence work on start date per Notice to Proceed issued
by the City Community Services Division, and must complete the work within Sixty (30)

calendar days. Exceptions as noted in the Rehabilitation Contract.
22. A Maximum of three payments may be made on each Housing Rehabilitation Project. Upon
satisfactory completion of 40% of the work and submission of proper documentation, 30% of
the contract amount may be released to the contractor with 10% being held as retainer. Upon
satisfactory completion of 70% of the work and submission of proper documentation, 60% of
the contract amount may be released to the contractor with 10% being held as retainer. Final
payment shall be made after satisfactory completion and acceptance of the project. Retainers
shall be released with the final payment.
23. A certificate of final inspection by the City of Fayetteville's Building Safety Division must be
performed before the release of the final check.
24. Any construction material containing Lead -Based Paint (LBP) shall be removed by workers
certified in LBP Interim Controls and with adherence to the current HUD Regulation on LBP
Hamrds.

Contractors Description of Work
Minimum requirement for bidder: Proof of current Arkansas Residential Contractor's license.
Provided by the State of Arkansas Contractors Licensing Board, Certificate of Liability
Insurance, & a Statement of Completion EPA / HUD Approved Lead Safety Training.
GENERAL:
The contractor will be responsible for all aspects of the construction, installation and repairs - as
stated in the Scope of Work - 'ayetteville, Arkansas.
Each bidder will be responsible for a complete inspection of the property. All the
distances, measurements, and listed materials should be verified before submitting your bid. The
requirements listed here — in the description of work - are general requirements and it will be the
responsibility of the winning bidder to assure the City of Fayetteville that the finished project is
in compliance with all applicable codes and standards.
The contractor's duties include, but are not limited to, the following:
1) Purchasing of all materials.
2) Supervision of all employees and subcontractors.
3) Coordination with the City of Fayetteville CDI3G Administrator, The City of Fayetteville
Code Compliance Office and Owners
4) Project Design.
5) Clean up and restoration of all lawns, planters, walking and driving surfaces to their
original condition.

SPECIFIC:
A: WINDOWS
A - 1 Remove the existing windows and doors.
A - 2 Replace all the windows in the house with maintenance free, single hung (or sliders)
double paned, insulated, solid vinyl windows with half screens. (18 Windows Total)
Note: It will be the responsibility of the contractor to ensure that where required by code
that at least 1 window in bedrooms without a separate exit meet emergency egress
requirements.
A —3 It will be the responsibility of the contractor to return the trim, interior and exterior
surfaces back to their original condition.
A - 4 Install New Front and Rear Doors and reframe the openings to accommodate the new
doors if necessary.
A — 5 The Front Door shall be a pre -hung 36" door similar in style and price to the Re!ial3ilt
brand door. The door shall be a six panel, metal clad, insulated door bored for a lock set
and dead bolt lock and include a security viewer.
A — 6 The Rear Door shall be a pre -hung 32" door similar in style and price to the ReliaBilt
brand door. The door shall be a six panel, metal clad, insulated door bored for a lock set
and dead bolt lock.
A — 7 A complete door installation will include an aluminum threshold, weather stripping, locks
and hardware.
A — 8 The contractor will be responsible for returning the door trim and interior and exterior
surfaces back to their original condition.

HOUSING & COMMUNITY DEVELOPMENT NEEDS
HOUSING
The City of Fayetteville is committed to the development of programs which address the need for housing
for Low and Moderate Income (LMI) persons and families. In response to priority needs revealed during
the development of the City's five year Consolidated Plan in 2005, the City has focused on developing
community partnerships with local entities with expertise in specialized housing activities. This cooperation
will further the Attainable Housing effort in the City of Fayetteville. Attainable housing has become a topic
of great concern for this division. Housing costs in Northwest Arkansas have increased at a considerable
rate throughout the past 10 years according to the latest information from the 2000 Census. The cost of
the median mortgage payment in the City of Fayetteville remains the highest in Northwest Arkansas at
$916, an increase of 45 percent. It is the highest median mortgage payment of any city in Northwest Ar-
kansas and 24 percent higher than the state median of $737.
This home received housing rehabilitation with Community Development Block Grant funds. The moderate rehabilitation consisted of an upgrade in
electrical, plumbing, and installation of new HVAC unit; removal and replacement of windows and doors; removal and replacement of all rotting and
damaged soffit and fascia; replacement of porch ceiling; addressing of all lead -based paint issues; and painting of exterior surface.
REHABILITATION
The City of Fayetteville has been helping homeowners with rehabilitation of their homes for approximately
30 years. The funding has allowed homeowners to stay in their homes, and the improvements to their
homes have acted as a catalyst for other, high quality renovations and new construction of housing in the
project area. The majority of recipients have been very low income and or elderly households. These
owners have little or no funds available to repay the loan and typically have the greatest amount of de-
ferred maintenance. The chart below reflects the income levels from January 2008 - September 2008.

According to the U.S. Census Bureau approximately 7,722 homes were built prior to 1978 in the City of
Fayetteville. Any rehabilitation activities on homes constructed prior to 1978 will have lead hazards iden-
tified and actions taken to remove the hazard. Lead -based paint hazards consist of any condition that
causes exposure to lead. In 2008, the program conducted 8 Lead -Based Paint tests and removed haz-
ards from the homes that tested positive.
Along with the Lead Based Paint need the U.S. Census Bureau reports that there are approximately
5,038 residents over the age of 65 in the City of Fayetteville. These homeowners are generally on a fixed
income and cannot afford to make any repairs on their homes or address making their homes energy effi-
cient. The program addresses both Lead -Based Paint issues and making the home energy efficient to
allow the homeowners to remain in their homes for up to 10 years longer than expected. The charts be-
low reflect the statistics on the participants that have been assisted in the past nine months of 2008. We
have provided rehabilitation to 21 homes from January —September 2008.

ADMINISTRATION
Administration funds are used for the salary and benefits of the Community Development Director, ad-
ministration staff, office supplies, travel and training costs, some Fair Housing activities, and other costs
associated with administration of community development activities. CDBG funds allocated - $121,359.
Location: Community Planning & City Engineering Building, 125 West Mountain Street, Fayetteville,
Arkansas 72701.
HOUSING SERVICES
RESIDENTIAL REHABILITATION i This allocation provides forgivable loans to low and moderate in-
come persons for rehabilitation of owner -occupied housing. The following services are offered:
• Minor Rehabilitation up to $10,000
• Moderate Rehabilitation up to $25,000
The program provides labor, materials, project management, Lead Based Paint (LBP) Hazard Control,
and other associated costs to bring a home into compliance with State and City Housing Codes. Em-
phasis is placed on repairs that improve energy efficiency, those that alleviate deferred maintenance
conditions, safety devices, and replacement of principal fixtures and components. CDBG funds allo-
cated —$279,998 and includes salary and program delivery costs for management and oversight of all
housing programs. Fifty households to be served.
Location: Citywide, applicants are prioritized according to established criteria to give preference on the
waiting list to those most in need of services. Priority criteria include: Very Low Income, Elderly, Dis-
abled, Single -parent household, Lead -based paint hazards in homes, and homes located in the Target
Area.
REDEVELOPMENT PROGRAM
Program activities conducted in the target area include code compliance, clearance and demolition, and
land acquisition for attainable housing. Twenty-five households to be served. CDBG fund allocated -

All contractors working on CDBG Rehabilitation Projects must be trained and certified to
work with lead -based paint. The last free training session was held in March 2008.
CDBG staff contacted 50 local NWA contactors in reference to the training. Of those
contacted 5 attended the training. The certified contractors are eligible to bid on current
