A RESOLUTION AMENDING THE MASTER STREET PLAN,
RECLASSIFYING S. WEST AVENUE, BETWEEN W. SOUTH STREET AND W.
PRAIRIE STREET, FROM A 45 FOOT RIGHT-OF-WAY TO A 40 FOOT RIGHT-
OF-WAY, AS DESCRIBED AND DEPICTED IN THE ATTACHED MAP.
WHEREAS, the north and south sections of West Avenue between South Street and Prairie
Street have been previously vacated, resulting in a 40' right-of-way; and
WHEREAS, a 40 foot right-of-way maintains the integrity and purpose of the Master Street
Plan, providing sufficient right-of-way for future improvements.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby amends the
Master Street Plan to reclassify S. West Avenue between W. South Street and W. Prairie Street from
a required 45 foot right-of-way to a 40 foot right-of-way.

Subject: Master Street Plan Amendment (VAC 09-3399) 303 S. West Avenue
RECOMMENDATION
Staff and the Planning Commission recommend approval of a Master Street amendement
for a section of S. West Avenue, between W. South Street and W. Prairie Street,
associated with VAC 09-3399.
BACKGROUND
The south section of West Avenue, between South Street and Prairie Street, contains 60'
of right-of-way, dedicated in the 1930's with the platting of the Ferguson Addition. Prior
to re -adopting the Master Street Plan in 2007 and designating this section of West
Avenue as an ST -45' right-of-way, West Avenue was designated as an ST -40' right-of-
way. Two separate property owners therefore requested that the City Council reduce the
right-of-way from 60' to 40' adjacent to their properties. Consistent with the
classification of West Avenue at the time, the City Council approved both vacations
(Ord. No. 5017 and 5072). The reduction in right-of-way was, and still is appropriate
given that the right-of-way, 40' of which is located on the west side of the centerline,
encroaches into several existing structures (see attached maps).
DISCUSSION
This item was heard at the regular Planning Commission meeting on August 24, 2009.
The Planning Commission voted 9-0-0 on the consent agenda to forward this vacation
request to the City Council with a recommendation of approval.
