REPLACEMENT EMPLOYEES
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILI,E, ARKANSAS:
Section I : That the City Council of the City of Fayetteville, Arkansas hereby approves
the hiring of replacement employees for the following positions:
(A) One Senior Legal Assistant in the City Prosecutor's Division
(13) One Secretary in the City Prosecutor's Division
(C) Two Animal Services Caregivers

1 share the C:ty Council's commitment to budgetary restraint and employee effic:ency.
When I became Cit) Attorney in March 2001.: immediately re\iewcd all MN office's ongoing
expenses and made siunificar.: cuts in cos:s which were dup'ica:i\e or otherwise unnecessary.
also instituted my own Departmental Staffing Freeze and have never requested from City
Council any increase in personnel during my entire tenure !now over seven +cars). The cuts
and the Stalling hrccze helped me keep my budget below the amount authorized for 200: (prior
to m) appointment) through 2005.
Although the Lit y Prosecutor is facing an increasing work load with maze more DWI
cases to he prosecuted in the las: few +ears. Casey and his staff have handled the extra case load
wit:nout additional staff. They !:a+c also begun the aggr.s'i\e overdue f I\1R prosecutions \\Inch
went from virtually nothing helbre 1 became City Attorney to :he recrnen of over 5450.000.00
since 2001. 1ialf of this recovered 1I MR tax goes to our Parks Department. !hese new duties
were again accomplished without any new personnel.

replacement of these positions with Council approval. On Wednesday. March 19. 2008.
Senior 1.egal Assistant Dorothy Straub submitted her resignation.
Discussion: The Fayetteville City Prosecutor's Office current1 has ten (10) positions.
Through a series of internal promotions the position of Senior Legal Assistant will be
filled leaving the need to fill the position of hot check program clerk. The primary
function of this position is the daily processing and administration of hot checks
submitted by merchants to the City Prosecutor's office for collection. This includes
sending warning letters. processing warrant requests as well as preparation of paperwork
for trials held at the Fayetteville District Court.

Recommendation:
City Council approves the hiring of one (1) Senior Legal Assistant to replace a
recent resignation.
Background:
On January 4. 2008, the Fayetteville City Council approved a hiring freeze for
replacement employees funded by the General Fund. This hiring freeze allowed
replacement of these positions with Council approval. On Wednesday, March 19, 2008.
Senior Legal Assistant Dorothy Straub submitted her resignation.
Discussion:
The Fayetteville City Prosecutor's Office currently has ten (10) positions. The
primary function of this position is to prepare cases that are appealed from Fayetteville
District Court to Washington County Circuit Court. This includes preparation of
motions/orders and coordination w ith w itncssesiN ictims and Circuit Court staff as well as
attend pretrial hearings and trials. lois position also is solely responsible for receiving
and reviewing information regarding City ordinance violations from other City
departments such as Code Compliance. Planning. Building Safety. etc. This also includes
receiving information from Accounting with regards to the collection of overdue IIMR
taxes. A responsibility that has resulted in the collection of over 5450.000.00 in ON erduc
IIMR taxes while maintaining a positive relationship with the Fayetteville business
community.
This position is also responsible for supervising the overall preparation of
paperwork for cases set in the Fayetteville District Court as well as detailed preparation
of all cases of DWI's. Domestic Battery's and Possession of Controlled Substances. Due
to increases in the general population of Fayet:evifle as well as growth in the commercial
sector combined with corresponding growth in City departments with compliance
authority (Fayetteville Police Department, Code Compliance, City Planning, etc.); the
number of cases handled by the City Prosecutor's office has increased correspondingly.
The court docket currently consists of approximately 300 cases a week, up from an
average of 230 (32% increase) for the same period over the last two years. Included are
cases that require extensive preparation and treatment, such as Driving While Intoxicated
(up 50%) and Domestic Battery (up 65%). Though there are fluctuations from week to
week, the overall increase in cases set at the Fayetteville District Court shows no sign of
abating

Background:
On January 4. 2008, the Fayetteville City Council approved a hiring freeze for
replacement employees funded by the General Fund. This hiring freeze allowed
replacement of these positions with Council approval. On Ihursday Arn' 10 1008,
Erin Johnson submitted her resignation.
Discussion:
The Fayetteville City Prosecutor's Office currently has ten (10) positions. The
primary function of this position is to serve as the receptionist to two City Prosecutors
and the entire office staff. This includes daily contact with citizens, attorneys, various law
enforcement agencies, and departments within :he City of Fayetteville as well as outside
representatives.
This position is also responsible for preparation of paperwork for cases set in the

RE: Animal Services Full-time Caregiver Position Opening
The Animal Services Division currently has one full-time Animal Services Caregiver position vacant.
The vacancy was created when the current caregiver resigned as she will be relocating to Indiana
because of her husband's employment. The caregiver leaving was employed with the city for 6 years
The loss of her skills and experience will effect shelter operations.
Replacing the full-time caregiver position is vital to continue to provide the shelter animals care 7 days
a week, 365 days a year The caregiver staff is not only responsible for the cleaning, feeding,
vaccinating, and handling of over 5,000 animals each year, they conduct adoption counseling and
assist the Animal Services Officers with the task of euthanasia and loading the incinerator. The
division does not have any additional staff members to assist with the caregiver duties. The current
caregivers are working additional hours on their scheduled days off to perform essential duties.
Although we are utilizing volunteer and community service workers, many of the caregiver duties
require trained and certified staff due to health and safety concerns such as handling dangerous animals
and zoonotic diseases. The starting salary for this position is $9.53 per hour.

Division. My husband has recently accepted a position at the University of Notre Dame,
Mendoza College of Business. We are therefore relocating to South Bend, IN. My last day of
employment with the City of Fayetteville will be April 11, 2008. In order to find housing in
South Bend, I will need to take vacation time on April 3 and 4, 2008, if at all possible.
Please know that this decision was not made lightly. I would like to thank you and the
entire staff of the Fayetteville Animal Shelter for everything, and will cherish the

ESSENTIAL DUTIES AND RESPONSIBILITIES: Note: All City of Fayetteville positions
require the employee to provide good customer service to both internal and external customers,
maintain positive and effective working relationships with other City employees (especially
members of his or her own team), and have regular and reliable attendance that is non -
disruptive. Other essential duties of Ibis position include the following:
1. Clean, disinfect and maintain facility including, cages, walls and floors. Launder and
disinfect bedding, toys, and towels in an efficient manner.
2. Feed and socialize animals; provide toys, beds and comforts of home.
3. Perform first view examinations of eyes, ears, paws, teeth, coat, weight and overall
health, administer dog and cat vaccinations, flea and tick control and administer
medications as directed by staff veterinarian.
4. Scan for and implant microchips.
5. Assist and hold animal during euthanasia.
6. Assist the public with adoptions and counsel potential adopters on training, behavior and
pet care.
7. Educate the public about spaying and neutering and disease and illness prevention.
8. Handle feral cats and aggressive dogs.
9. Utilize safe handling practices and use of chemicals (bleach and disinfectant).
10. Ensure proper use and disposal of needles and syringes and safety equipment.
11. Properly restrain animals and assist in taking blood work.
12. Knowledge and use of computer in order to enter information on persons and animals,
document behavior, medications and vaccines given.
13. Perform other duties as assigned.

that was approved by the Council on March 18, 2008.
Replacing the part-time caregiver position is necessary to provide adequate staffing on Saturdays, the
busiest day for adoptions, and additional assistance during the week. The division also relies on the
part-time position to assist when full-time staff is on vacation or sick for essential duties to be
completed The current caregivers are working additional hours on their scheduled days off to perform
essential duties. Although we are utilizing volunteer and community service workers, many of the
