A RESOLUTION APPROVING A REVISED PROJECT DESIGN
FOR THE RED OAK PARK STREAMBANK IMPROVEMENTS
SUBMITTED BY THE ARKANSAS GAME AND FISH
COMMISSION REGION 1 STREAM TEAM; AND APPROVING A
BUDGET ADJUSTMENT IN THE AMOUNT OF $39,578.00.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby approves the revised project design for the Red Oak Park Streambank
Improvements submitted by the Arkansas Game and Fish Commission Region 1
Stream Team. A copy of the revised project design, marked Exhibit "A" is
attached hereto and made a part hereof
Section 2. That the City Council of the City of Fayetteville, Arkansas
hereby approves a budget adjustment to appropriate $39,578.00 from Park Land
Fees and reduce the previous appropriation from Sales
Improvements Fund in like amount.

RE: Red Oak Park Streambank InYprovement Project
RECOMMENDATION
Approval of a revised project design proposed by the Arkansas Game & Fish
Commission (AGFC) Region 1 Stream Team for Red Oak Park streambank
improvements.
BACKGROUND
In the fall of 2006, Mr. David Evans, Region 1 Stream Team Coordinator with the
Arkansas Game and Fish Commission, prepared a schematic plan proposing to modify
the upstream portion of the channel, widening the banks to allow for runoff events. This
widening will involve substantial removal of soil and trees that are currently being
undercut by the water flow.
The proposed plan was presented to the surrounding neighborhoods at a public meeting
held on Tuesday, August 14, 2007, at the Red Oak Park pavilion on New Bndge Road in
the Bridgeport Subdivision.
The proposed plan was then presented to the City Council for approval on August 23,
2007. The City Council tabled the item until a revised design that involved less tree
removal could be considered. Park staff met with Mr. Evans and the plan was revised.
Approximately 15 trees can potentially be saved under the revised plan. The revised plan
was presented to the City Council for approval on October 2, 2007. The City Council
tabled the item again until the residents in the surrounding neighborhoods could engage
in additional discussion regarding the project.
DISCUSSION
The subject of the erosion problems at Red Oak Park was placed on the January 28, 2008,
Ward 4 meeting agenda. Parks and Recreation staff attended the meeting and listened to
dialogue from the residents. Approximately 10 — 15 residents attended the meeting and
engaged in the discussion. The residents and Aldermen from Ward 4 agreed to have a
special Ward 4 meeting to discuss Red Oak Park exclusively.
Seven residents attended the special Ward 4 meeting on February 11, 2008. A concensus
reached by the residents was a three-phase plan: to solve the erosion problems following
the state's Region 1 Stream Team design, to meet with neighbors and develop a plan for
future park improvements, and to encourage area residents to consider the use of rain
gardens to assist in reducing the volume of flow to the stream.

The timing of the proposed project designed by the AGFC is essential to its success.
Work should be conducted during the dry season when the stream flow is nonexistent or
very low. Tree removal must occur as the first stage of the project in order to clear the
project area for the necessary soil and root excavation. The installation of the stone
grade -control structures will immediately follow the soil and root excavation. The newly
shaped banks will be planted in grass, fertilized and covered with coconut matting to
encourage rapid revegetation immediately following the installation of the stone grade -
control structures. Work on the downstream (northern) portion of the project will take
place after the upstream (southern) portion is finished. The planting of the shrubs and
small trees will be performed during the appropriate planting season. The entire project is
expected to take eight to ten weeks with the exception of the shrub and tree plantings.
BUDGET IMPACT
The construction materials cost estimate is $99,530. This project is funded with Parks
Development and Sales Tax funds. The downstream (northern) portion of the project will
be partially funded by a 50/50 matching Urban and Community Forestry Assistance
Grant from the Arkansas Forestry Commission in the amount of $10,000. The acceptance
of the matching grant was approved at the July 17, 2007, council meeting. The remaining
funds from this project budget will be used to modify the low-water bridges at Gordon
Long Park. City Council bid approval of the actual costs of materials (particularly stone)
is anticipated once the project design is approved.
This project is financially viable because of the assistance of Arkansas Game and Fish
Commission staff (at no cost to the City) and the use of Parks and Recreation staff and
equipment for tree removal, excavation, placement of stone and revegetation with grass.
The use of volunteers for the planting of the shrubs and trees also facilitates keeping the
project cost low. Parks and Recreation staff and the Arkansas Game and Fish
Commission believe this is the best method for controlling the erosion problem that is
creating a safety issue as well as destroying the integrity of this beautiful neighborhood
park.

The following response is from Lowell D. Boynton, adversely affected
property owner between the north border of Red Oak Park and Hamestring
Creek.
My position on this issue appears to be the same as the Parks.Division, i.e.
mitigation of the runoff problem should be addressed by implementing the
proposal of Mr. Evans of the Arkansas Game and Fish Commission.
Recommendations of this nature are his expertise from successful experience
m similar situations.
Some individuals may find certain aspects of this proposal to be
aesthetically/environmentally objectionable. I understand, no one of the
opposite conclusion could agree more with these objections. I too, would
have to accept these same less than desirable unnatural appearing structures
on my property However in my view, the consequences of doing nothing
are unacceptable and there is no viable alternative.
Unfortunately this problem has to be dealt with in retrospect. Obviously a
solution more pleasing to all could have been possible prior to development,
but such options no longer exist. Agonizing over what might/should have
been results in the present state of endless unproductive Iimbo.
In my opinion, it is time for those vested with authority to initiate action to
do so. Those having this responsibility must consider all various views.
Parties suffering actual damages, i.e Red Oak Park and I are entitled to
serious consideration and resolution.

SUBJECT: Funding of the Red Oak Stream Revitalization Project
In response to questions at the March 11, 2008 Agenda Session, I have reviewed the funding plan
for the Red Oak Stream Revitalization Project.
The estimated cost of the Red Oak Park Stream Revitalization Project is $99,530 and the current
budgeted funding sources are as follows:
$79,054 Sales Tax Capital Fund
10,476 Parks Development (I-IMR) Funds
10,000 State Grant
$99,530
Funding for this project, as well as Gordan Long Park, was allocated in the CIP prior to 2006.
Connie Edmonston has advised me that she has recently received remittances for the Park Land
Dedication Fees which will result in an uncommitted balance of $39,578 in the Northwest
Quadrant. This could be used for this project if the City Council wishes; however, budgeted
funds were committed previously for this project as indicated above. If the Council wishes to use
the available uncommitted balance in the Park Land Dedication Fee Fund, a budget adjustment
will need to be approved to recognize the revenue and appropriate the $39,578.If the current
funding method is used the $39,578 will be incorporated in the 2009 budget.
