A RESOLUTION APPROVING A TWO-YEAR LEASE AGREEMENT WITH
OLD SQUARE, INC., FOR THE ANNUAL RENTAL AMOUNT OF $7,800.00
TO LEASE APPROXIMATELY 3,500 SQUARE FEET FOR DOCUMENT
STORAGE
BE IT RESOLVED BY TILE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS*
Section 1. That the City Council of the City of Fayetteville, Arkansas, hereby approves a
two-year Lease Agreement with Old Squat, Inc., for the annual rental amount of $7,800.00 to
lease approximately 3,500 square feet for document storage. A copy of the Lease Agreement,
marked Exhibit "A," is attached hereto and made a part hereof.

LEASE
On this /0 day of November, 2008, Old Square, Inc. (Lessor) and the City of
Fayetteville (Tenant) agree as follows:
Old Square, Inc. agrees to lease the north end of the basement of 26 West Center
(approximately 3,500 square feet) to the City of Fayetteville for an annual rent of Seven
Thousand Eight Hundred Dollars ($7,00.00) to be paid monthly at the first business day of
each month beginning January 1, 2009 in he amount of Six Hundred Fifty Dollars ($650.00).
The City of Fayetteville agrees to lease approximately 3,500 square feet in the north end
of the basement of 26 West Center from Old Square, Inc. and pay an annual rent of Seven
Thousand Eight Hundred Dollars ($7,800.00) to be paid monthly on the first business day of

Old Square, Inc. shall be responsible to pay all building utilities. The City of Fayetteville
agrees that the space it has rented will be used as storage space for City of Fayetteville records or
property. Old Square, Inc. agrees to allona access to the City of Fayetteville records or property
as needed by City personnel.
The City of Fayetteville shall not sublet any of this space without the prior written
approval of Old Square, Inc.
The initial term of this Lease shall be two years (from January 1, 2009 until December
31, 2010). The City of Fayetteville shail have the right to renew this Lease for up to time G
additional years, but the annual rental (tc be paid in future equal monthly payments) shall be
increased each year by the increase of the Consumer Price Index of the preceding period.
In Agreement with all the promise,, terms and conditions stated above, Old Square, Inc.
by Lee Ward and the City of Fayetteville by Mayor Dan Coody sign their names below.

RE- Approve Resolution authorizing the Mayor to execute a two year contract in the amount
of $7,800 annually with Old Square, Inc. for lease space of approximately 3,500 square feet to be
used for document storage
Background
The Old Jail and Prosecutor's Office building is being demolished to make room for a new
Courts Building The vacant space within the building had been used by various departments for
the storage of files. The unnecessary files have been purged and destroyed. However, the City
Clerk and others require storage space not available in City Hall and other municipal buildings.
Discussion
The files to be stored must be at a relatively convenient location as some files require access on a
somewhat frequent basis.
Management of nearby office buildings wise contacted concerning there availability and cost per
square foot. The lowest cost option with 5 ecure storage, utilities paid, and proximity to City Hall
is the Old Square, Inc located at Center and Block Street.
The initial lease is for two years with an o_7tion for an additional two years
