A RESOLUTION APPROVING RENEWAL OF THE
MEMORANDUM OF AGREEMENT WITH VAN SCOYOC
ASSOCIATES IN THE AMOUNT OF $84,000.00 TO PROVIDE
LOBBYING SERVICES TO THE CITY OF FAYETTEVILLE FOR
2008.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby approves renewal of the Memorandum of Agreement with Van Scoyoc
Associates in the amount of $84,000.00 to provide lobbying services to the City of
Fayetteville for 2008.

MEMORANDUM OF AGREEMENT
Agreement. The City of Fayetteville ("the City")hereby retains Van Scoyoc
Associates, Inc. ("VSA") as consultants and advisors with regard to various
legislative and administrative matters.
Statement of Work. VSA will assist the City and its personnel in the following
areas:
• Developing a program and strategy towards obtaining federal
appropnations and grants for Fayetteville's future economic viability.
• Analyzing and informing the City of contemplated legislative and
regulatory changes that may positively or negatively affect programs of
interest to the City.
• Educating Members of Congress and their staffs about Fayetteville
concerns or opportunities with respect to legislation or regulations.
• Building grassroots support of the projects to demonstrate local interest
by finding individuals and groups with goals similar to those of the City.
• Working with the relevant committees to secure enactment of the
legislative agenda or otherwise advance the interests of the City.
• Assisting in working with federal agencies and the federal administration
to identify, create and secure new federal grant and funding opportunities.
Lobby Disclosure Act. It is understood that VSA will be required to register on
behalf of the City under the terms of the Lobbying and Disclosure Act of 1995 (P.L.
104-65) and any subsequent laws or regulations.
Term. In consideration of the performance of these services, the City shall pay
to VSA the sum of $7,000 per month for the period of February 1, 2008 through
January 31, 2009, for a total of $84,000 in retainer expenses subject to
appropriation by the Fayetteville City Council.
The City further agrees to pay all reasonable costs and expenses incurred by
VSA in furtherance of its efforts on behalf of the City, including, but not limited to,
copies, facsimiles, couriers, telephone, local transportation and meals directly
attributable to those efforts. VSA agrees that these expenses, exclusive of out-of-
town travel costs taken solely at the City's direction, shall not exceed $5,000 during
the contract term. The City hereby warrants that these obligations will not be paid
with federally appropriated funds.
Notice. The City shall have the right to terminate this contract after giving
VSA 30 days advance wntten notice. Should the City exercise this option, it agrees
to pay VSA all outstanding retainer and expense costs owed through the termination
date.

SUBJECT: Van Scoyoc Associates Memorandum of Agreement
Recommendation
A resolution approving a Memorandum of Agreement with Van Scoyoc Associates in the amount
of $84,000 to provide lobbying services to the City of Fayetteville.
Background
The City of Fayetteville entered into a one year renewable Memorandum of Agreement with Van
Scoyoc and Associates (VSA) in February 2004. The firm is a Washington D.C. based
consulting firm that assists clients with securing federal funding including line -item earmarks
and agency -based grants. A summary of requests and funding received since our initial contract
with Van Scoyoc is attached.
Current Status
This year we have developed a list of seven projects for FY 2009 totaling approximately $23.1
million (attached as FY 2009 Federal Requests Summary). VSA will begin actively lobbying for
these proposals in the first quarter of 2008. They are also providing written progress reports, e-
mail briefings on relevant budget and/or congressional committee activities, and a monthly
conference call to provide funding status reports and to help us generate ideas for increasing our
chances for securing federal dollars including earmarks and agency grants
Currently, the firm is also under contract with the University of Arkansas.
Budget Impact
The firm works on an annual retainer basis. The annual retainer fee for services is $84,000 which
was included in the approved 2008 budget. The City may incur additional reimbursable expenses
not to exceed $5,000 for the one-year contract term.

2008 White Paper Summary
Federal Requests FY 2009
$9.0 million - Fayetteville Expressway Economic Development Corridor
The City of Fayetteville and the University of Arkansas request $9 million in the Fiscal
Year 2009 Transportation and Housing and Urban Development Appropriations Bill for
continued revitalization of the northern section of the Fayetteville Expressway Economic
Development Corridor. The Corridor is a seven -mile thoroughfare that serves as the
major north -south route for vehicular traffic along the east side of Fayetteville and into
the City's historic downtown. To begin upgrades to the Corridor's northern section, this
request received $9 million in the Safe, Accountable, Flexible, Efficient, Transportation
Equity Act: A Legacy for Users (SAFETEA-LU, Public Law 109-59), which was enacted
in 2005.
$4.0 million - Fayetteville Regional Wastewater System Improvements
The City of Fayetteville requests $4 million in the FY 2009 Intenor Appropriations Bill to
continue the existing initiative of rehabilitation of the regional wastewater system.
$1.0 million - Housing Partnership: An effort to provide attainable/ affordable
housing
The City of Fayetteville is requesting $1 million to increase current efforts aimed at
addressing the lack of attainable/affordable single family housing for a significant
percentage of the population in the city.
$3.6 million - Drake Field / Municipal Airport: Runway extension & Safety
Improvements
Because of the need for safety area improvements, as required by the Federal Aviation
Administration (FAA), at the North End Runway Safety Area (RSA) of the Drake
Field/Fayetteville Municipal Airport (FYV), the City of Fayetteville requests $3.6 million
through the FAA's Airport Improvement Program (AIP) for better operational capability
of corporate/business aircraft.
$1.0 million — City of Fayetteville — Sustainability Initiative

$2.5 million - Simulcast System for Public Safety Communication
The City of Fayetteville is requesting $2.5 million in the Fiscal Year 2009 Commerce,
Justice and Science Appropriations Bill to complete the purchase, installation and
implementation of an ASTRO 25 LE simulcast system — offering a broad range of
communication features, capabilities and benefits for public safety agencies in the
Fayetteville area with wireless communication needs. The ASTRO system will ensure a
coordinated approach to preparedness issues and is the next logical and quite
necessary step towards regional interoperability.
$2.0 million - Arkansas Research and Technology Park
Through the development of the Arkansas Research and Technology Park (ARTP), the
University of Arkansas Technology Development Foundation (UATDF), the City of
Fayetteville, the State of Arkansas, and region are building an economic development
engine focused on innovation and Northwest Arkansas entrepreneunal strength that is
able to attract and retain knowledge-based workers and induce technology-based
business cluster formation. Because research parks provide the physical infrastructure
and environment to encourage research and development, the ARTP is viewed as the
comerstone toward developing the building blocks essential to growing and sustaining a
knowledge-based economy in Arkansas. Accordingly, the UATDF, in cooperation with
its strategic partners, requests an additional $2 million in the Small Business
Administration (SBA) for site-specific infrastructure necessary to support the ARTP. In
fiscal year 2006, $1.1 million was provided for the Park in SBA. An appropriation of
$500,000 was recommended in Committee Report 109-280 accompanying the Senate
version of the fiscal year 2007 Commerce, Justice and Science Appropnations Bill.

JOINT REQUESTS WITH THE UNIVERSITY OF ARKANSAS
$11.6 million - Fayetteville Expressway Economic Development Corridor
The City of Fayetteville and the University of Arkansas request $11.6 million in the
Fiscal Year 2009 Transportation and Housing and Urban Development Appropnations
Bill for continued revitalization of the northern section of the Fayetteville Expressway

$6.2 million — Razorback Road (Hwy 112)
In an effort to address safety needs and the adverse impact of congestion in an area of
heavy pedestrian traffic, the University of Arkansas, with the support of the City of
Fayetteville and the Arkansas Highway and Transportation Department, requests an
authorization of $6.2 Million for a joint project to improve access to the campus from
Interstate 540 along Razorback Road and Maple Street. Currently, Highway 112, or
"Razorback Road" as it is commonly called, is unsustainable given the growth of the
area, and that it serves as the major throughway from the Arkansas Research and
Technical Park and the University. Highway 112 is becoming a major thoroughfare, vital
for economic development as it links the University and other economic engines of
Fayetteville, yet as the needs of the road have grown, the safety and size of the road
has not. The safety concems are real, during game days at Donald W. Reynolds
Razorback Stadium, tens of thousands of fans are now required to park a distance from
the stadium due to traffic bottlenecks and walk in trenches on the side of the road to the
stadium as traffic passes them. The construction of 10 foot sidewalks will help mitigate
this safety issue as will the widening of the road allow for fewer traffic tie-ups.
$2.0 million - Arkansas Research and Technology Park
The University of Arkansas Technology Development Foundation (UATDF), in
cooperation with its strategic partners, requests an additional $2 Million in the Small
Business Administration (SBA) to equip laboratories in a new, privately developed multi -
tenant research facility at the Arkansas Research and Technology Park (ARTP).
Through the development of the ARTP, the UATDF, the City of Fayetteville, the State of
Arkansas, and the region are building an economic development engine, focused on
innovation and Northwest Arkansas entrepreneurial strength that is attracting and
retaining knowledge-based, highly skilled jobs and the production of technology-based
business cluster formation The ARTP provides the physical infrastructure and
environment to encourage research and development. Therefore the ARTP is viewed as
the comerstone toward developing the building blocks essential to growing and
sustaining a knowledge-based economy in Arkansas. In fiscal year2006, $1.1 Million
was provided for the Park in SBA, and $446,500 was provided in fiscal year 2008.
$600,000 — Razorback Transit System
Razorback Transit, a federally funded public mass transit system operated by the
University of Arkansas that transports 1.3 million passengers annually, is requesting
$600,000 in the FY 2009 Transportation, Housing & Urban Development Appropnations
Bill. This request is sought in response to environmental concerns, in support of
sustainability initiatives supported by the University of Arkansas and the city of
Fayetteville, AR, to improve communication during emergency operations, to increase
security of the federally funded vehicles and facilities and to increase the universal
accessibility to all those living in Fayetteville, AR and the surrounding area. These funds
will be used to upgrade the vehicle fueling and maintenance facility; improve secunty on
the buses, and improve operating efficiency for the transit system.
