HomeMy WebLinkAbout149-08 RESOLUTIONRESOLUTION NO. 149-08 A RESOLUTION AUTHORIZING THE MAYOR TO APPLY FOR AN ARKANSAS PARKS AND TOURISM OUTDOOR RECREATION GRANT IN THE AMOUNT OF $150,000.00 FOR THE DEVELOPMENT OF THE PARK PROPERTY ON FAIRLANE DRIVE. WHEREAS, the City of Fayetteville, Arkansas seeks to improve recreation facilities and wishes to seek grant funding assistance; and, WHEREAS, in order to obtain the funds necessary to develop and/or improve the site for such a recreation area, it is necessary to obtain a 50/50 Matching Grant from the Arkansas Department of Parks and Tourism's Outdoor Recreation Grant Program; and, WHEREAS, the plans for such recreation areas have been prepared and the price therefore has been established; and, WHEREAS, the City Council of the City of Fayetteville, Arkansas understands the grantee and grantor will enter into a binding agreement which obligates both parties to the policies and procedures contained in the Land and Water Conservation Fund Grants Manual including, but not limited to the following: the park area defined by the project boundary map, submitted in the application, must remain in outdoor recreation use in perpetuity, regardless if the property is bought or developed with matching grant funds and; all present and future overhead utility lines within the project boundary must be routed away or placed underground and; the project area must remain open and available for use by the public at all reasonable times of the day and year; facilities can be reserved for special events, league play, etc. but cannot be reserved, leased, or assigned for exclusive use, and, the project area must be kept clean, maintained, and operated in a safe and healthful manner. The City Council of the City of Fayetteville, Arkansas is well aware and apprised of the above-mentioned project, and will provide the local portion of the development cost of the entire project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS. Section 1. That the City Council of the City of Fayetteville, Arkansas hereby authorizes the Mayor to make application to the Arkansas Department of Parks and Tourism for assistance, in the amount of $150,000.00, for the development of the park property on Fairlane Drive. The Natural and Cultural Resources Grant and Trust Fund (NCRGTF) is a state program with funds collected from a tax on the transfer of certain real estate in the State of Arkansas. LWCF and NCRGTF funds are included in the Department of Parks and Tourism's Outdoor Recreation Grants Program for funding outdoor recreation facilities. Only incorporated cities and counties may apply. This is a 50/50 reimbursable matching grant with a $250,000 maximum request on matching funds. Last year, Arkansas Parks and Tourism awarded our City with $100,000 for the development of Eagle Park, which is currently out to bid. In 2007, the City was awarded $100,000 for the renovation of Sweetbriar Park and Bryce Davis Parks. Re -Grand Openings were held this spring for both of these parks. Other parks funded in part by this grant include Braden Park, Grinders Skate Park at Walker Park, Gulley Park, Veterans Memorial Park at Lake Fayetteville and the Botanical Gardens of the Ozarks at Lake Fayetteville Park. This year's grant deadline is August 31. A resolution from the City of Fayetteville is required to apply for the grant. Current Status On June 18, a public meeting was held at the public park property on Fairlane Dnve to gather input from the public of their recreation desires and to prioritize an eligible grant program. An outreach to groups such as ethnic minority populations, the elderly and persons with disabilities was attained through group meetings. It was determined, after obtaining public input, that a grant for improvements to the Fairlane property be submitted. Improvements to this property will include a walking trail, playground and pavilion. The conceptual design will be presented to the neighborhood in August for feedback and then forwarded to the Parks and Recreation Advisory Board for final approval of the park's master plan, along with a potential name for the park. The grant application must include detailed budgets, plans, specifications and bid documents that are ready for immediate bid and construction. The planned improvements for the Fairlane property will be ADA accessible. The grant asks the application to specify how funding meets the needs of the community These improvements will provide for a safe play area as well as ADA accessible equipment for all citizens, which was a request in the Parks and Recreation Ten Year Master Plan Developing facilities at this park will help achieve this goal. This grant contains twelve (12) obligations covering everything from compliance of the Americans for Disabilities Act to property retained in perpetuity for outdoor recreation use. The Fairlane Property project meets these obligations. Section 6(0(3) of the LWCF Act states "No property acquired or developed with the assistance under this section shall, without the approval of the Secretary of the United States Department of the Interior, be converted to other than public outdoor recreation use The Secretary shall approve such conversion only if he/she finds it to be in accordance with the then existing Statewide Comprehensive Outdoor Recreation Plan (SCORP) and only upon such conditions as he/she deems necessary to assure the substitution of other recreation properties of at least equal fair market value and of reasonable equivalent usefulness and location " If this property must ever be used for anything other than outdoor recreation use, it is possible to covert the park boundary. Budget Impact This grant application is for $150,000. The Arkansas Outdoor Recreation Grant is a 50/50 Matching Grant. If the full amount requested is awarded, the City is responsible for applying $150,000 towards the project, resulting in a $300,000 project. Currently, the Fairlane project has $100,000 budgeted for 2009. If the full $150,000 is awarded, Parks Staff will request Parks and Recreation Advisory Board to approve $50,000 from funds currently available in the Neighborhood Park Projects. This would provide the $150,000 from the City of Fayetteville and $150,000 from the State of Arkansas. If the grant is awarded, this item will be brought back to City Council to be approved and a budget adjustment if needed for an additional $50,000. Recommendation Parks and Recreation requests City Council approval of a resolution to authorize the City to apply $150,000 from the Arkansas Parks and Tourism Outdoor Recreation Grant Program for the development of Fairlane public property. SMITH, City Clerk/Treasurer Fairlane Public Meeting Wednesday, June 18, 2008 The meeting began at 5:30 in the vacant field on Fairlane. Eighteen citizens attended. Staff attending was Connie Edmonston, Carole Jones, and Melanie Thomas. Billy Waite from the Parks and Recreation Advisory Board also attended. Connie began the meeting by talking about the grant from the Land Water Conservation Fund (LWCF) that would help fund this park. She then asked the citizens for suggestions on what type of park they wanted, what type of amenities, etc. Some suggestions were: • Make it a family park, with lots of things for children. • Fayetteville needs a dog park, and Fairlane would be a good place. Someone else added that lots of people walk their dogs in this area. Connie told them that a minimum of two acres is needed for a dog park, which would be most of the area of this field. • A walking trail would be good around the border of the park. It was suggested that it be ADA accessible, such as a smooth walking trail for wheelchair bound citizens. • A wooden gym set for the children was requested. • A citizen wanted the park closed at dusk because there were pedophiles in the area • Someone suggested a small ball park. • Benches were requested. • Trees were suggested, especially around the shde • Maybe a basketball court could be put on site, to keep the kids from playing basketball in the street. • Someone suggested a small pavilion or gazebo for shade. Also needed were picnic tables and grills. A vote was taken. Each suggestion was read, and the number of votes was recorded. Each person could vote on three items. 1. Walking trail- 13 votes 2. Playground- 10 votes 3. Small ballpark- 1 vote 4. Basketball court- 9 votes 5. Pavilion- 9 votes A tie breaker vote was taken for the basketball court and pavilion. 1. Basketball court- 5 votes 2. Pavilion- 9 votes The top three amenities chosen for the new park are the walking trail, playground, and a pavilion. The meeting adjourned at 6:20. The park upgrades that I see that could improve the baseball complex are : 1) ADA compliant sidewalks from main entrances. We have no sidewalk from the parking lot by the batting cages and main parking area.The sidewalks that are in the park are broken and in disrepair. This was a complaint from people using the park that it is difficult for strollers and wheel chairs to be pushed in to watch a game. They have to walk through the mud to get to the fields. 2) The bleachers for field 3,4,5, are 40 years old and need replacement . The screens that are over them need replaced as well as some other fields do not have screens creating a hazard to fans watching the game. 3) The umpire room/ concession stand / restroom in the middle of the park is 40 plus years old and is in constant disrepair. This park is going to be here for the future and it needs to be replaced. Once a public park projea boundary has been identified by the local project sponsor and provided to the Department of Parts and Tourism, all facilities constructed within that boundary, atanyfuture time, mustbein compliance with the rules and regulatons of the Outdoor Recreation Grants Program PhjectManagementGuide. This also applies to those facilities constructed in whole or in part with local finds. 2. Property acquired or developed with grant funds must be retained in pespemity for outdoor iec eation use and will be subject to inspection bytheState at least once everyfcveyears. In addition cad' project will be inspected by the State during construction and before final reimbursement is made. 6 3. No overhead utility lines are allowed within the project boundary. Mil exist - mg utility lines located within the park boundaries must be placed under- gniund. This regulation applies to any overhead lines including electric lines, phone lines and pubhcannouncement system wiring. No vehicular right-of- way easements are allowed within the boundary. 4 A permanent sign stating that federal LWCF or state NCRGTF moneys were used to acquire and/or develop publicoutdoorteaeationfacilitiesmust be maintained within the park in per- petuity. Guidelines for the size, place- ment and design of the signs will be presented to each applicant after grant approval. Upon projea completion the applicant will be required to de - settle thelacationofthesign, andstate that the sign location will not change. 5. All public recreation facilities con- stntctedwithin aMatching GrantPro- gram assisted park must be accessible to the handicapped. This also applies to those facilities constructed in whole or part with local funds. 6. Property acquired or developed with assistance from the fund must be open to entry and use by all persons regard- less of race, color, religion, sex, or national origin. Property acquired or developed with assistance from the Matching Grant Program shall be operated and maintained in perpetuity. The property shall be maintained so as to appear attractive and inviting to the public. Sanitation and sanitary facilities shall be maintained in accordance with applicable health standards. Properties shall be kept safe for public use. Fite prevention, lifeguards, and the like should be provided for proper public safety. Buildings, roads, trails, and other structures and improvements shall be kept in reason- able repair throughout their functional lifetime to prevent undue deterioration and to encourage public use. Facilities that have reached an age that tenders them obsolete or worn out maybe removed with written permission of the Arkansas Department of Parks and Tourism's Outdoor Recreation Grants Program Director. Permission must be obtained prior to removal of the facilities. 8. The Arkansas ORGPstafFwillconduaperiodic pest comple- tion inspections of the projea area to ensure that program compliance continues after the project is completed. These inspections will be unannounced. Sponsors who fail to com- ply with long term commitment may jeopardize future eligibility for matching grant funds for newprojects and/orbe subject to legal actions by the State or Federal govcrmnent to enforce program compliance. 9. The property shall be kept open for public use at reasonable hours and times of the year, according to the type of arca or facility.
