HomeMy WebLinkAbout148-08 RESOLUTIONRESOLUTION NO. 148-08 A RESOLUTION TO AUTHORIZE THE CITY ATTORNEY'S OFFICE TO SEEK CONDEMNATION AND POSSESSION OF 6,320 SQUARE FEET OF LAND OWNED BY RUTH CAROLINE THORNTON FOR A TRAIL EASEMENT WHEREAS, Ms. Ruth Caroline Thornton, the landowner of a short portion of the proposed Scull Creek Trail, refuses to dedicate or sell to the City the 6,320 square feet (.145 acre) needed to complete the trail for the appraised value of $5,000.00; and WHEREAS, there is not a good alternative route for the Scull Creek Trail; and WHEREAS, the trail easement sought is to be built over a water/sewer easement already owned by the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes the City Attorney's Office to file a condemnation action in the Washington County Circuit Court to obtain possession of an easement for the construction, use, maintenance, repair, and replacement of a twelve foot wide trail as described on Exhibit A and shown on Exhibit B. Further, the City Attorney's Office is authorized to pay into the Court Registry the amount of $5,000.00 as the appraised compensation for the trail easement. RECOMMENDATION: Staff recommends approval of a resolution authorizing the City Attorney to seek possession by condemnation of a portion of the property owned by Ruth Carolene Thornton. BACKGROUND: As Scull Creek Trail approaches completion, access across only one property prevents the 4.2 mile long trail from connecting Maple Street to Mud Creek Trail. This property, owned by Ms. Carolene Thornton, is located just north of Fulbright Expressway where the trail will emerge from an existing tunnel under the expressway (see attached map). With the fixed location of the existing tunnel, there are no alternative routes for the trail therefore the trail must cross Ms. Thornton's property to continue north and connect to Mud Creek Trail. The necessary multi -use trail easement is 0.145 acres in size and is located directly on top of an existing water and sewer easement (see attached multi -use trail easement) Since in April of 2006 when Ms. Thornton was first informed of the Scull Creek Trail project and the need for a multi -use trial easement, negotiations have continued including offers of $3,186.60 and most recently the appraised value of $5,000 (see attached case history). The City has also offered to grant Ms. Thornton a 36 foot wide driveway access from Gregg Avenue rather than the normal 24 foot standard. On November 27`h, 2006 a development project called Shoppes at Shiloh was proposed on this property and was approved by Planning Commission. The applicant requested a waiver of the Unified Development Code to allow a second curb -cut from Gregg Avenue. This waiver was unanimously denied by the Planning. Commission so the applicant appealed the Planning Commission motion to City Council. The applicant then tabled indefinitely prior to the December 196, 2006 City Council meeting. The item was never brought back up to the City Council, so it is considered denied by the City Council. 1 City Council Meeting of July 15, 2008 Over the past several years, 40 acres of land and easement has been obtained from 25 separate properties for Scull Creek Trail. 18 of the 25 property owners have donated the land or easement to the City in support of the trail. These donations result in 32 acres or 80% of the land and easements for Scull Creek Trail donated. DISCUSSION: As of June 24`h, 2008, Ms. Thomton is not willing to accept the appraised value offer of $5,000 and the 36 foot wide driveway access from Gregg Avenue. She is insistent that the only way she would agree to the multi -use trail easement is if the City will give her approval for two curb cuts off from Gregg Ave. The two curb cuts cannot be granted by the City due the Planning Commission and City Council denial based on safety concerns and the necessary waiver from the Unified Development Code. BUDGET IMPACT: This payment will be funded with a portion of the 2006 Transportation Bond Trail Improvement proceeds. $5,140 to cover $5000 to Ms. Thomton and a $140 filing fee with the Washington County Courthouse has been budgeted for land acquisition in the Scull Creek Trail Improvements Project. 2 RESOLUTION NO. My understanding is that the City will agree to pay you Five Thousand Dollars ($5,000.00) for the trail easement to be built and maintained on top of the City's sewer easement running across your property In addition, the Mayor .and City Plannuig. Staff have agreed to strongly recommend to the Planning commission (which makes all such decisions) that your property be allowed a Thirty -Six foot (36') wide access driveway onto Gregg Street rather than the normal Twenty -Four foot (24') driveway. This will allow a three lane instead of two lane driveway access from/ to Gregg Street for your property. 'I sit with the Planning Commission at their meetings and will remind them of the Mayor's commitment if and when you decide to develop your property. Because you have already been compensated for the City's acquisition of the sewer main easement, .the City's offer to pay you an • additional $5,000.00 just to build and maintain a trail onthis same strip of Iand. is quite fair We hope this trail will carry substantial traffic as soon as it is complete (in. the near future) and should be an asset to your property by bringing more potential customers to the many types of businesses that could wish to locate there. CASE HISTORY Scull Creek Trail Ruth Carolene Thornton 3360 Gregg Street Fayetteville AR 72704 Parcel No. 765-15781-000 Instrument Number 2008-9698 4/13/2006 E-mail message sent to Ms. Thornton at cthorntoio itlshop.ionesnet.orq. The message indicated the plans for Scull Creek Trail and the need for a multi -use trail easement across a portion of her property. Attachments included an overall Scull Creek Trail map along with the detailed map of the proposed trail location on her property. (No response from Ms. Thornton followed) 2/5/2008 E-mail message sent to Ms. Thornton describing the proposed Scull Creek Trail project and how it will not adversely affect the planned development protect called Shoppes at Shiloh. $3,186.60 was offered for a 5,311 square foot multi -use trail easement along with the multi -use trail easement document and exhibits. The offer was based on 0 60 cents per square foot for an appraisal of a similar property located north of the Thornton Property. (No response from Ms. Thornton followed) 3/11/2008 Meeting with Ms. Thornton, her son, Mayor Dan Coody, Matt Mihalevich, and Brian Shaw. During this meeting the Mayor expressed the need for a multi -use trail easement across Ms. Thornton's property for Scull Creek Trail. Ms. Thornton said she would like the City to guarantee two curb cuts for driveway access from Gregg Avenue to her property. The Mayor explained the history that the Planning Commission had denied the two curb cuts, it was then appealed to City Council, but tabled indefinitely prior to the meeting resulting in a denial by the City Council. Since both the Planning Commission and City Council denied the request for two curb cuts, there was no way the Mayor can offer her approval of the two curb cuts. 5/6/2007 Mayor Dan Coody sent Ms. Thornton an e-mail further reinforcing the fact that two separate driveways can not be installed on Gregg Ave due to the required separation distance between Shiloh Road and between drives. The Mayor offered to allow one wider driveway approach from Gregg Ave — 36 feet instead of the standard 24 feet. The message also stated that an appraisal is underway for condemnation of the small strip of land needed for the multi -use trail easement running concurrently over the top of the existing sewer easement. 6/5/2008 A letter prepared by Mr. Kit Williams, City Attorney was sent to Ms. Thornton via e-mail and regular mail offering $5,000 for the 6,320 square foot multi -use trail easement in addition a 36 foot wide driveway access from Gregg Ave. was offered. The multi -use trail easement is located directly over existing 35 foot wide water & sewer easement instrument number 2006-23420. Offer was based on fee simple value of $0.75/s.f. as determined in appraisal at full fee simple. 6/9/2008 Another e-mail was sent by Dan Coody to Ms. Thornton with the $5,000 offer and 36 foot wide driveway access. The mayor also brought up the condemnation process as an option we do not want to use. The multi -use easement document and letter from Kit Williams were attached. 6/24/2008 Matt Mihalevich spoke with Ms. Thornton about the $5,000 offer and the 36 foot wide access. She was insistent that the only way she would agree to the multi -use trail easement is if the City will grant her two curb cuts off from Gregg Ave. Mihalevich explained to her once again that this is not possible because the Planning Commission and City Council denied two the two curb cuts from Gregg Ave. Mihalevich then informed Ms. Thornton that the City would have to resort to condemnation if this offer is unacceptable. Ms. Thornton again said she will only agree to the multi -use trail easement if the two curb cuts are allowed by the City. Note: Several phone conversations, primarily voice messages also transpired throughout the process with Ms. Thornton between both Matt Mihalevich and Mayor Goody. Pate, Director of Current Planning Date: December 4, 2006 Subject: Large Scale Development for the Shoppes at Shiloh (LSD 06-2278) RECOMMENDATION Planning Staff recommends denial of the applicant's appeal of the conditions of approval for LSD 06-2278 Shoppes at Shiloh, approved by the Planning Commission on November 27, 2006. BACKGROUND The subject property is located at the northeast corner of Gregg Avenue and Shiloh Drive and is zoned C-2 Thoroughfare Commercial. There is currently a single-family structure on the property with associated accessory structures The owners are proposing an 18,750 sq. ft. retail building with 84 parking spaces. Three curb -cuts are proposed, two onto Gregg Avenue and one onto Shiloh Drive. • Staff recommended approval of the subject development proposal, however recommended denial of a requested waiver from the 200' separation between the two proposed curb -cuts on Gregg Avenue. Staff is not supportive of a 101' waiver to allow a second curb -cut onto Gfegg Ave. given the dose proximity to the southern curb -cut on Gregg Ave. and the amount of traffic in the vicinity of the Gregg Ave. and Shiloh Dr. intersection, finding the interior circulation and additional turning movements created on adjacent streets would compound a dangerous traffic condition (see access findings in staff report). Additionally, the proposed second curb -cut may create a dangerous traffic condition, with vehicle stacking distance limited for the proposed drive-thru on the west end of the building. DISCUSSION • The Planning Commission voted 7-0-0 in favor of this request, including staff's recommendations for the requested waivers from the Design Overlay District requirements. All recommended conditions were approved by the Planning Commission and are reflected in the attached staff report. The waiver from the Unified Development Code requirement that was requested was denied unanimously.
