A RESOLUTION TO WAIVE THE FEE NORMALLY REQUIRED FOR A
CONDITIONAL USE PERMIT FOR PROPERTY OWNERS ADVERSELY
AFFECTED BY THE WALKER PARK NEIGHBORHOOD MASTER PLAN
REZONINGS
WHEREAS, §159.01 (A)(1) of the Unified Development Code permits the City Council
to waive certain permit fees if the waiver serves the public interest, alleviates an unfair burden or
is beneficial to the city as a whole; and
WHEREAS, adopting the Walker Park Neighborhood Master Plan rezonings will be
beneficial to the city as a whole, and
WHEREAS, certain properties within the master plan area will be rendered
nonconforming by these rezonings unless the owners obtain Conditional Use Permits; and
WHEREAS, the City Council should waive the Conditional Use Permit fees for the
remainder of 2008 for property within the Walker Park Neighborhood Master Plan area to
remove the unfair burden the rezonings might have upon these landowners.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS'
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby waives the
Conditional Use Permit fee for the remainder of 2008 for the owners of any land within the
Walker Park Neighborhood Master Plan area whose property was adversely affected by the
rezoning such that a Conditional Use Permit would be advisable.
