IN THE AMOUNT OF $231,750.00 FOR DESIGN AND CONSTRUCTION PHASE SERVICES FOR THE CONSTRUCTION OF THE MT. SEQUOYAH WATER & SEWER IMPROVEMENT PROJECT; AND APPROVING A CONTINGENCY OF $15,000.00. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council of the City of Fayetteville, Arkansas hereby approves Amendment No. 1• to the Contract with Garver Engineering, Inc. in the amount of $231,750.00 for design and construction phase services for the construction of the Mt. Sequoyah Water & Sewer Improvement Project. A copy of Amendment No. 1, marked Exhibit "A" is attached hereto and made a part hereof. Section 2. APPROVED: By: DAN COODY, Mayo ATTEST: By SONDRA E SMITH, City Clerk/Treasurer AMENDMENT TO AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES CITY OF FAYETTEVILLE FAYETTEVILLE, ARKANSAS AMENDMENT NO. 1 Mount Sequoyah Water and Sewer Improvements This Amendment No. 1, dated J(4M) 5' , 2007 shall amend the original contract between the City of Fayetteville (Owner) and GARVER ENGINEERS, LLC (Engineer), dated December 2, 2003 for professional engineering and surveying services in connection with the Mount Sequoyah Water and Sewer Improvements. This Amendment No. 1 adds professional engineering services for the Design, Bidding, and Construction Phase Services as described herein. The City of Fayetteville has approved and accepted as complete the work accomplished by Garver under the original contract for the Study Phase. The City of Fayetteville has reviewed the report prepared during the Study Phase and has selected specific water and sewer line improvements. These specific water and sewer lines are as described in Appendix B — Design, Bidding, and Construction Phase Services and are shown on Exhibit A. The original contract is hereby modified as follows: SECTION 2—BASIC SERVICES OF GARVER Section 2.3 of the original contract shall be modified as follows: 2.3.1.1 The second sentence of this paragraph which states "Bid documents shall include required forms for State Revolving Loan Fund funding." is hereby deleted from this contract. 2.3.2.2 U.S. Army Corps of Engineers — This section is hereby deleted from this contract, since no environmental handling and documentation is included in this contract. 2.3.4 References to "startup, O&M manuals, and one-year performance evaluation" are hereby deleted from this contract. 2.3.7 All references to geotechnical and other subsurface investigations and testing are hereby deleted from this contract. SECTION 6—PAYMENTS TO GARVER Section 6.1 of the original contract is hereby amended as follows: Contract Amendment No. I Mount Sequoyah Water and Sewer Improvements 1 of 2 0396-1000 6.1.2 Design Phase Services For the Scope of Services during the Design Phase described herein, CITY OF FAYETTEVILLE shall pay GARVER the lump sum amount of $130,000. The unused portion of this fee, due to delays beyond GARVER's control, will be increased annually with the first increase effective on or about May 1, 2008. 6.1.3 Bidding Phase Services For the Scope of Services during the Bidding Phase described herein, CITY OF FAYETTEVILLE shall pay GARVER the lump sum amount of $8,000. The unused portion of this fee, due to delays beyond GARVER's control, will be increased annually with the first increase effective on or about May 1, 2008. 6.1.4 Construction Phase Services For the Scope of Services during the Construction Phase described herein, CITY OF FAYETTEVILLE shall pay GARVER the lump sum amount of $87,000. The unused portion of this fee, due to delays beyond GARVER's control, will be increased annually with the first increase effective on or about May 1, 2009. 6.1.5 In addition to the costs defined above, if directed by the CITY OF FAYETTEVILLE, GARVER will hire ARKUPS for Utility Marking Services (estimated at $6,000) and WACO for Property Record Research (estimated at $750). GARVER will pass the actual costs through to the CITY OF FAYETTEVILLE, and the CITY OF FAYETTEVILLE will reimburse GARVER for those costs. PART A - EXTENT OF IMPROVEMENTS This project will involve the installation of approximately 6,900 linear feet of waterline and 600 linear feet of sewer line in the Mount Sequoyah area as shown on the attached Exhibit "A". More specifically, the extent of improvements shall generally be as listed below: 1. Assembly Road — from Andrew Avenue south to Dogwood Lane - 8 -inch waterline. 2. Andrew Avenue — approximately 270 -feet south of Assembly Road - add fire hydrant assembly. 3. Dogwood Lane — from Assembly Road to approximately 1,100 -feet to the west to the roadway bend to the north — 8 -inch waterline. 4. Crescent Drive — from Fletcher Avenue to approximately 470 -feet to the east to tie to the Dogwood Lane waterline — 6 -inch or 8 -inch waterline. 5. Missouri Way — from Dogwood Lane waterline southwest approximately 560 -feet — 8 -inch waterline. 6. Missouri Way— from approximately 100 -feet north of Dogwood Lane to approximately 350 - feet southwest of Dogwood Lane — 8 -inch sanitary sewer. 7. West and South Skyline Drive — from Texas Way on the south to Wesley Road on the north — 8 -inch waterline. 8. East Skyline Drive — from North Skyline Drive south approximately 290 -feet — 8 -inch waterline. 9. Summit Avenue — from Fletcher Avenue on the north to approximately 1,400 -feet to the south — 6 -inch or 8 -inch waterline. Water and sewer service lines, as appropriate, shall be extended to each adjacent residence in accordance with CITY OF FAYETTEVILLE requirements. The following contains a description of GARVER's Scope of Services in addition to that described in the original Agreement for the Study Phase. PART B—DESIGN PHASE 1. General Generally, the scope of services for the Design Phase includes limited surveying, preliminary design, final design, and preparation of certain property acquisition documents for improvements to specific Contract Amendment No. 1 — Appendix B Mount Sequoyah Water and Sewer Improvements 1 of 5 0396-1000 water and sewer improvements in the Mount Sequoyah area in Fayetteville, Arkansas. The improvements will consist of the relocation and/or upsizing of existing water lines, placement of new water and sewer lines, and tie-in of adjacent residents to the new or relocated water and sewer lines. The improvements will be limited to the locations as indicated in PART A — EXTENT OF IMPROVEMENTS and as described herein and shown on the attached Exhibit A. 2. Design Surveys Garver's fee for Design Surveys is based on field surveys to supplement CITY OF FAYETTEVILLE planimetrics with utility locations along the alignments as indicated in PART A — EXTENT OF IMPROVEMENTS and as shown on the attached Exhibit A. Field surveys will utilize radial topography methods, to locate any pertinent features or improvements along the designated limits of the project. Drainage features, visible utilities, underground utilities marked by their owners and/or representatives, and water meters will be located. -Permanent control points will be established along the alignment utilizing GPS methods in combination with electronic total stations and data collectors noting the coordinates and elevations to the nearest 0.01 foot. All survey data will be tied to the CITY OF FAYETTEVILLE's plane coordinate system and all elevations will be tied to the National Geodetic Vertical Datum (NGVD) 1929. If directed by the CITY OF FAYETTEVILLE, GARVER will hire ARKUPS for Utility Marking Services. GARVER will pass the actual costs through to the CITY OF FAYETTEVILLE, and the CITY OF FAYETTEVILLE will reimburse GARVER for those costs. GARVER will survey the locations marked by ARKUPS and the utility owners. GARVER will not be responsible for the completeness or accuracy of the markings made by ARKUPS or utility owners, nor will GARVER be liable for costs incurred by CITY OF FAYETTEVILLE due to incomplete or inaccurate utility markings. 3. Property Surveys GARVER will locate existing monumentation representing right of way and/or easements for a maximum of five properties based on record data which will be provided by the CITY OF FAYETTEVILLE or an abstractor under a subconsultant agreement with GARVER. 4. Property Acquisition Documents GARVER will provide mapping as required for preparing easement acquisition documents for CITY OF FAYETTEVILLE's use in acquiring the property. Documentation will include a description of temporary and permanent acquisition for each property. The fee for providing property acquisition documentation is based on permanent right of way and temporary construction easements for no more than 5 properties. The City will be responsible for acquiring right of entry to properties as required to complete individual connections to new utility mains. Property acquisition document preparation will begin after receiving CITY OF FAYETTEVILLE's comments from the Preliminary Design review. 5. Coordination GARVER will furnish plans to all known utility owners potentially affected by the project at each stage of plan development. GARVER shall conduct coordination meetings among all known affected utility owners to enable them to coordinate efforts for any necessary utility relocation. GARVER will also include, as provided by the utility companies, proposed and/or relocated utility information in the construction plans. GARVER will attend coordination meetings with CITY OF FAYETTEVILLE and other agencies as required. 6. Preliminary Design GARVER will perform a preliminary design and submit a preliminary opinion of probable construction cost and preliminary plans to include the known utilities, roadways, property lines as shown on the CITY OF FAYETTEVILLE GIS, relevant structures, relevant trees and shrubs, and the horizontal alignments of all proposed water improvements and the horizontal and vertical alignments of all proposed sewer improvements. GARVER will meet with CITY OF FAYETTEVILLE to discuss the design before proceeding with Final Design. GARVER-wilt not continue with Final Design until the Preliminary Design is approved by CITY OF FAYETTEVILLE in writing. 7. Final Design GARVER will perform final design and shall prepare construction plans and specifications and final construction details and quantities, special provisions, and an opinion of probable construction cost. GARVER will make a final field inspection with CITY OF FAYETTEVILLE; and shall make minor changes to the final plans as a result of the final field inspection. CITY OF FAYETTEVILLE will furnish GARVER standard construction details and specifications in electronic format for GARVER's use. GARVER will make the necessary submittals to the Arkansas Department of Health. CITY OF FAYETTEVILLE will reimburse GARVER for payment of the Department of Health review fee in addition to the Lump Sum fee for services described herein. PART C — BIDDING SERVICES During the bidding phase of the project, GARVER will dispense construction contract documents to prospective bidders (at the approximate cost of reproduction and handling), support the contract documents by preparing addenda as appropriate, participate in a pre-bid meeting if necessary, attend the bid opening, prepare bid tabulation, evaluate bids, recommend award, and prepare construction contracts. PART D — CONSTRUCTION PHASE SERVICES During the construction phase of work, GARVER will accomplish the following: 1. Issue a Notice to Proceed letter to the Contractor and attend preconstruction meeting, which will be combined with the utilities coordination meeting. 2. Review the Contractor's progress payment requests based on the actual quantities of contract items completed and accepted, and will make a recommendation to CITY OF FAYETTEVILLE regarding payment. 3. Attend progress/coordination meetings with CITY OF FAYETTEVILLE/Contractor. 4. Evaluate and respond to construction material submittals and shop drawings. Corrections or comments made by GARVER on the shop drawings during this review will not relieve Contract Amendment No. 1 — Appendix B Mount Sequoyah Water and Sewer Improvements 3 of 5 0396-1000 Contractor from compliance with requirements of the drawings and specifications. The check will only be for review of general conformance with the design concept of the project and general compliance with the information given in the contract documents. The Contractor will be responsible for confirming and correlating all quantities and dimensions, selecting fabrication processes and techniques of construction, coordinating his work with that of all other trades, and performing his work in a safe and satisfactory manner. 5. Maintain a set of working drawings and prepare and furnish record drawings. 6. Provide part-time resident construction observation services for the 180 -calendar -day construction contract performance time. The proposed fee is based on approximately 4 hours per day, 5 days per week, during the 180 -calendar -day construction contract performance time. If the construction time extends beyond the time established in this agreement or if CITY OF FAYETTEVILLE wishes to increase the time or frequency of the observation, CITY OF FAYETTEVILLE will pay GARVER an additional fee agreed to by CITY OF FAYETTEVILLE and GARVER. 7.. When authorized by CITY OF FAYETTEVILLE, prepare change orders for changes in the work from that originally provided for in the construction contract documents. If redesign or substantial engineering or surveying is required in the preparation of these change order documents, CITY OF FAYETTEVILLE will pay GARVER an additional fee to be agreed upon by CITY OF FAYETTEVILLE and GARVER. 8. Participate in final project inspection, prepare punch list, review final project closing documents, and submit final pay request. Construction observation services will be provided by GARVER's Resident Project Representative, who will provide or accomplish the following: • Consult with and advise CITY OF FAYETTEVILLE during the construction period. • Coordinate with the firm providing construction materials quality assurance testing under separate contract with CITY OF FAYETTEVILLE. • Maintain a file of quantities incorporated into the work, test reports, certifications, shop drawings and submittals, and other appropriate information. • Maintain a project diary which will contain information pertinent to each site visit including date and weather conditions, names of important visitors, construction work in progress and location, size of Contractor's work force and equipment in use, number of hours worked by Contractor's forces, and substance of important conversations with the Contractor. In performing construction observation services, GARVER will endeavor to protect CITY OF FAYETTEVILLE against defects and deficiencies in the work of the Contractor(s); but GARVER cannot guarantee the performance of the Contractor(s), nor be responsible for the actual supervision of construction operations or for the safety measures that the Contractor(s) takes or should take. However, if at any time during construction GARVER observes that the Contractor's work does not comply with the construction contract documents, GARVER will immediately notify the Contractor of such non-compliance and instruct him to correct the deficiency and/or stop work, as appropriate for the situation. GARVER will also record the observance, the discussion, and the actions taken. If the Contractor continues without satisfactory corrective action, GARVER will notify CITY OF FAYETTEVILLE immediately, so that appropriate action under CITY OF FAYETTEVILLE's contract with the Contractor can be taken. Water and Sewer Improvements 4 of 5 0396-1000 PART E - PROJECT DELIVERABLES The following will be submitted to CITY OF FAYETTEVILLE, or others as indicated, by GARVER: 1. Three copies of the Preliminary Plans with opinion of probable construction cost. 2. One copy of half -sized Preliminary Plans to each potentially affected utility company. 3. Three copies of the Final Plans, Special Conditions which amend, modify, or clarify CITY OF FAYETTEVILLE Standard Specifications, and an opinion of probable construction cost. 4. Ten copies of the Final Bid Documents and an opinion of probable construction cost. 5. One copy of half -sized revised Final Plans to each potentially affected utility company. 6. Three copies of the right-of-way acquisition documents. 7. Electronic files as requested. PART F — EXTRA WORK The following items are not included under this agreement but will be considered as extra work: 1. Redesign for CITY OF FAYETTEVILLE's convenience or due to changed conditions after previous direction or approval. 2. Submittals or deliverables in addition to those listed in PART E. 3. Pavement Design. 4. Design of any utilities relocation other than water and sewer. 5. Retaining wall or other significant structural design. 6. Construction materials testing. 7. Environmental Handling and Documentation, including wetlands identification or mitigation plans or other work related to environmentally or historically (culturally) significant items. 8. Coordination with FEMA and preparation/submittal of a CLOMR and/or LOMR. 9. Survey crew time for field checking quantities, contractor's layout, etc. Extra Work will be as directed by CITY OF FAYETTEVILLE in writing for an additional fee as agreed upon by CITY OF FAYETTEVILLE and GARVER. PART G — SCHEDULE GARVER will begin work under this agreement within ten days of written authorization and complete the scope of work in substantial conformance to the attached schedule, assuming meetings are completed, as needed, with appropriate direction provided by the CITY OF FAYETTEVILLE. I. Design Surveys — to be completed 60 calendar days after Notice to Proceed. 2. Property Surveys — to be completed 20 calendar days after completion of Design Surveys. 3. Preliminary Design — to be completed 60 calendar days after completion of Design Surveys. 4. Acquisition Documents — to be completed 20 calendar days after City approval of Preliminary Design. 5. Final Design — to be completed 60 calendar days after City approval of Preliminary Design. RECOMMENDATION Fayetteville City Administration recommends approval of an amendment to the Engineering contract with Garver Engineers, Inc., in the amount of $231,750.00, for Design and Construction Phase Services pertaining to Construction of the Mt. Sequoyah Water & Sewer Improvement Project, and approve a contingency of $15,000.00. BACKGROUND This project involves installing approximately 6,900' of water and 600' of sewer line in the Mount Sequoyah area. The objective is to replace existing, old water and sewer mains that are undersized and/or located underneath houses built after the original lines were installed. Where this is the case, new meters and services will be installed. Garver Engineers has performed preliminary engineering and field surveys for this project. A change order is now required for fmal engineering design. DISCUSSION Garver has performed preliminary design work for the project. Executing the amendment to have Garver design this work, and continuation of construction phase services with this firm (including submittal review, construction inspection, and general resident engineer services) will provide the City with continued responsible charge and subsequent engineering responsibility by a single, consistent entity. Garver has been working well with the East Line portion of the WSIP project Their services have been conducted in a timely, professional manner and we have every reason to believe that this track record will continue throughout construction and post -construction phase activities for this project as well BUDGET IMPACT Funds are available in the 2007 project budget. BACKGROUND This is a budgeted project under construction. In the past Change Order # l has been executed. This Change Order did not change the cost of the contract but did add 14 calendar days to the time of the contract. There were two under ground concrete tanks at Mt. Sequoyah Garden Parks that needed to be filled-in. Staff worked out an agreement with the contractor to use the excavated dirt from this project to fill these tanks at no cost to the City. This change order added 14 calendar days to the contract time, to allow for the demolition of the top of the tanks. DISCUSSION The circumstances in the field determined that it was not necessary to construct one segment of the water lines designated as Line "D". Also not to be constructed was Sewer Line "1" (300 feet) and three manholes. At this time Staff recommended to construct a much needed 8" water line in this project area to extend from Dogwood Ln. to Lafayette St. to allow the Water & Sewer Division to construct a 2" water line in place of the existing inadequate and leaky 1 1/4" galvanized line. This line serves 10 residences, which have extremely low water pressure. r Because of weather related delays, unexpected changes in the field, and addition of 225 feet of 8" water line to the contract, 48 additional days arc being added to the contract time. For more information please refer to attached Change Order #2 to the construction contract. Although Change Order #2 decreases the contract amount by $10,027.17, because of the addition of 48 extra days the Engineering Contract is being amended to adjust for the cost of daily inspections and other services. This addition is in the amount of $35,000, which is an average daily inspection of 4 hours per day. (Please see attached Engineering Contract Amendment #2 for details). BUDGET IMPACT This is a reduction of $10,027.17 to the construction contract, however, it does affect the Engineering fees for the construction management because additional days are granted to the contractor for construction of the added water line. A separate Engineering Contract Amendment is attached for approval as well. This Amendment will increase the cost by $35,000. Council has approved a project contingency of $50,000, which has not been used at all.
