HomeMy WebLinkAbout44-07 RESOLUTIONRESOLUTION NO. 44-07 A RESOLUTION TO OPPOSE HOUSE BILL 1367 WHICH REMOVES THE REQUIREMENT FOR AN ELECTRICAL UTILITY OF OBTAINING A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FROM THE PUBLIC SERVICE COMMISSION WHEN ERECTING TALLER ELECTRICAL POLES TO CARRY 161kV TRANSMISSION LINES WHEREAS, SWEPCO initially attempted to avoid all public hearings for its project to replace its wooden poles carrying a 69kV transmission with significantly taller metal towers carrying a 161kV transmission line through Fayetteville; and WHEREAS, the affected citizens, property owners, and government should be allowed a public hearing before the Public Service Commission for such an expansion, rebuilding, and upgrading of the electrical poles and transmission line which can have an adverse and deleterious effect upon property owners and other citizens; and WHFREAS, electrical utility companies enjoy numerous government granted special rights including the powers of condemnation and monopoly, so that it is fit and proper that these companies should be willing to submit their plans for substantially larger facilities to the Public Service Commission so that property owners and citizens can testify about the certificate of public convenience and necessity. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby expresses its opposition to House Bill 1367 which Would limit or foreclose property owners' current rights to explain their concerns to the Arkansas Public Service Commission when an electrical utility is planning to build much larger and taller electrical towers that can adversely affect property values, economic vitality and aesthetics. Section 2: That the City Council of the City of Fayetteville, Arkansas hereby requests the Senate of the State of Arkansas to reject House Bill 1367 as unnecessary and unwise.
