A RESOLUTION APPROVING AN ADDENDUM TO THE
CONTRACT WITH WILSON ESTES POLICE ARCHITECTS IN
THE AMOUNT OF $35,500.00 FOR SERVICES ASSOCIATED
WITH GAINING LEED CERTIFICATION FOR THE DISTRICT
COURT AND CITY PROSECUTOR FACILITY.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby approves an Addendum to the Contract with Wilson Estes Police
Architects in the amount of $35,500.00 for services associated with gaining LEED
Certification for the District Court and City Prosecutor Facility. A copy of the
Addendum, marked Exhibit "A" is attached hereto and made a part hereof.
Section 2. That the City Council of the City of Fayetteville,
hereby authorizes the Mayor to sign the attached Addendum.

Dear Coy,
In accordance with all other terms and conditions of the current agreement with the City of
Fayetteville under the AIA Standard Form of Architect's Services dated June 23, 2005, Wilson
Estes Police Architects propose to provide the following Additional Services:
Provide comprehensive services for the design and construction documentation to achieve LEED
silver certification for the Fayetteville District Court and Prosecutor's office. The scope of work shall
include the addition of sustainable design engineering, cost benefit analysis, building systems
commissioning, LEED required process documentation, and all fees necessary for project
registration with USGBC and certification review.
Compensation for the above stated scope of services shall be a Guaranteed Fixed Fee of $35,500.

Recommendation
Staff recommends that the City Council consider and accept a contract addendum to the
Wilson Estes Police Architects' contract to design the District Court and City Prosecutor
Facility. The proposed addendum is in the amount of $35,500, and would be added to the
present contract of $264,300 (plus reimbursable expenses).
Background
On October 2, 2007, the Fayetteville City Council passed a resolution declaring that
future city buildings (5,000 square feet and larger) would be LEED certified. The
District Court and City Prosecutor Facility will be the first city -owned building bid and
constructed after this resolution became effective.
Discussion
Because of the extra work needed to design a LEED building, provide cost/benefit
analysis, commission the building's systems, provide needed process documentation,
and, register the project with the certifying organization, Wilson Estes Police Architects
requests additional compensation. When Wilson Estes' original contract was negotiated,
LEED certification was not in their scope of work. Staff has negotiated the additional
amount of $35,500 for the LEED associated work, and submits that this amount is fair
and equitable compensation for this additional needed work.

The design effort for the District Court and City Prosecutor Facility (formally known as
the Joint Public Safety Command Center) is included in the adopted
Five Year Capital Improvements Program (2006 — 2010).
