HomeMy WebLinkAbout213-07 RESOLUTIONRESOLUTION NO. 213-07 A RESOLUTION TO APPROVE THE PROMOTION OF AFFORDABLE HOUSING AGREEMENT WITH RAUSCH COLEMAN HOMES, LLC WHEREAS, the City Council has placed the promotion of affordable housing in Fayetteville as a high priority for Fayetteville; and WHEREAS, City Staff prepared a Request For Proposals to find an appropriate housing builder/residential developer to work with toward the goal of increased affordable housing for our citizens; and WHEREAS, the City Selection Committee chose Rausch Coleman Homes, LLC as the best possible partner to create more affordable housing in Fayetteville NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: The City Council of the City of Fayetteville, Arkansas hereby approves the Promotion of Affordable Housing Agreement with Rausch Coleman Homes, LLC (attached as Exhibit A) and agrees that City Staff should partner with Rausch Coleman Homes, LLC by soliciting grants, etc. to achieve the goal of increased number and availability of affordable housing in Fayetteville. SMITH, City Clerk/Treasurer PROMOTION OF AFFORDABLE HOUSING AGREEMENT WHEREAS, the City of Fayetteville desires to promote and facilitate affordable housing for the citizens of Fayetteville; and WHEREAS, the City advertised a Request For Proposals from house builders/residential developers to work with the City to provide and increase affordable housing in Fayetteville; and WHEREAS, a City Selection Committee evaluated all of the Responses to the RFP and selected Rausch Coleman Homes, LLC as the most qualified and competent applicant. Now Therefore, The City Of Fayetteville And Rausch Coleman Homes, LLC Hereby Agree: 1) Tenn: This agreement shall begin upon the signed approval of Rausch Coleman Homes, LLC and Mayor Dan Coody and shall run for an initial term through December 31, 2008. This agreement shall be automatically renewed under the identical terms for up to four one year periods beginning January 1, 2009, unless either party notifies the other in writing one month prior to the renewal date. 2) Voluntary Termination: Either party may terminate this agreement without cause by giving the other party thirty days' written notice of its intention to terminate the agreement. 3) Notices: Any and all notices provided for under this agreement shall be delivered (in person or by first class mail) to: Rausch Coleman Homes LLC ATTN: Fred Rausch 300 E. Main Farmington, AR 72730 4) Response and Request For Proposals Incorporated: Office of the Mayor City Administration Building 113 W. Mountain Fayetteville, AR 72701 This agreement incorporates and includes as if set forth word for word all the terms, conditions, proposals, recitatals, and representations within the City's Request For Proposals and Rausch Coleman Homes, LLC Response thereto. 5) Grants and Donations: The City shall work with Rausch Coleman Homes, LLC to attempt to obtain and utilize grants and donations for affordable housing projects to be accomplished by Rausch Coleman. 6) Assignment: This agreement may not be assigned without the express written consent of the other party. 7) Entire Agreement: The Request For Proposals, Rausch Coleman Homes, LLC's Response thereto and this document make up the entire agreement and no other oral or written terms, conditions, promises. etc. shall have any effect or validity. 8) Venue and Jurisdiction: The proper venue and jurisdiction for any dispute involving this document is and shall be Washington County, Arkansas. 9) Freedom of Information Act: City contracts and documents prepared while performing city contractual work are subject to the Arkansas Freedom of Information Act. If a Freedom of Information Act request is presented to the City of Fayetteville, the (contractor) will do everything possible to provide the documents in a prompt and timely manner as prescribed in the Arkansas Freedom of Information Act. (A.C.A. §25-19-101 et. Seq.) Only legally authorized photocopying costs pursuant to the FOIA may be assessed for this compliance. CITY COUNCIL AGENDA MEMO To: Mayor and Council Thru: Gary Dumas, Director of Operations From: Yolanda Fields, CR Director Date: December 5, 2007 Subject: Approval of Agreement with Rausch Coleman for the Promotion of Affordable Housing RECOMMENDATION Staff recommends approval of Agreement. BACKGROUND Affordable housing is decent housing affordable to individuals and families earning less than 80% of the area median income and paying no more than 30% of their income for housing. We have experienced a challenge with providing this type of housing product to the community. In July of this year the City Council made the affordable housing challenge a goal to be tackled. Staff has been and will continue to work to find ways to create affordable/attainable housing stock and to maintain the affordable/attainable housing stock we currently have. DISCUSSION The U.S. Department of Housing and Urban Development (HUD) provides funding for the HOME program which is administered through the Arkansas Development Finance Authority (ADFA) ADFA is Arkansas' largest source of low cost financing for low -to - moderate income housing development. The HOME program may be used to assist eligible low-income homebuyers to finance the purchase of a home. Rausch Coleman, LLC will be building affordable/attainable housing and will be applying for HOME funding to provide homeowner assistance for the homes. The City of Fayetteville will be partnering with this developer in the effort to increase the affordable/attainable housing stock. BUDGET IMPACT No impact. RESOLUTION NO.
