A RESOLUTION APPROVING AN ADDENDUM TO THE
ENGINEERING SERVICES CONTRACT WITH HDR/EES, INC.
IN THE AMOUNT OF $9,300 00 FOR COMPLETION OF A
COMPREHENSIVE WATER AND SEWER RATE STUDY.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby approves an Addendum to the Engineering Services Contract with
HDR/EES, inc. in the amount of $9,300.00 for completion of a comprehensive
water and sewer rate study. A copy of the Addendum, marked Exhibit "A" is
attached hereto and made a part hereof.
Section 2. That the City Council of the City of Fayetteville,
hereby authorizes the Mayor to sign the attached Addendum.

AMENDMENT TO SERVICES AGREEMENT
The Services Agreement (hereinafter "Agreement") dated May 19, 2006 between the City of
Fayetteville and HDR Engineering, Inc. (hereinafter "HDR") shall be amended and modified by
this amendment (hereinafter "Amendment") as follows:
WHEREAS:
Under the Agreement, HDR is to provide professional services in connection with City of
Fayetteville Water and Sewer.
City of Fayetteville desires to amend said Agreement to adjust contract price of
agreement.
HDR is willing to amend the Agreement for said contract price adjustment as agreed
upon by the parties.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, City of
Fayetteville and HDR do hereby agree to amend the Agreement as follows:
The Agreement and the terms and conditions therein shall remain unchanged except for
the sections listed below:
"Compensation": Increased by $9,300 for a not to exceed of $107,790.
No cancellation, modification, amendment, deletion, addition, waiver or other change
shall have effect unless specifically set forth in writing signed by the party to be bound
thereby.

RECOMMENDATION
City Administration recommends approval of a contract addendum to the engineering services
contract wih HDR/EES, Inc., in the amount of $9,300.00, for completion of a comprehensive
water and sewer rate study. Funds are available within the project budget.
BACKGROUND
HDR has been conducting an in-depth water and sewer rate study for the City of Fayetteville.
This study has resulted in a detailed cost of service evaluation that is allowing the City leadership
to evaluate water and sewer rates in a complete break from previous methodologies used. It has
also created opportunities for more flexibility in rates, whereby they can be applied more
accurately to different customer groups. The original contract was approved on May 19, 2006, in
the amount of $98,490.00.
DISCUSSION
The cost of service study, with the ability to allocate costs across various customer groups based
on the actual costs of providing the service to that group, has generated a great deal of discussion
about the philosophy of applying rates to different customer classes. As a result, the consultant
has needed to make more presentations to staff and the Water/Sewer Committee than were
included m the original contract.
This addendum for $9,300 allows for three additional trips for Water/Sewer and/or City Council
meetings, at a rate of $3,100 per trip. This is consistent with the original contract, and takes the
total contract amount to $107,790; the City will only be billed for trips actually required.
BUDGET IMPACT
No contmgency was approved with the original contract, but $39,000 remains and is available
within the project budget. This expenditure will leave a balance of $29,700.

Subject: Water and Sewer Rate Study Contract Addendum
Dear Rainy:
HDR Engineering, Inc. (HDR) was retained by the City of Fayetteville (City) to conduct a
comprehensive water and sewer rate study. As you know, we are nearing the completion of this
study but potentially still have a series of public meetings to complete and finalize the study.
The original contract budget for the study and these meetings have been expended by the prior
meetings held with the Water and Sewer Commission. Therefore, HDR is respectfully
requesting a contract addendum in the amount of $9,300.00 to conduct these final meetings.
This amount is intended to cover both labor and expenses associated with preparing handout
materials for the presentations, attending the meeting/presentation and any associated travel -
related expenses.
It has been assumed that a total of three additional public meetings will be required.
Specifically, these meetings will be as follows:
• Water and Sewer Commission Meeting (Dec. 10) — Select final rate designs for presentation
to the City Council.
■ Fayetteville City Council (date to be determined) — Presentation of the comprehensive water
and sewer rate study
• Fayetteville City Council (date to be determined) — Public Hearing on the proposed rates

It is further assumed that the cost of each meeting is as follows:
Labor (Preparation/Meeting) 10 Hrs. @ $215/hr $2,150.00
Airfare 500.00
Car Rental 100.00
Hotel 150.00
Meals 50.00
Misc. Expenses (copes, phone, technology charges, etc.) 150.00
Grand Total Per Meeting $3,100.00
Given the assumed three (3) additional meetings, the total requested addendum is $9,300.00. In
making this request, HDR will only bill the City for the number of meetings presented. Similar
to the existing contract, HDR would propose to bill the City on a fixed fee basis of $3,100.00 per
meeting.
Should this contract addendum be acceptable, please sign two copies and return them to me for
final signature. This signature provides us with written notification of your agreement to this
addendum and terms and conditions.
