A RESOLUTION APPROVING CONTRACT AMENDMENT NO 1
TO THE CONTRACT WITH McCLELLAND CONSULTING
ENGINEERS, INC. IN AN AMOUNT NOT TO EXCEED $74,690.50
FOR PERMITTING SUPPORT, EASEMENT DOCUMENT
PREPARATION, ELECTRICAL DESIGN AND RELATED
SERVICES ASSOCIATED WITH THE COLLEGE AVENUE
IMPROVEMENTS PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby approves Amendment No. 1 to the Contract with McClelland Consulting
Engineers, Inc. in an amount not to exceed $74,690 50 for permitting support,
easement document preparation, electrical design and related services associated
with the College Avenue Improvements Project. A copy of Amendment No. 1,
marked Exhibit "A" is attached hereto and made a part hereof.

AMENDMENT NO. 1
TO
AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
COLLEGE AVENUE IMPROVEMENTS — PHASE I
FROM ROCK STREET TO MAPLE STREET
ARKANSAS HIGHWAY AND TRANSPORTATION DEPARTMENT PERMITTING,
EASEMENT DOCUMENTATION AND ELECTRICAL DESIGN SERVICES
The Agreement for Professional Engineering Services executed on December 5th, 2006
for the Survey and Preliminary Design of the College Avenue Improvements — Phase I in
Fayetteville, Arkansas is hereby amended. This Amendment entered into and executed on the
date indicated beneath the signature blocks, by and between the City of Fayetteville (hereinafter
"City of Fayetteville") and McClelland Consulting Engineers, Inc (hereinafter "McClelland")
changes the authorized Scope of the Project, and the Fees and Payments, due to the requested
increase in scope of services on the College Avenue Improvements — Phase I. The scope of
amendment one includes the creation of engineering documents to the level necessary to obtain
construction approval from the Arkansas Highway and Transportation Department (hereinafter
"AHTD") the creation of' easement documentation (sidewalk and temporary construction
easements anticipated) and the production of electrical engineering documents for the installation
of proposed streetlights and associated wiring.
The Agreement lists the Scope of Services for:
1. AHTD Permitting Services
2. Easement Documentation (Sidewalk Easements and Temporary Construction
Easements Anticipated)
3. Electrical Engineering Services
The purpose of this Amendment No. 1 is to authorize McClelland to complete the AHTD
Permitting the creation of easement documentation (sidewalk and temporary construction
easements anticipated) and Electrical Design Services as defined in the Agreement and
hereinafter, and to establish compensation for these services.

SECTION 2 — BASIC SERVICES OF MCCLELLAND
McClelland is hereby authorized to complete AHTD Permitting the creation of easement
documentation (sidewalk and temporary construction easements anticipated) and Electrical
Design Phase Services as defined under Section 2.2 of the Agreement, to include the creation of
engineering documents only to the level necessary to obtain construction approval from the
Arkansas Highway and Transportation Department (hereinafter "AHTD") the creation of
easement documentation (sidewalk and temporary construction) based upon the existing parcel
information and the production of electrical engineering documents for the installation of
proposed streetlights and associated wiring as defined under Section 2 of the Agreement.
From the time the City of Fayetteville issues the Notice To Proceed (NTP), McClelland.
will endeavor to execute the project within the following time periods:
Task Completion After NTP
A. AHTD Permitting, Easement Documentation
(Sidewalk and Temporary Construction)
and Electrical Design
SECTION 6 — PAYMENTS TO MCCLELLAND
120 calendar days
(Receipt of AHTD permit)
Compensation for Permitting and Electrical Design Services shall be based upon for
Scope of Services indicated above. The estimated manhours and labor rates as applicable for
these phases of the project are given on the attached Exhibit "A". The fee shall be based on the
Hourly Rates shown on the attached Exhibit "B" and the Total Fee shall be a Not -To -Exceed as
follows:

This Amendment No. 1 authorizes an additional Seventy
Four Thousand Six Hundred Ninety and 0.50 dollars ($ 74,690.50 ) to the originally approved
One Hundred Eight Thousand One Hundred Eleven dollars ($ 108,111.40 ). This amended
Contract Amount ($ 182,801.90) shall not be exceeded without specific written authorization
from the City of Fayetteville.
All other provisions and conditions of the original Agreement remain in full force and
effect. AHTD Permitting, Easement Documentation and Electrical Design shall be completed to
conform to the City of Fayetteville's schedule.
IN WITNESS WHEREOF, the parties hereto have caused this AGREEMENT to be duly
executed as of the date and year first herein written.

Subject: A resolution approving Contract Amendment No. 1 with McClelland

permitting support, easement document preparation, electrical design,
and related services associated with the College Avenue Improvement
Project.
RECOMMENDATION:
Staff recommends approval of Contract Amendment No. 1 with McClelland Consulting
Engineers, Inc. in the amount of $74,690.50 for permitting support, easement document
preparation, electrical design, and related services for College Avenue, from Rock Street
to Maple Street.
BACKGROUND:
The College Avenue Improvement Project is included in the Transportation Improvement
Bond Program. The project includes sidewalk replacement, tree and landscaping
installation, decorative lighting, and removal/reconfiguration of existing driveways to
provide better access management and increase safety. No changes to the existing street
capacity are planned.
DISCUSSION:
Under this Contract Amendment, McClelland will provide permitting support, easement
document preparation, electrical design, and related services as detailed in the Contract.
The services will provide a completed product that the City will use to construct the
improvements to College Avenue. The contract amount for this work is $74,690.50.
BUDGET IMPACT:
The contract amendment amount of $74,690.50 will be paid from the Transportation
Improvement Bond Funds. The total amended contract is therefore $182,801.90.
