Osborn 2900 West 6 Street Fayetteville, AR 72701 I RE' Wastewater Treatment Plant Project — Water/Sewer Easement Acquisition Tract # E-7-51 il Response to Counter -Offer Parcel#765-15224-000 • Dear Mr. Osborn: Now that the Wastewater Treatment Plant is under construction on the West side of town and the Noland Plant is being renovated on the East side, we are in the process of continuing the easement acquisition process for the new lines for the east side of town. I In June, 2005, you were presented an offer to purchase a permanent easement of 10 feet, and rental for a 50 - foot temporary construction and grading easement. Bidder has carefully studied all: (1) reports of explorations and tests of subsurface conditions at or contiguous to the Site and all drawings of physical conditions in or relating to existing surface or subsurface structures at or contiguous to the Site; and (2) reports and drawings of a Hazardous Environmental Condition, if any, at the Site. Bidder acknowledges that such reports and drawings are not Contract Documents and may not be complete for Bidder's purposes. Bidder acknowledges that Owner and Engineer do not assume responsibility for the accuracy or completeness of information and data shown or indicated in the Bid Documents with respect to Underground Facilities at or contiguous to the Site. Bidder does not consider that any additional examinations, investigations, explorations, tests, studies, or data are necessary for the determination of this Bid for performing and furnishing of the Work in accordance with the times, price, and other terms and conditions of the Contract Documents. Bidder is aware of the general nature of work to be performed by Owner and others at the Site that relates to Work for which this Bid is submitted as indicated in the Contract Documents.
