HomeMy WebLinkAbout155-07 RESOLUTIONRESOLUTION NO, 155-07 A RESOLUTION APPROVING AN INTER -LOCAL AGREEMENT BETWEEN THE CITY OF FAYETTEVILLE, ARKANSAS AND WASHINGTON COUNTY, ARKANSAS TO BUILD A NEW LAW ENFORCEMENT FIRING RANGE; AND APPROVING A BUDGET ADJUSTMENT IN THE AMOUNT OF $40,000.00 AS THE CITY OF FAYETTEVILLE'S SHARE OF THE CONSTRUCTION COSTS. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council of the City of Fayetteville, Arkansas, hereby approves an Inter -local Agreement between the City of Fayetteville, Arkansas and Washington County, Arkansas to build a new law enforcement firing range. A copy of the agreement, marked Exhibit "A" is attached hereto, and made a part hereof. Section 2. That the City Council of the City of Fayetteville, Arkansas hereby approves a budget adjustment in the amount of $40,000.00 as the City of Fayetteville's share of the construction costs. Section 3. That the City Council of the City of Fayetteville, Arkansas hereby authorizes the Mayor and City Clerk to execute the Inter -local Agreement with Washington County, Arkansas. AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF FAYETTEVILLE, ARKANSAS AND WASHINGTON COUNTY, ARKANSAS PERTAINING TO THE USE OF THE WASHINGTON COUNTY SHERIFF'S FIRING RANGE BY THE FAYETTEVILLE POLICE DEPARTMENT WHEREAS, pursuant to A.C.A. § 14-14-910 the County and the City are authorized to enter into an Agreement to pursue joint endeavors; and, WHEREAS, the Washington County Sheriff has, or will soon have, a new firing range; and, WHEREAS, in the past the Washington County Sheriff has been allowed to use the firing range of the City of Fayetteville; and, WHEREAS, the parties desire to share the new firing range of the Washington County Sheriff. NOW, THEREFORE, IT IS AGREED: The new firing range of the Washington County Sheriff will be ready for use soon. 2. For the sum of forty thousand dollars ($40,000) the Washington County Sheriff does hereby agree that the Fayetteville Police Department may share in the use of said range at any and all reasonable times as agreed upon by the parties. 3. That the duration of this agreement shall be perpetual unless terminated by �I withdrawal as set out below. 4. Either party may withdraw from this agreement upon six (6) months written notice pursuant to A.C.A. § 14-14-910. 5. It is further agreed that each of the parties will endeavor to supply additional funds necessary and/or labor if needed to maintain and improve said firing r range. However, neither party may financially obligate the other without the approval of the governing body of each. 6. The parties may acquire real or personal property individually or jointly. In the event of termination or withdrawal, each shall be entitled to property purchased with its own funds. The parties shall agree as to the disposal of property purchased with joint funds. Any dispute concerning such will be settled by the board created herein. 7. Pursuant to A.C.A. § 14-14-910 a Board is hereby created for the purposes of administering this agreement. The Board shall consist of the Washington County Sheriff, the Chief of Police of the City of Fayetteville and a third person to be mutually agreed upon by the Sheriff and the Chief of Police. 8. The Board shall meet as needed. Minutes of meetings shall be kept and copies of such shall be provided to the County Judge and the Mayor, or any other person who requests copies of such. 9. It is agreed and understood that each party has tort immunity, which is specifically preserved, and that both are members of separate risk management programs. 10. This .agreement may be amended from,time to time upon approval of the governing bodies of each; in the event that this agreement is terminated then sums contributed by the City shall be refunded on a pro rata basis. STATE OF ARKANSAS, AN ORDINANCE a TO BE ENTITLED: AN ORDINANCE APPROVING AN INTERLOCAL AGREEMENT PERTAINING TO THE USE OF THE WASHINGTON COUNTY SHERIFF'S OFFICE FIRING RANGE BY THE CITY OF FAYETTEVILLE POLICE DEPARTMENT. WHEREAS, A.C.A. § 14.14-010 authorizes cities and counties to enter into contracts to cooperate or join with each other to provide services; such to specify the responsibilities of all parties; and, WHEREAS, Washington County and the City of Fayetteville desire to enter Into an Interlocal Agreement to allow use of the Washington County SherffFs Department firing range by the City of Fayetteville.
