RESOLUTION NO. 152-07
A RESOLUTION EXPRESSING THE WILLINGNESS OF THE CITY
OF FAYETTEVILLE TO UTILIZE FEDERAL -AID MONEYS AND
APPLY FOR AN 80/20 GRANT IN THE AMOUNT OF $100,000.00
TO REBUILD AND IMPROVE A SECTION OF THE MUD CREEK
TRAIL
WHEREAS, the City of Fayetteville has agreed to apply for funding through the Arkansas
Recreational Trails Program to develop or improve the Mud Creek Trail; and
WEHREAS, the Fayetteville City Council is willing and able to provide the required 20% of the
total project cost; and
WHFREAS, The City of Fayetteville understands that Federal -Aid Funds are available for this
project on a reimbursable basis, requiring work to be accomplished and proof of payment prior to actual
monetary reimbursement; and
WHEREAS, the City of Fayetteville understands that there will be no reimbursement for any
work accomplished prior to the issuance by the Arkansas State Highway and Transportation Department
of an Official Notice To Proceed; and
WHEREAS, this project, using federal funding, will be open and available for use by the general
public and maintained by the City of Fayetteville.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section I: That the City Council of the City of Fayetteville, Arkansas hereby approves the
Engineering Division's request to submit an application for an 80/20 matching grant form the Arkansas
Highway and Transportation Department through the Arkansas Recreational Trails Program for an award
of up to $100,000.00 which would require up to $20,000.00 of City Funds.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby agrees that
Fayetteville will participate in accordance with its designated responsibility including maintenance of this
project, and authorizes the mayor to execute all appropriate agreements and contracts necessary to
expedite the construction of the above state project.
Section 3: That the City Council of the City of Fayetteville, Arkansas hereby pledges its full
support and authorizes the City of Fayetteville to cooperate with the Arkansas State Highway and
Transportation Department to initiate action to implement this project.

Subject: Request for a resolution approving the Engineering Division to submit an application for an
80/20 matching grant through the Arkansas Recreational Trails Program.
Recommendation: Staff requests a resolution approving the Engineering Division to submit an application to
the Arkansas Highway and Transportation Department for consideration of an 80/20 matching grant through
the Arkansas Recreational Trails Program for an award of up to $100,000.00.
Background: Mud Creek Trail, from Front Street east to Kitty Creek, includes a dilapidated section of trail
with a narrow bridge that is in need of replacement. This section of trail was installed more than 10 years ago
by a private developer. The asphalt for the trail was installed without base material and is only 6 feet wide.
The current trail bridge over the Mud Creek tributary is only 4' wide and has a large arch in the middle that
does not comply with the Americans with Disabilities Act (ADA). The reconstruction of this important section of
trail waited on the replacement of a sewer line associated with the City of Fayetteville's new Westside
wastewater treatment plant project. Now that the new sewer line is installed along this section of trail we are
now ready to reconstruct this section of Mud Creek Trail and use this opportunity to bring the trail into
compliance with the Americans with Disabilities Act.
Discussion: If awarded, the funding would be used to complete the reconstruction of the above mentioned
.22 mile section of Mud Creek Trail with a new 12 feet wide asphalt trail and 80' long prefabricated steel trail
bridge. Mud Creek is 2.1 miles long and experiences a great amount of use for recreation and as an
alternative transportation route connecting nearby commercial, residential, office and a senior citizens
community. With the exception of this section, the remainder of the trail is 12 feet wide and is completely ADA
accessible.
A resolution from the City of Fayetteville is required to apply for funding through the Arkansas Recreational
Trails Program. To comply with the grant application requirements, the resolution must include specific criteria
and language. A sample provided by the Arkansas Highway and Transportation Department has been
included, as an attachment to this memorandum.
Budget Impact: If approved by City Council, the grant application will be submitted for a total amount of
$100,000.00. The terms of this grant require a local sponsor or municipality to provide funding for 20% of the
total project cost. Upon receipt of an official Notice to Proceed from the Arkansas Highway and Transportation
Department, the project would be reimbursable at the rate of 80%, which for this project would be estimated at
a total reimbursement amount of $80,000.00. Sufficient funding for the City's portion of this project has been
budgeted in the Trail Development Project, within the Sales Tax Capital Improvement Fund.
