A RESOLUTION CERTIFYING TO THE TAX COLLECTOR OF
WASHINGTON COUNTY THE COSTS OF ABATING UNSIGHTLY AND
UNSANITARY CONDITIONS UPON THE PROPERTY LOCATED AT
1079 SOUTH WASHINGTON AVENUE IN THE CITY OF
FAYETTEVILLE, ARKANSAS.
WHEREAS, pursuant to the provisions of §§ 95.01-95.03, Code of Fayetteville, as
authorized by A.C.A. § 14-54-901 et seq., the City of Fayetteville directed the owner of the
property located at 1079 South Washington Avenue (WC Parcel #765-05685-000) to correct
unsightly or unsanitary conditions on the property; and,
WHEREAS, Globe CEO, LLC, record owner of the property, through its Registered
Agent, Hossein Kouchehbagh, failed to correct the unsightly or unsanitary conditions on the
property within the ten (10) days allotted; and,
WHEREAS, the City of Fayetteville, in accordance with the above-cited ordinances
and statutes, entered upon the property and corrected the unsightly or unsanitary conditions; and,
WHEREAS, by operation of law, the City is given a hen against this real property for
the costs of correcting the unsightly or unsanitary conditions; and,
WHEREAS, the City Council of the City of Fayetteville, Arkansas, is required to
determine the appropnate amount of the lien, and certify this amount to the Tax Collector of
Washington County, Arkansas to be placed on the tax books as delinquent taxes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS*
Section 1. That, by the authonty granted pursuant to § 14-54-901 et seq., and in
accordance with the provisions of §§ 95.01-95.03, Code of Fayetteville, the City Council of the
City of Fayetteville, Arkansas, hereby determines the appropriate amount of the lien against the
property located at 1079 South Washington Avenue (WC Parcel # 765-05685-000) to be
$1,276.25.
Section 2. That the City Council of the City of Fayetteville, Arkansas, hereby certifies
this amount to Mr. David Ruff, Tax Collector for Washington County, Arkansas, so that this
amount, plus ten percent (10%) penalty for collection, be placed on the tax books as delinquent
taxes against the property located at 1079 South Washington Avenue (WC Parcel # 765-05685-

RECOMMENDATION
Staff recommends imposing a lien against the real property for the amount of $1,276.25,
pursuant to A.C.A. 14-54-904.
BACKGROUND
Service Request #14457, Case #2697: Code Compliance sent a Notice of Violation for
Unsightly Unsanitary Conditions on Real Property owned by Globe CEO, LLC c/o
Houssein Kouchehbagh. •The Notice of Violation was signed on September 14, 2004.
Ownership questions and Police investigations delayed abatement measures. Once
vacant, cleanup of the property was immediate. Clean-up concluded 2/16/06.
DISCUSSION
An Accounts Receivable Request was sent to the Accounting Department on 4/4/06 for
the amount of $1,276.25. The Accounting Department has yet to receive the payment for
these services.
BUDGET IMPACT
This $1,276.25 will be imposed as a lien on the property. Once paid, the money will
return to General Fund.

NOTICE TO PROPERTY OWNERS
Pursuant to A.C.A. d14-54-904 and §95.02 of the Fayetteville Code of Ordinances, you are
placed upon Notice that the Fayetteville City Council will conduct a public hearing to
determine the amount of the lien for costs of correcting §95.01 of the Fayetteville Code of
Ordinances at: 1079 S. Washington (Parcel #765-05685-000).
If you need additional information concerning this process or if you have information that we
are not aware of please call the Code Compliance Office at (479) 444-3430.
The public hearing will be part of a regular City Council meeting — probably on May 2, 2006
beginning at 6:00 p.m. at the City Administration Building, 113 West Mountain St,
Fayetteville, AR 72701. it is possible that this hearing may be conducted at a later meeting
such as May 16, 2006 or thereafter.
The City Council Meetings are advertised in local newspapers and will contain an item
concerning this hearing. You may also call the Fayetteville City Clerk's Office (479-575-
8323) for information confirming the date of the public hearing.

§95.01 Unsightly or Unsanitary Conditions on Real Property; order and notice to correct
How This Violation Can Be Voluntarily Corrected
Remove the garbage, trash, rubbish, brush, limbs, fumiture, appliances, junk and/or debris from your property,
including the right-of-way and utility easement.
Penalties:
If this violation is not corrected within ten (10) days from the service of this notice, our office is authorized to
enter upon the property and do whatever is necessary to correct or remove the conditions described above.
The costs of correcting said conditions shall be charged to the owner(s) of the property and the city shall have a lien
against such property for such costs. You can also be issued a Criminal Citation for the above violation and be
summoned to appear in court. If you disagree with our conclusion that your property contains a violation of the
ordinance listed above, please contact our office.
