A RESOLUTION TO VARY THE MASTER STREET PLAN'S
DEDICATION REQUIREMENTS FOR HIGHWAY 265 IN
CONNECTION WITH THE CONSTRUCTION OF FIRE
STATION #5
WHEREAS, it would be an undue hardship upon the City to dedicate the full right of
way pursuant to the Master Street Plan for Highway 265 in conjunction with the construction of
Fire Station #5 because of the existing site conditions (sanitary sewer easements, gas easements,
existing street nghts of way, floodway and floodplain).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS.
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby finds that
pursuant to U.D.C. § 171.03 (A) (1) the right of way dedication requirements of the Master
Street Plan shall be vaned to avoid undue hardship so that the twenty-five foot building setback

RECOMMENDATION
Planning Staff recommends approval of a Master Street Plan variance to vary the Master
Street Plan right-of-way dedication requirements for Crossover Road (HWY 265) to
allow for the construction of Fayetteville Fire Station #5. The required right-of-way
dedication of 55' from centerline shall be dedicated in all locations along the frontage of
the subject property, except in those locations where a full dedication would result in the
proposed structure encroaching into the required 25' building setback.
BACKGROUND
The Arkansas Highway and Transportation Department (AHTD) is designing for the
future expansion of Crossover Road and is currently planning to acquire additional right-
of-way along the east side of the existing street section. The highway expansion has been
designed to accommodate existing utility infrastructure along the west side of Crossover
Road. These include an existing high-pressure gas main along the front of the subject
property and a sewer lift station to the north of the subject property. Staff finds that a
variance of the Master Street Plan right-of-way in this location maintains the integrity
and purpose of the Master Street Plan, and allows for the proposed expansion of HWY
265. Additionally, there are several hardships that are unique to this property, including
an existing high pressure gas main along HWY 265, floodway and floodplain associated
with a tributary of Mud Creek and a sewer force main on the west border of the property.
If the City Council chooses not to allow for a reduced dedication in this area, the building
will likely have to be redesigned to accommodate this requirement.
On March 16, the Subdivision Committee forwarded the proposed large scale
development for Fire Station #5 to the Planning Commission, who will review the item
and the associated Conditional Use request on March 27, 2006.

Agenda Request
Currently under review by City Planning are the Large Scale Development Plans for Fire Station
Number 5 located upon the southwest corner of Crossover Road (Arkansas Hwy 265) and Old
Wire Road. This 1,56 acre parcel of land is currently known as Routh Park and is owned by the
City of Fayetteville, Arkansas.
Per the Master Street Plan, 110 feet of total right-of-way (55 feet from centerline) is required
along Crossover Avenue (Hwy 265). Due to the nature of the existing site (existing sanitary
sewer easements to the west and both existing gas and street easements to the east), additional
right-of-way 'requirements would cause the proposed fire station building to be in violation of the
building setback regulations:
AHTD is currently planning to obtain additional right-of-way for the eventual build -out of •
Crossover by obtaining land to the east of the current road section due to land west of the road
containing such obstacles as city park land, a large operational sanitary sewer pump station, and
a high-pressure gas mann
In subsequent discussions with the Fire Department, City of Fayetteville Planning and
Engineering Staff, WDEA Architects, and McClelland Engineering it was determined that due to
the fact that the current highway improvement plans are still in the preliminary stages, it is unlikely
that a concluding answer regarding the future right-of-way from AHTD would be received — and
therefore it would be unlikely that a waiver from the requirements of the Master Street Plan could
be fully granted.
In order to proceed through the planning process, it was determined that a proper compromise
may be to dedicate all the required right-of-way wherever possible upon the property and
requesting a variance from the Master Street Plan requirements in the area that would be within
the 25 foot setback around the proposed building. Attached is an exhibit that illustrates the
proposed right-of-way dedication for the fire station.

Attacked is an aerial image of the conceptual plans for 265 at this
time. One of AHTD's priorities on this project is avoidance of historic
and park properties, including the Routh Pads, which I understand rs
the future fire station. You'll note on ibis image that the conceptual
design calls for the existing right of way hne along the Routh Park
(40' offset from the centerline) to be maintained. (ie. for roadway
widening to not occur beyond the existhig right of way, although
easements could be needed during construction).
The shift in the; alignment in this area causes the new roadway section
to be very near the creek on the east side. We are currently working
011 measures to take to minimize the impacts.
Please note that this plan is very conceptual and has not been cleared
environmentally_ It is, however, how we are proposing to proceed.
Environmental clearance is the next step, winch will then be followed
by design.

Because our utility easement has "prior right" easement of 50 feet - 25 feet each side of
the gasmain, and no severe interference is apparent in your proposed grading plan, we do
not take exception to the proposed Fire Station depicted in your drawing file.
However, please know that we do request that the original conditions of this easement be
honored. These conditions include no structures to be placed within the easement.
Even though the right of way dedication will overlap our easement, the prior right
scenario will govern should repairs etc. need to take place regarding our gas main.

McClelland Consulting Engineers is currently has civil plans under review with the City of
Fayetteville, AR. For approx. 1.46 acres of land located at the southwest corner of
Crossover Ave and Old Wire Rd (currently known as Routh Park) - See attached site and
grading plans (.pdf).
Duririg technical plat review, Arkansas Western Gas representative Bill Brandt indicated
that there was a 10" high pressure gas main and associated easement running parallel to
the eastern boundary of this site.
Per the requirements of the City of Fayetteville's Master Streets Plan, a 110' ROW is to
exist upon Crossover Avenue (55' from centerline) - this additional ROW would require the
relocation of the existing 10" line - we would like the gas company's opinion on this
improvement.

Right-of-way Dedication: Right-of-way dedication is required for Old Wire Rd. (Minor Arterial -
45' from centerline) and Crossover Rd. (Principal Arterial -55' from centerline).
The Arkansas Highway and Transportation Department is designing the expansion ofHWY 265,
so that the improvements will be on the east side of the existing road. Expanding HWY 265 to
the west is problematic since there is an existing high pressure gas line along the front of the
subject property and a sewer lift station to the north of the subject property. Sufficient right-of-
way exists for Old Wire Rd. to meet the minimum requirements of the Master Street Plan.

The Fayetteville Street Committee and the City Council will review the request for a lesser
dedication of right-of-way for HWY 265 on March 16, 2006 and April 4, 2006 respectively.
Water/Sewer: Water and sewer will be extended to the site to serve the proposed development.
Tree Preservation: Existing Canopy: 9.3%
Preserved Canopy: 1.9%

Mitigation: Required; 11 trees
Site Coverage: The plat indicates 67% pervious surface in compliance with this requirement.
Recommendation: Staff recommends forwarding LSD 06-1962 to the Planning Commission
with the following conditions:
Conditions of Approval:
1. Subdivision Committee determination of Commercial Design. Standards. Staff finds that
the proposed elevations largely meet commercial design standards. However, staff
recommends additional articulation of the east facade and that discussed revisions to this
fdrrade be presented to the Planning Commission.
2. Right-of-way dedication along Crossover Rd. (HWY 265) at 55' from centerline by
warranty deed. The applicant has submitted a request for a lesser dedication of right-of-
way. Based on information provided by the expansion plans for HWY 265, existing
constraints including floodway, a sewer force main, high pressure gas main and the
existing lift station to the north, the combination of which creates a unique hardship on
this property. If the request is denied, the proposed location of the building will not
meet. the required front setback from the Crossover Road right-of-way. Consequently,
the applicant will have to request a setback variance from the Board of Adjustment, or
relocate/redesign the structure.
3. The large scale development shall be subject to approval of a Conditional Use request for
a Public Protection and Utility Facility (Use Unit 3) by the Planning Commission.
4. The Large Scale Development shall comply with the Lighting Ordinance. Any new
lighting and any lighting that is replaced due to construction shall meet the requirements
of Chapter 176. A lighting plan and cut-off sheets for all exterior lighting, including
lighting on the structure, shall be submitted for compliance with the City of Fayetteville
lighting ordinance prior to building permits.
5. A proposed overhead deck is indicated on the west side of the structure, overhanging an
existing sewer easement and trail corridor. Approval by the Water and Wastewater
Superintendent and the Trails Coordinator is required prior to construction.
6. Mitigation will be required on this site. This is equivalent to 11 (2) inch caliper trees,
$2,500.00 deposited into the Tree Escrow Account, or a combination of both. The
developer has proposed to do on-site planting.

7. Any proposed communications tower for the fire station shall be permitted according to
Chapter 163.14. Should the fire station be exempted by the Zoning and Development
Administrator pursuant to 163.14 (E)(4), a Conditional Use shall not be required.
8. Street lights shall be installed along the public right-of-way with a maximum spacing of
300'. If there are existing street lights on either side of the street along the frontage of
this property, then additional street lights shall not be required.
9. The proposed trail -head parking and associated curb cut is not be constructed and should
be removed from revised plans.
10. Trees are required to be planted every 30 linear feet along the right-of-way, where
existing canopy is not currently located. Mitigation trees shall not be planted in -lieu of
required landscape trees. Shrubs shall be located along all parking areas and drives, 50%
of which are required to be evergreen.
Standard conditions of approval:
11. Plat Review and Subdivision comments (to include written staff comments provided to
the applicant or his representative, and all comments from utility representatives: AR
Western Gas, SWBT, Ozarks, SWEPCO, Cox Communications).
12. All mechanical/utility equipment (roof and ground mounted) shall be screened using
materials that are compatible with and incorporated into the structure. A note shall be
clearly placed on the plat and all construction documents indicating this requirement.
13. Trash enclosures shall be screened with access not visible from the street. The trash
enclosures shall be constructed with materials that are complimentary to and compatible
with the proposed building. A detail of the proposed screening shall be submitted and
approved by the Planning Division prior to issuance of the building permit. Any
additional dumpsters located on site shall be screened from the right-of-way.
14. Staff approval of final detailed plans, specifications and calculations (where applicable)
for grading, drainage, water, sewer, fire protection, streets (public and private),
sidewalks, parking lot(s) and tree preservation. The information submitted for the plat
review process was reviewed for general concept only. All public improvements are
subject to additional review and approval. All improvements shall comply with City's
current requirements.
15. All existing utilities below 12kv shall be relocated underground. All proposed utilities
shall be located underground.
16. Large scale development shall be valid for one calendar year.
17. Prior to the issuance of a building pennit the following is required:
a. Grading and drainage permits
b. An on-site inspection by the Landscape Administrator of all tree protection

measures prior to any land disturbance.
c. Separate easement plat for this project that shall include the tree preservation area
and all utility easements.
d. Project Disk with all final revisions
e. One copy of final construction drawings showing landscape plans including tree
preservation measures submitted to the Landscape Administrator.
f. Completion of all required improvements or the placement of a surety with the
City (letter of credit, bond, escrow) as required by Section 158.01 "Guarantees in
Lieu of Installed Improvements" to guarantee all incomplete improvements.
Further, all improvements necessary to serve the site and protect public safety
must be completed, not just guaranteed, prior to the issuance of a Certificate of
Occupancy.

FINDINGS:
The desirability of preserving a tree or group of trees by reason of age, location, size or
species.
• This site is very narrow with a sanitary sewer easement down one side
and a gas easement down the other. Many trees are found on this site
but most are found within the right of way and gas easement along the
east property line.
The extent to which the area would be subject to environmental degradation due to
removal of the tree or group of trees.

• Staff is recommending approval of the submitted Tree Preservation
Plan with the following Conditions of Approval.
Conditions of Approval:
1. Identify on-site areas for delivery and storage of construction
materials, on-site parking, cement truck wash-out, and soil stockpiles.
2. Please revise the Tree Preservation Plan to have all canopy
calculations including total site SF, SF of canopy, SF of preserved
canopy and all corresponding percentages.
3. Please revise the mitigation calculations and Landscape plan to depict
11 mitigation trees.
4. Mitigation will be required in the amount of 11(2) inch capper large
species trees. The project is proposing on-site mitigation in
coordination with the construction of a trail head and parking lot on
the south end of the property.
5. A 3 -year maintenance and monitoring bond will be required in the
amount of $2750. This shall be deposited with the City of Fayetteville
in the form of a letter of credit, bond, or check before Final Certificate
of Occupancy.

TRAIL COMMENTS
4. As identified on the Fayetteville Alternative Transportation and Trails Master
Plan, A 10 to 12' wide multi -use trail is planned along the existing 25' sewer
easement along the west side of the property. The trail Nvill connect southwest
to Gulley Park and north to Mud Creek Trail. For increased safety, the trail
will cross Old Wire Road at the stop light and will have a pedestrian button.
5. The proposed deck on the fire station should be designed so it does not have
support columns in the way of the future trail. To insure safe passage for trail
users, the deck posts should be placed a minimum of i8' from the west
property line.
6. A trail head and parking lot is planned for the south portion of the property.
Parks staff has created a conceptual layout for the parking lot and this design
is attached for planning approval.
4. Please notify Trails Coordinator of any changes to the trail or trail head
parking lot

Submitted for your review are the Large Scale Development Plans for Fire Station Number 5
located upon the southwest corner of Crossover Road (Arkansas Hwy 265) and Old Wire Road.
This 1.56 acre parcel of land is currently known as Routh Park and is owned by the City of
Fayetteville, Arkansas.
Beirfg a parcel of land owned by the City of Fayetteville, both the Large Scale Development and
Conditional Use Applications have been forwarded to the office of the mayor for signature.
Further, we request that fees be waived for this development project.
Proposed is a 5,500 square foot fire station facility with associated parking, utilities, landscaping,
and greenspace. This land us currently within the 100 year floodplain and will require substantial
amounts of fill material to raise the finished floor elevation a minimum of two feet above the base
flood elevation. The City of Fayetteville Parks Department has expressed interest in developing a
portion of the future Multi -Use Trail System in this area - a potential layout of a future 'Trail Head'
has been illustrated upon the site plan.
We look forward to working with the City of Fayetteville to ensure the health, safety, and welfare
of its citizens with the development of both Fire Station #5 and the associated section of Multi -
Use Trail

McClelland Consulting Engineers, INC. is proud to present our civil site plans for the proposed
Fayetteville Fire Station Number 5. The proposed fire station is a stand alone, two story facility
(approx 5,500SF) that will face Crossover Avenue. The lot is currently zoned RSF-4 and is not
subject to the additional requirements of the Design Overlay District.
Currently, plans are being reviewed by the City of Fayetteville Planning and Engineering Staff.
The next scheduled meeting will be for the Subdivision Committee to be held on March 16th at
9:00 am and then to the full Planning Commission on January March 27th. If you have any
