BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS'
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby approves
the request by Washington Regional Medical Center to modify the location of the Tree
Preservation Areas on Lots 1, 4 and 7, and to modify the geographic extent of the Tree
Preservation Area on Lot 2, and the tract adjacent to Scull Creek, pursuant to § 167.04 (L) (2),
Tree Preservation and Protection, Unified Development Code, Code of Fayetteville, subject to
the following conditions:
1. Washington Regional Medical Center shall dedicate to the City of Fayetteville a Tree
Preservation Area and Scull Creek Trail Easement in excess of 40,000 square feet at or
before the development of the land on the Western bounds of Scull Creek, and giving
access to Futrall Drive. However, the Tree Preservation Area and Trail Easement to the
City of Fayetteville shall require a 50 -foot Access and Utility Easement to allow
Washington Regional to have unrestricted access to adjoin both properties on the West
bounds and East bounds of Skull Creek.
2. On-site mitigation shall be required to replace the 37,271 square feet of canopy lost,
while 246,422 square feet will be maintained. The Mitigation Plan shall require the
applicant to plant 86 (2) inch caliper large species trees located on-site in areas wjim.su,
their health and longevity can be guaranteed. ....................

RECOMMENDATION
The proposed Washington Regional expansion project requires the City Council to
consider the relocation of Tree Preservation Areas of Lots 1, 4, and 7; and the approval of
minor modifications to Tree Preservation Area of Lot 2 and the tract adjacent to Scull
Creek. The following conditions must be met:
1. On-site mitigation will be required to replace the 37,271 square feet of canopy
lost while 246,422 square feet will be maintained. Mitigation will require 86 (2)
inch caliper large species trees located on-site in areas where their health and
longevity can be guaranteed.
2. Washington Regional Medical Center shall dedicate to the City of Fayetteville a
Tree Preservation Area and Scull Creek Trail Easement in excess of 40,000
square feet when or before the land develops on the Western bounds of Scull
Creek also giving access to Futrall Drive. However, the Tree Preservation Area
and Trail Easement to the City of Fayetteville will require a 50 -foot Access and
Utility Easement to allow Washington Regional to have unrestricted access to
adjoin both properties on the West bounds and East bounds of Skull Creek.
BACKGROUND
Under the Tree Preservation and Protection Code Chapter 167 (L)(2) The geographic
extent and location of tree preservation areas, once recorded, may only be modified, or
abolished with the express approval of the City Council. Applicants requesting such
action shall bear the burden of proving to the City Council's satisfaction that such
modification or abolition is in the best interest of the City of Fayetteville. Such requests
shall be submitted to the Landscape Administrator, who shall ask the city clerk to place it
on the agenda of the next regularly scheduled City Council meeting.
The (LSD) Washington Regional Medical Center was approved in 2002 to preserve
158,393 square feet (6.98%) of canopy within protected Tree Preservation Areas. Since
this time approximately 125,300 square feet of additional canopy has been added with
City Council Meeting of March 21, 2006

numerous tree plantings around the entire 52 -acre site. Currently Washington Regional
Medical Center has 283,693 square feet of canopy and/or 12.51% on-site.
Expansion of the Washington Regional Medical Center is proposed. Two Large Scale
Developments have been submitted to the Planning Division for a Senior Center,
Emergency Room expansion, parking garage, and a new Administrative Services
Building. Washington Regional states the reason for the expansion of these areas is to
mitigate their Emergency Room from being closed eight percent (8%) of the time (29
days) throughout the year In addition, they need to improve access to Primary Care
Services for the elderly. Washington Regional's existing medical staff has to treat an
inordinately high percentage of Medicare patients, which decreases their ability to see
new patients. Finally, this expansion will allow Washington Regional to improve
delivery of vital ancillary services, thus improving quality, timeliness, and consistency of
food services and supplies for patients.
The relocation and modifications requested on behalf of Washington Regional Medical
Center will reduce the Tree Preservation Areas and canopy on-site to 244,329 square feet
(10.78%). This reduction will require on-site mitigation in the amount of 86 (2) inch
caliper large species trees to bring the overall percentage back to the original 12.51%.
These trees should be located in areas where their health and longevity can be assured.
The Tree Preservation Areas proposed for modification and relocation will allow
Washington Regional the ability to develop these sites while the City of Fayetteville will
gain a Tree Preservation Area and Scull Creek Trail Easement along a riparian buffer of
the Illionis River watershed
A full Staff Report is included and should be referred to for further detail.
DISCUSSION
City Council approval of modification of the Tree Preservation Easement found on Lot 2
and easement along Scull Creek is required. City Council approval of reloation of the
Tree Preservation Easement found on Lots 1, 4, and 7 is required.

STAFF REPORT
FINDINGS
- The Tree Preservation Area on Lot 1 (19,256 SQ ft) is found along the drainage
channel on the corner of Appleby and Northhills. Trees in this area are a
combination of oaks, bois d arc, and locust The area as a whole has a wide mix of
species including the ones mentioned with additional elms, hackberry, and hickory.
The proposed Large Scale Development for the Senior Center will require a portion
of the drainage to be piped and covered. Although Washington Regional is
requesting to relocate this entire easement, it is the intent to preserve as many of the
trees as possible dunng the construction process
- The Tree Preservation Area on Lot 4 (6,666 SQ ft) is also found along a drainage
channel The trees in this area are volunteer and less desirable species covered in
vines and underbrush The location of this Area, as it is currently recorded, inhibits
the flexibilty of design for any future projects.
- Tree Preservation Area ideated on Lot 7 (6,019 SQ ft) is between utility easements
along Appleby Road. The area contains only two significant trees that fall within the
easement area. Many trees are found in the vicinity of this easement but are either
under the size quailifications for significance or are found just outside the area in
question. This area has several hickory's, oaks, ash, and elm. This small tract is split
and surrounded by existing utility easements dedicated with the original Large Scale
Development approval in 2002. The proposed Administrative Services Building will
require relocation of public utilities found in these easements and the removal of tree
canopy for construction of the facility.
-The long Tract of Tree Preservation Area along Scull Creek will be modified slightly
to allow a 50 -foot Access and Utility. Easement between this and the adjoining
property. This will remove 4,768 square feet of canopy and split the existing Tree
Preservation Area into two separate Areas. •
-Modification of the Tree Preseravtion Area on Lot 2 is required for the construction
of a new parking lot This lot will be completed prior to the start of construction of
the other Large Scale Developments and will add additonal parking while the new
parking garage is completed. This modification will not remove any trees but will
allow the parlung lot to be constructed under the tree canopy. Approximately 562
square feet will be removed from the current 29,380
RECOMMENDATION
Staff recommends the relocation of Tree Preservation Areas of Lots 1, 4, and 7; and the
approval of minor modifications to Tree Preservation Area of Lot 2 and the tract
adjacent to Scull Creek. The following conditions must be met:
