A RESOLUTION APPROVING AMENDMENT #1 TO THE
CONTRACT WITH McG00DWIN, WILLIAMS & YATES,
INC. IN AN AMOUNT NOT TO EXCEED $11,000.00 FOR 24"
WATERLINE REPLACEMENT PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby approves
Amendment #1 to the contract with McGoodwin, Williams & Yates, Inc in an amount not to
exceed $11,000.00 for 24" Waterline Replacement Project. A copy of Amendment #1, marked
Exhibit "A" is attached hereto, and made a part hereof.

AMENDMENT NO. 1
TO
AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
BETWEEN
CITY OF FAYETTEVILLE, ARKANSAS
AND
McGOODWIN, WILLIAMS AND YATES, INC.
WHEREAS, on July 19, 2005, the City of Fayetteville, Arkansas (CITY OF FAYETTEVILLE) and
McGoodwin, Williams and Yates, Inc. of Fayetteville, Arkansas (MWY) entered into an Agreement for
engineering services in connection with the City of Fayetteville Water and Sewer Improvements; and in
particular, the 24 -Inch Water Main Replacement at Custer and Morningside (the "Project"): The scope of
these services included the final design and bidding services, and construction phase services, and
WHEREAS, MWY has proceeded with the design services in accordance with the original scope set forth
in the Agreement,.and
WHEREAS, CITY OF FAYETTEVILLE requests that the scope of MWY's services to be amended to
include additional lineal footage of water main replacement forthe Project;
NOW THEREFORE, in consideration of the mutual covenants and Agreements herein contained, CITY
OF FAYETTEVILLE and MWY, the parties hereto, stipulate and agree that the Agreement for
Engineering Services dated July 19, 2005, is hereby amended in the following particulars:
SECTION 6 — PAYMENTS TO MWY
6.1 Compensation
Delete Paragraph B of Section 6.1.1, and replace with the following:
B. Design and Preparation of Construction Plans and Specifications
For the Scope of Services during the Design Phase described herein for the design and
preparation of construction plans and specifications, CITY OP FAYETTEVILLE shall pay MWY
the lump sum amount of Thirty -Four Thousand Five Hundred United States Dollars (US
$34,500.00).
Delete Paragraph 6.1.3.1 and replace with the following:
6.1.3.1 For the Scope of Services during the Construction Phase described herein, CITY OF
FAYETTEVILLE shall pay MWY the sum not to exceed Forty -Two Thousand United States
. Dollars (US $42,000.00), unless amended in accordance with Paragraph 6.1:5.
APPENDIX A — SCOPE OF SERVICES
A.1 General Scope.
Add the following sentence at the end of Paragraph A.1:
"The scope also includes replacement of an additional 1,000 linear feet of existing 24 -inch water

line along Morningside Drive to mitigate conflicts with a new sewer line designed and
constructed by others."
A.4 Project Design Schedule
Delete Paragraph A.4 and replace with the following:

MWY shall begin work under this Agreement within ten (10) calendar days of a Notice to Proceed
(NTP) and shall complete design work in accordance with the schedule below:

Engineering Contract Amendment #1
Recommendation:
Staff recommends approval of a Resolution to execute Amendment #1 to the
Engineering Contract with McGoodwin, Williams, and Yates in the amount of $11,000
for the extra work requested by the City Staff for Design, Bidding, and Construction
Inspection of 24" Waterline Replacement Project.
Background:
This project was identified in the 2002-2006 Capital Improvement Program, and placed
in the unfunded category. It was the highest pnority unfunded project in the 2004 CIP. In
early 2004, the City of Fayetteville attempted to initiate the project, but funds that were
allocated had to be applied to mandatory A.H.T.D. widening projects that were first
identified in the same time frame.
The existing 24" waterline has experienced numerous leaks due to external corrosion.
The severity of the leaks has increased in the last two years. Prior to that time, the leaks
were relatively small, however recently larger leaks have significantly increased the risk
of property damage to the homes in the vicinity.
McGoodwin, Williams, and Yates, Inc. was selected for this project by an engineering
selection committee. The Council approved the design, bidding and construction
engineering for this project by approving Resolution 139-05

Discussion:
Design for the water line sections on Custer and Morningside/Lewis Lane are complete.
Six hundred feet north of the planned end of this replacement project, a section of the
24" water line has to be lowered in order to install the 42" gravity sewer line that is part
of the WSIP.
City Staff and the Engineer are evaluating extending the replacement to include this line
lowenng as part of the 24" water line project. The cost of the additional replacement
would be split between the WSIP and 24" water line projects. There are several
possible benefits:
(1) 24" main will only be shut down for one project rather than for two.
(2) Net cost will almost certainly be lower if the construction work is performed under
one contract rather than two.
(3) Additional pipe will be replaced in an area where we have experienced numerous
corrosion leaks
There was no contingency approved with the Engineering contract for designing the 2
line replacement, so adding this portion to the scope of work would require City Council
approval.
