RESOLUTION NO. 32-06
A RESOLUTION TO AMEND THE MASTER STREET PLAN BY
REALIGNING PERSIMMON STREET BETWEEN BROYLES
ROAD AND LEGACY POINT SUBDIVISION SOUTH OF THE
CURRENT ALIGNMENT AS DESCRIBED AND DEPICTED IN
THE ATTACHED MAP
WHEREAS, Collector Streets are intended to provide traffic circulation within residential
areas, collecting traffic to channel it into the arterial system, and should be indirect connections
between arterials to discourage use by traffic outside the neighborhood; and
WHEREAS, the existing alignment of Persimmon Street continues a long, uninterrupted,
direct street connection between arterials that encourages high speed and cut -through traffic from
outside the neighborhood; and
WHEREAS, the City Council finds that a realignment of Persimmon Street to the south as
indicated in the attached map maintains the integrity of the east -west Collector connection while
better protecting existing and future neighborhoods by creating a more indirectly aligned Collector
Street.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby amends the
Master Street Plan as indicated in Exhibit "A" attached hereto and made a part hereof.

RECOMMENDATION
The Fayetteville Street Committee and staff recommend approval of a resolution
amending the Master Street Plan to realign Persimmon Street (a Collector) south of its
current configuration. The Planning Commission voted unanimously to deny the original
proposal as presented, and the applicant has presented an alternative alignment to address
some of the raised concerns. This realignment maintains the integrity and purpose of the
Master Street Plan, allowing for the needed east -west and north -south future connections
in this area.
BACKGROUND
The applicant proposes to amend the Master Street Plan for Persimmon Street between
Legacy Pointe S/D Phase IV and Broyles Avenue in West Fayetteville. The primary
change lies within property currently owned by the City of Fayetteville, who has
contracted to sell to the applicant. Originally a part of the Wastewater Treatment Plant
site, approximately 35 acres of property was advertised to sell through the City Council.
The contract for purchase includes a contingency that states a Master Street Plan
amendment must be approved by the City Council in order for the sale to be finalized.
The reason this is requested is due to the current direct alignment of streets in the area
that connect major arterials and concerns voiced by neighbors and the applicant about
creating cut -through, high-speed traffic if Persimmon is continued in a long, straight
stretch (2.8 miles) from the Interstate to Double Springs Road.
Currently Persimmon Street west of Broyles Avenue continues in a direct line to 54th
Street. It is a gravel road that serves a few large, single family lots to the north. Should
the 35 acres to the south be developed, it is likely that a portion of this street would be
improved. The applicant proposes to relocate the Collector Street south of the intersection
of Broyles and Persimmon (see attached maps), dedicating the entire right-of-way within
the property, to allow for a full street section to be constructed at the time of
development. This option continues to provide the important east -west connection while
creating a more indirect •route, thereby discouraging high-speed traffic in this
predominantly residential area. The proposal also realigns Persimmon Street west of 54th

Pointe Phase V. This would alleviate an intersection issue of Persimmon, 54th and the
future Sunshine Road, which is a Principal Arterial. The existing Persimmon Street
would remain in place, for the most part, though some improvements to provide
continued access while discouraging cut through traffic will likely occur at the time of
development.
DISCUSSION
This item was heard at the Street Committee meeting of January 12, 2006, at which the
four members voted to forward this item to the City Council with a recommendation of
approval. The Planning Commission on January 23 voted unanimously against the
proposal, finding that it did not alleviate any problems in the area and created difficult
turning movements. In response to these comments, the applicant has presented a new
alternative, in which the intersection alignment is maintained, thereby not creating the
difficult tuming movements, but moving the rest of the street to the south. Staff is
supportive of this new configuration.

Persimmon Street is a Collector Street on the Master Street Plan. It is intended to connect from
Double Springs Road (in West Fayetteville) to Shiloh Drive, next to I-540. Rapid growth in this area
has transformed fence lines and disconnected gravel roads in the county to paved, curbed and
guttered 28 -foot wide streets with turning lanes and future traffic signals in a matter of a couple of
years. It is anticipated that Persimmon Street will become an important east -west connector once all
segments are constructed; presently all segments but the one under consideration now have been
constructed to city standards or approved to be constructed in conjunction with development plans.
Currently Persimmon Street west of Broyles Avenue continues in a straight line to 54'h Street. It is a
gravel road that serves a few large, single family lots to the north. Should the 35 acres to the south be
developed, it is likely that a portion of this street would be improved. The applicant proposes to
relocate the Collector Street south of the intersection of Broyles and Persimmon (see attached maps),
dedicating the entire right-of-way within the property, to allow for a full street section to be

Request: The request is to realign the planned Persimmon Street Collector to south of its current
location, as indicated in the attached maps.

Background: The Master Street Plan in its entirety was adopted in 1996, after several public
meetings to discuss future collector and arterial connections. The current location of Persimmon
Street as a Collector does not easily lend itself to a full expansion due to the existing homes on
the north side, and movement of the street to the south would help faciliate a more appropriate
connection that discourages high speed traffic on long, straight streets without short block
lengths. The Master Street Plan is intended as a guideline, adopted by ordinance, in order to give
the city routes of primary connections. It is also relied heavily upon by developers when planning
individual developments, for it serves as a key component to tieing different developments
together with a vehicular and pedestrian street network. In this case several developers,
landowners and neighborhood members have come together to work out a solution that hopefully
serves the community as a whole.
DISCUSSION
This item was heard at the Street Committee meeting of January 12, 2006, at which the four
members voted to forward this item to the City Council with a recommendation of approval.
RECOMMENDATION
The Fayetteville Street Committee recommends approval ofa resolution amending the Master Street
Plan to realign Persimmon Street between its currently placement in Legacy Point IV and Broyles
Avenue, a movement southward, as indicated in the attached maps. This realignment maintains the
integrity and purpose of the Master Street Plan, allowing for the needed east -west and north -south
future connections in this area, and providing a more realistic plan for development than where it is
currently located. The City Council must also review and approve this alignment, and will take both
staff's and the Planning Commission's comments as part of their review.

Please find fifteen copies of the revised Persimmon Street MSP Amendment and fifteen
copies of the original submittal of this plan that was presented to the Street Committee
and the Planning Commission. This plan has been revised to show the Persimmon/
Broyles Intersection aligned. This change was made after the reservations expressed by
the Street Committee about the offset intersection even with their approval and also the
concems by the Planning Commission. Other options were explored to cross the existing
creek and a more feasible option was found so the plan was revised. The length of
Persimmon Street without the offset will still likely pose a problem but hopefully the
added bends in the road shown by this plan will help to calm the traffic somewhat.
