That the City Council of the City of Fayetteville, Arkansas hereby approves a Memorandum of Agreement with Van Scoyoc Associates in the amount of $84,000.00 to provide lobbying services to the City of Fayetteville. The City of Fayetteville hereby retains Van Scoyoc Associates, Inc. (VSA) as consultants and advisors with regard to various legislative and administrative matters. Statement of Work. VSA will assist the City of Fayetteville and its personnel in the following areas: • • • Developing a program and , strategy towards obtaining federal appropriations and grants for Fayetteville's future economic viability. • Analyzing and informing the City of contemplated legislative and regulatory changes that may positively or negatively affect programs of interest to the City. • Educating Members of Congress and their staffs about Fayetteville concerns or opportunities with respect to legislation or regulations. • Building grassroots support of the projects to demonstrate local interest by finding individuals and groups with goals similar to those of the City. • Working with the relevant committees to secure enactment of the legislative agenda or otherwise advance the interests of the City. • Assisting in working with federal agencies and the federal administration to identify, create and secure new federal grant and funding opportunities. Lobby Disclosure Act. It is understood that VSA will be required to register on behalf of the City of Fayetteville under the terms of the Lobbying and Disclosure Act of 1995 (P.L. 104-65) and any subsequent laws or regulations. Term. In consideration of the performance of these services, the City of Fayetteville shall pay to VSA the sum of $7,000 per month for the period of February 1, 2006 through January 31, 2008 for a total of $168,000 in retainer expenses subject to appropriation by the Fayetteville City Council. The City of Fayetteville further agrees to pay all reasonable costs and expenses incurred by VSA in furtherance of its efforts on behalf of the City, including, but not limited to, copies, facsimiles, couriers, telephone, local transportation and meals directly attributable to those efforts. VSA agrees that these expenses, exclusive of out-of-town travel costs taken solely at the City's direction, shall not exceed $10,000 during the contract term. Notice. The City of Fayetteville shall have the right to terminate this contract after giving VSA 30 days advance written notice. Should the City exercise this option, it agrees to pay VSA all outstanding retainer and expense costs owed through the termination date. VAN SCOYOC ASSOCIATES $44 H. Background The City of Fayetteville entered into a one year renewable contract with Van Scoyoc and Associates in February 2004. The firm is a Washington D.C. based consulting firm that assists clients with securing federal funding including line -item earmarks and agency -based grants. Each year, the City develops a list of priority projects that qualify for federal support In 2005, Van Scoyoc helped the City develop seven proposals for FY 2006 funding totaling $22.15 million. Of those seven requests, the City secured $13.8 million which represents approximately $162,000 received for every $1,000 invested. The details of these awards are outlined in the attached document, Federal Funding 2006. Current Status This year we have developed a list of four projects for FY 2007 funding totaling $16.07 million (attached as FY 2007 Federal Requests Summary). Van Scoyoc will begin actively lobbying for these proposals in January 2006. They are also providing written progress reports, e-mail briefings on relevant budget and/or congressional committee activities, and a monthly conference call to provide funding status reports and to help us generate ideas for increasing our chances for securing federal dollars including earmarks and agency grants. Currently, the firm is also under contract with the University of Arkansas. Budget Impact The firm works on an annual retainer basis. Contracts are for one year, with a 90 day opt -out clause for both parties. The agreed upon contract price for 2006 and 2007 is $84,000 per year. The City may incur additional reimbursable expenses not to exceed $10,000 for the two-year contract term. RESOLUTION NO. The funding received for this multi -phased proposal will address the first priority which is I-540 (a north terminus) from mile post 68 to the end of Fulbright Expressway. (1.59 miles) $3.2 million University of Arkansas Technology Corridor Enhancement Project Request: $4.95 M Bill: Transportation Reauthorization Bill Agency/Acct: Federal -Aid Highway High priority Projects Summary: In an effort to address safety needs and the adverse impact of congestion in an area of heavy pedestnan traffic and to enhance access between the University Main Campus and the Arkansas Research and Technology Park, the University of Arkansas, with the support of the City of Fayetteville and the Arkansas Highway Transportation Department, requests $4.95 million for the Technology Corridor Enhancement Project in the Transportation Reauthorization Bill. • $1.1 million Arkansas Research & Technology Park Request: $1.1 M Bill: Commerce, Justice, State Appropriations Agency/Acct: SBA — Salaries & Expenses Summary: Catalyzing and sustaining a culture of innovation will require a robust research and development infrastructure that can provide technology -intensive companies • • access to leading edge research investigators and facilities. FY 2007 Federal Requests Fayetteville Expressway Economic Development Corridor Request: $8.87 M Bill: Transportation Reauthorization Agency/Acct: National Corridor and Planning and Border Infrastructure Programs Summary: The City of Fayetteville requests $16 8 million for further improvement of the Fayetteville Expressway Economic Development Corridor that includes the redesign of the College Avenue Corridor, U.S. Business 71 in four distinct segments: (1) Sixth Street to North; (2) North to Sycamore; (3) Sycamore to Rolling Hills; and (4) Rolling Hills to Zion.
