A RESOLUTION APPROVING A VARIANCE FROM THE MASTER
STREET PLAN SETBACK REQUIREMENTS TO ALLOW FOR THE
CONSTRUCTION OF AN ENTRANCE SIGN AT WALKER PARK.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas,
hereby approves a variance from § 161.18, Master Street Plan setback requirements,
of the Unified Development Code, to allow for the construction of an entrance sign
at Walker Park.

Subject: Variance request (ADM 05-1907) from the Master Street Plan setbacks
RECOMMENDATION
Planning staff and the Planning Commission recommend approval of the proposed
variance from Master Street Plan setbacks at Walker Park, to allow the proposed entry
sign to be constructed within the Master Street Plan right-of-way for 15th Street.
BACKGROUND
In an effort to create a landmark for south Fayetteville and Walker Park, Parks and
Recreation has designed an entrance sign that anchors the edge of the park as well as to
inform citizens and visitors of the recreational opportunities within. When completed, the
entry feature will include a native stone wall with park signage and a planting area. The
feature will spotlight a trailhead, and will compliment the newly resurfaced tennis and
basketball courts. The project was bid, resulting in Resolution 205-105 from the October
18th City Council. This resolution approved a contract with Midland Construction for
$64,026 with a 10% project contingency of $6,402.60 for a total project cost of
$70,428.60 to construct the new entry feature at the comer of Fifteenth Street and South
College Avenue.
Construction began in November, to include a rock wall with raised lettering, landscaped
berm and irrigation. In an effort to accommodate the wall and berm between the existing
trail south of the basketball court and sidewalk along Fifteenth Street, the wall was
planned outside of the existing right-of-way, south of the existing trail and basketball
courts. However, the Master Street Plan dictates a 55 feet from centerline right-of-way in
this location, as indicated on the attached drawing. Fifteenth Street is currently a four -
lane street along Walker Park. The Planning Division does not anticipate the addition of
lanes to this street in this location and a turning lane onto South College Avenue is also
not anticipated. On December 21s1, 2005, construction on the entry sign was halted until
the Master Street Plan issued is resolved. The request is for a variance from §161.18
Master Street Plan Setbacks to allow the entry signage in its intended location.

Property Description: The subject property Walker Park, a public park located at the
northwest corner of South College Avenue and Fifteenth Street. The sign proposal is
located at this corner, but within the Master Street Plan right-of-way for Fifteenth Street,
which is a Principal Arterial requiring 55 feet from centerline right-of-way setbacks.

Request: The request is for a variance from §166.18 Master Street Plan Setbacks, which
states:
166.18 Master Street Plan Setbacks
The city shall require the applicant/developer to establish a right-of-way setback
line based on the right-of-way requirements for streets and highways designated
by the Master Street Plan. Such setback line shall be considered the property line
for such purpose of satisfying the requirements of the UDO. All building
setbacks, required landscaping, parking lots, display areas, storage areas and other
improvements and uses shall be located outside of such established setback area.
The required width of setbacks, landscaped areas, buffers, and all other setback
requirements shall be dimensioned from the established right-of-way setback line.
The establishment of any new structure or other improvements within the
right-of-way setback is prohibited.
The Parks Department requests the ability to construct an entry sign approximately 13
feet within the Fifteenth Street Master Street Plan right-of-way as indicated in the
attached site plans. This sign is planned to improve this intersection and major entry to
the public park, and is not located within the existing right-of-way for Fifteenth Street,
which is a four -lane street in this area. The City Council must also approve this request,
as the proposal is for a structure within the Master Street Plan right-of-way.
Recommendation: Staff recommends approval of the variance request, finding the
application proposal is not injurious or otherwise detrimental to the public or surrounding
neighborhoods. The proposal will be a compatible and positive improvement to the area,
identifying the Walker Park area from Fifteenth Street for citizens and visitors. The four -
lane street section in this area transitions to a two-lane section east of the S. College
Avenue intersection, and there are no anticipated improvements to widen this street to a
five -lane section along the park. The parkland will not likely be developed for uses other
than those already in place, therefore traffic generation into the park will not necessitate
widening of Fifteenth in the foreseeable future.
