A RESOLUTION APPROVING ONE-YEAR AGREEMENTS WITH
THE ARKANSAS DEMOCRAT -GAZETTE - NORTHWEST
EDITION FOR DISPLAY AND LEGAL ADVERTISING.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby approves one-year Agreements with the Arkansas Democrat -Gazette -
Northwest Edition for display and legal advertising. Copies of the Agreements,
marked Exhibit "A" is attached hereto and made a part hereof.

We, in addition to the terms and conditions as hereinafter set forth,
agree to pay monthly, as used for such advertising on or before the
10th of the month following advertising, without discount. In the
event scheduled payments are not received, advertisements may be
withheld until past due balances are brought current.
If for any reason the minimum space contracted for should not be
used by us within the contract period, we agree to pay the
difference between the rate stated herein and the rate actually eamed
as per rates printed in the published rate cards.
We agree that the Arkansas Democrat -Gazette, IncJNorthwest
Arkansas Edition, shall have the right to revise the rates mentioned
herein upon thirty days notice of us, but if such revision of the rate is
not agreed to by us, either party shall have the right to terminate the
contract without penalty at the end of thirty days notice.

advertising, and its privileges cannot be transferred, in whole or in
part, to another party. It is further agreed that there are no terms or
agreements not set forth herein and that the rates and regulations or
conditions contained in•the published rate card are a part of this
contract as fully as if they appeared on its face.
This contact shall become effective on its acceptance by the
publisher, general manager, or director of marketing of the Arkansas

Recommendation: Staff recommends City Council approve contracts for legal and
display ads with Arkansas Democrat Gazette for the following public notifications:

Discussion:
The City's website has given the City the ability to provide quality public notification to
citizens, but ordinances, bond issues, bid advertisements, fob openings, etc. are required
by code to be published in the newspaper.
The City currently budgets over $100,000 for public notification. The contract price for
display advertising is $10.55/column inch. Without the contract it is $15.79/ column
inch. It results in a savings of $5.24/column inch. The contract price for classified or
legal ads has a tiered rate. The Monday through Thursday tier is $9.76/column inch with
the contract and $14.57/column without a contract. The City Clerk's office has spent
$39,822.12 to date for advertising. Their savings with the new contract pricing would be
approximately 32 percent or $12,743.08. I've attached some examples of ads that have
recently run to further demonstrate the significant savings.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:

Effective November 1st, the open display rate for the NWA Times will be $15.79.
The contract rate for the Times would be $10.55. This is also effective November
1st.
An example of the saving is listed below.
Ordinance 4930- Runs October 20th, is 344"
344x$15.33 (this is the current NWA Times rate) = $5273.52
344x$10.55=3629.20.

Ordinance 4931 ran October 13. This ad was 35.5"

RE: Publishing requirement for ordinances
A.C.A. §14-55-206 Publishing or posting requirements.
"(a)(1)(A) All bylaws or ordinances of a general
or permanent nature .. shall be published in some
newspaper published in the municipality."
According to the Masthead of the Northwest Arkansas Times: "The
Northwest Arkansas Times (USP 396-980) is published seven days a week,
daily and Sunday, by the Northwest Arkansas Times, 212 N. East Avenue,
Fayetteville, Arkansas 72701." (emphasis added)
According to the Masthead of The Morning News (Fayetteville
edition): "Published daily and Sunday by The Morning News, 2560North
Lowell Road, Springdale, AR 72764 and 313 S. Second Street, Rogers, AR
72756 "
I looked up the ordinary definition of "publish" in my office
dictionary. According to the American Heritage Dictionary (Second College
Edition) "publish" means: "1. To prepare and issue (printed material) for
public distribution or sale."
Taking both newspapers at their word (which appear to coincide with
the above definition of "publish"), only the Northwest Arkansas Tunes meets
the statutory requirement of being "published in the municipality." (The
Morning News may have the exclusive ordinance publication rights in.
Springdale and Rogers).

Voluntary display ads (agendas, etc.) are not bound by this statute.
Required publication of Planning Commission meetings and public hearing.
notices for rezoning ordinances (pnor to passage) must "be published in a'
newspaper of general circulation in the city." A.C.A. §14-56-416 (b)(3)(B)
and §14-56-422 (1)(B). The "general circulation in the city" language had
been used for publishing ordinances in §14-56-206 until 1993 when the
legislature adopted the more restrictive "published in the municipality"
language.
