RESOLUTION NO. 170-06
A RESOLUTION FOR ADM 06-2293 APPROVING
ENCROACHMENTS INTO THE CITY'S RIGHT-OF-WAY
FOR THE PURPOSE OF CONSTRUCTING FOUNDATION
ON THE NORTH SIDE OF THE LOFTS AT UNDERWOOD
PLAZA PROJECT INTO DICKSON STREET, AS
DESCRIBED AND DEPICTED IN THE ATTACHED
EXHIBIT.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby
approves encroachments into the City's right-of-way for the purpose of constructing a foundation
on the north side of the Lofts at Underwood Plaza project into Dickson Street, as requested by
West Dickson Development Company, LLC. Plans for the foundation are attached hereto
marked Exhibit "A," and made a part hereof.
Section 2: Placement of the basement shall be approved by the City.

RECOMMENDATION
Planning Staff recommends approval — in concept - of the submitted request allowing a maximum
I -foot below -grade encroachment into the City's right-of-way for the purpose of constructing a
foundation on the north side of the Lofts at Underwood Plaza project on Dickson Street in
downtown Fayetteville. Sufficient time for a full review by all appropriate divisions had not
occurred by the time of publication of this memo, however those reviews should be forthcoming
and all comments forwarded to the City Council in a timely manner.
BACKGROUND
The Lofts at Underwood Plaza project is located at 607 Dickson Street As part of the new mixed
use building being built at this site the applicant requests to extend a footing/foundation one foot
(1'0") from the building and into the 55' right-of-way and sidewalk along Dickson Street. This
encroachment would be at a depth of approximately 8 feet to 15 feet below the elevation of the
sidewalk. This encroachment is depicted in the attached exhibit.
During the construction planning for the Lofts at Underwood Plaza it was determined that the
foundation for the mixed use building would encroach into the Dickson Street right-of-way, due
to the design of the foundation. The existing sidewalk would be removed and replaced during
construction, with the foundation remaining under the sidewalk.
The applicant's desire is to locate this building in a line with the existing buildings along West
Dickson with the intent of defining the street edge, which staff supports and is encouraged in the
Downtown Master Plan and Downtown Zoning Code before the City Council. The applicant has
indicated that due to the poor soil conditions on this site a Mat Foundation is necessary, and the
footings/foundation will be required to extend beyond the wall, and therefore into the Dickson
Street right-of-way.

The Underwood Plaza project was approved by the Planning Commission through the LSD
process on March 27, 2006. Although our building has not moved on the site since this approval,
it has come to our attention that the Right of Way has been widened to 55' rather than the 50' we
had shown on our drawings and was stated in the staff report. Our building is located in line
with the existing buildings along West Dickson with the intent of defining the street edge. It is
also our understanding that this is the intent of the new downtown codes, in addition to the goals
of our firm. The existing sidewalk along Dickson Street will remain as it is, varying from 8'-6"
to 9'-6", along the building front. Although it is in some cases possible to have a pier and grade
beam foundation or a footing that is offset from the centerline of the wall, this is not an option in
the poor soil conditions found on this West Dickson site. To adequately support this building in
soft soil with a high clay content, we are using a Mat Foundation. The footings along Dickson
Street will range between 8' and 15' below the sidewalk, remaining at a constant depth as the
sidewalk grade changes and at that depth, will extend from 9" to 1'-0" into the 55' Right of Way.
At this depth, there would be little to no impact to the city infrastructure. We request permission
to &ild Underwood Plaza, located as it was approved, with the Northern most footings
extending 1'-0" into the new Right of Way.
