A RESOLUTION TO ADJUST THE WATER SERVICE
TERRITORIAL BOUNDARY BETWEEN FAYETTEVILLE
AND SPRINGDALE

WHEREAS, the areas shown on Exhibit A (map) are located in the City of Johnson, abut
tracts currently served by Springdale water and sewer mains, and are not near Fayetteville water
or sewer mains.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby transfers
from the Fayetteville Water Service Territory into the Springdale Water Service Territory the
lots shown on the attached maps/plats so that the newboundary between Springdale and
Fayetteville Water Service Territory shall be as shown on Exhibit A.

RECOMMENDATION
Fayetteville City Administration recommends approval of a resolution transferring approximately 14 acres
from Fayetteville's exclusive water service area to Springdale's exclusive water service area in the vicinity
of the Clear Creek Subdivision in Johnson.
BACKGROUND
On June 15, 1967, concurrent with the implementation of Beaver Water District's improvement project, the
cities of Bentonville, Fayetteville, Rogers and Springdale agreed upon exclusive water service areas. As a
part of this intermunicipal agreement, the cities retained the right to alter their exclusive water service areas
by mutual agreement. This service territory has been modified on several occasions. On July 30, 2002,
the Fayetteville City Council approved the Clear Creek development in Johnson be transferred to the
Springdale Water Utility.
DISCUSSION
The lots in this request are all immediately adjacent to existing Clear Creek Subdivision lots. The subject
properties in this request: (1) are in Johnson; (2) abutt tracts currently served by Springdale water/sewer;
and (3) are not near Fayetteville water/sewer facilities. Giving up rights to these lots does not impinge
upon Fayetteville's future ability to serve other customers in this area, as the following conditions still
apply: (1) This approval applies to these specific lots only, and does not imply approval for any other areas
to be transferred out of the Fayetteville water service territory; (2) Fayetteville retains all water service
rights to all lots east of Chris Hollow Road and south of Clear Creek with the exception of area number 5
on the attached map; (3) Fayetteville retains all water service rights to all lots west of Highway 112 and
south of Clear Creek.
From a water service standpoint, it is more logical for Springdale to provide service to these specific lots.
They would have the better ability to provide looped lines, shorter mains, and a better overall system layout
than Fayetteville.

TERRITORIAL BOUNDARY BETWEEN FAYETTEVILLE
AND SPRINGDALE
WHEREAS, the area shown on Exhibit A (map) are located in the City of
Johnson, abut tracts currently served by Springdale water and sewer mains, and are not
near Fayetteville water or sewer mains.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section I: That the City Council of the City of Fayetteville, Arkansas hereby
transfers from the Fayetteville Water Service Territory into the Springdale Water Service
Territory the lots shows on the attached maps/plats so that the new boundary between
Springdale and Fayetteville Water Service Territory shall be as shown on Exhibit A.
