A RESOLUTION SUPPORTING THE DEVELOPMENT OF THE
NORTHWEST ARKANSAS HOUSING COALITION TEN-YEAR
PLAN TO REDUCE HOMELESSNESS.
WHEREAS, the mission of the United States Interagency Council on
Homelessness is to develop and implement a comprehensive national approach to reduce
homelessness in the United States through interagency, intergovernmental and
intercommunity collaboration, and,
WHEREAS, the Interagency Council promotes:
■ the reduction of homelessness within ten years;
• prevention and intervention with results -oriented approaches;
• innovation driven by data and research, leading to performance-based outcomes;
• accessing mainstream resources to benefit homeless persons and families; and,
WHEREAS, the United States Conference of Mayors, National Association of
Counties, National League of Cities, National Governors Association, the United Way,
U. S. Chamber of Commerce, and the International Downtown Association have each
unanimously passed Resolutions endorsing community plans to reduce homelessness.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby
tasks the Planning and Program Development Director, in conjunction with the
Northwest Arkansas Housing Coalition Ten -Year Planning Committee, to coordinate a
public planning process to develop a Plan to Reduce Homelessness, and to periodically
report on the progress of said planning process to the City Council. Upon completion,
the Plan shall be submitted to the City Council of the City of Fayetteville for review and
approval.

Staff recommends approval of a resolution supporting the creation of the Northwest
Housing Coalition Ten -Year Plan to Reduce Homelessness in NWA
BACKGROUND
In 1993 then President Clinton directed the Interagency Council on the Homeless to
develop a Federal plan to address homelessness. The Continuum of Care comcept was
put forth, this concept combines prevention, outreach, assessment, emergency shelter,
and transitional and permanent housing with necessary services such as job training, child
care, substances abuse treatment, and mental health services. The Departmen of Health
and Urban Development's (HUD) implementation of the Continuum of Care is designed
to encourage localities to develop a coorinated, comprehensive, long-term approach to
homelessness. A coalition of agencies and community join to form a advacacy group and
forum for sharing ideas, identifing gaps, conducting community -wide planning and
implementation. The Northwest Arkansas Housing Coaliton (NWAHC) was formed to
gather organizations' resources for the purpose of addressing the increasing homeless
population in Northwest Arkansas. The Coalitions' mission is to "Creatre a seamless
system in Northwest Arkansas to stablilize the lives of homeless and near homeless
people, and to develop, with existing orgainizations, a continuum of services that
includes housing, physical and mental health, employment, education, transportation, and
other basic needs." During the past three years, NWAHC has applied for and distributed
$1.5 million dollars of HUD Continuum of Care funds to homeless service providers in
Northwest Arkansas.

DISCUSSION
The United States Interagency Council supports and encourages the development of local
10 -Year Plans to end chronic homelessness. Inspired by the President's call to action,
over 200 communities across the country, 49 states, and three territories have committed

to planning initiatives in the last two years. As a result, new people, ideas and resources
are beginning to emerge. The City of Fayetteville would join in the support of the
development of the Northwest Arkansas Housing Ten -Year Plan to Reduce
Homelessness.

RE• Plan to Reduce Homelessness in Northwest Arkansas
Dear Mayor Coody,
In 2001, President George W. Bush and his administration declared ending chronic
homelessness throughout the United States within ten years a top priority. The
President's initial step was to reactivate the United States Interagency Council on
Homelessness (USICH), which had been dormant for a number of years. Congress
established the USICH in 1987 with the passage of the Stewart B. McKinney Homeless
Assistance Act. The USICH coordinates the activities of eighteen Federal agencies that
are currently involved in assisting the homeless. Inresponse, numerous jurisdictions
throughout the Country have made steps towards the President's stated goal by creating
Plans to End Homelessness.
According to the USICH homelessness is a condition not unique to any one geographic
area but across the nation and increasingly so within Northwest Arkansas (NWA). The
homeless population consumes a large amount of costly resources, is in great need of
special assistance and special services, and is a finite problem that can be solved. The
NorthWest Arkansas Housing Coalition (NWAHC) is taking the first steps' to create a
Plan to Reduce Homelessness in NWA.
In NWA, like many regions around the country, homelessness continues to be a
significant social problem that is not going away. Homelessness is first and foremost the
result of a housing market crisis. Most notably, the supply of affordable housing for low
income families fails to match the demand. Additionally, wages and benefits for the
working poor fail to keep pace with the cost of housing and other critical services. Thus,
even in the midst of a booming NWA economy, the lowest income groups lose ground.
Most homeless programs do a good job of helping the region manage the homeless
problem but not solve it. Due to a dramatic population surge, lack of public
transportation, and the lack of affordable housing, NWA is particularly vulnerable to
experience both short and long-term ramifications to its homeless population.
At the time of the January 2006 NWAHC Homeless Survey over half of the homeless
population in NWA were staying in emergency shelters or on the streets; the survey
indicated their average length of being homeless is two years This does not characterize
a population that is having their needs met or shrinking in size—yet over 60% are
working in full or part-time jobs and over half of the sampled homeless have a high
school education or more. While divorce, substance abuse, and mental and physical
health continue to be primary circumstances behind homelessness, the inability to pay
rent leading to eviction, and affordable housing continue to be important factors
contributing to homelessness.

Plan. It is the hopes of the Planning Committee that you will embrace the Plan and
approve a Resolution endorsing it by your respective Jurisdiction's Council.

The CH was created to gather organizations' resources for the purpose of addressing an increasing
homeless population in NWA. The Coalitions' mission is to "Create a seamless system in Northwest
Arkansas to stabilize the lives of homeless and near homeless people, and to develop, with existing

RECOMMENDATION
Staff recommends approval of contract with J -Quad for the Homeless Needs
Assessment.
BACKGROUND
The City of Fayetteville in support of the development of the Northwest Arkansas
Housing Coalition ten-year plan to reduce homelessness will contract with J -Quad for the
Homeless Needs Assessment. Reference Resolution Number 157-06.
DISCUSSION
The Homeless Needs Assessment will provide accurate data on the current environment.
BUDGET IMPACT
CDBG funds would be used for this project. The consultant would be paid the amount
of $18,400.00 to complete this project.

J -QUAD CONSULTING AGREEMENT
This Agreement is made effective as of January 22, 2007 by and between The City of
Fayetteville, Arkansas, 113 W. Mountain Street, Fayetteville, Arkansas 72701, and J -
QUAD & ASSOCIATES, P.O. Box 803288, Dallas, Texas 75380.
In this Agreement, the party who is contracting to receive services shall be referred to as
"City Of Fayetteville" or "The City"and the party who will be providing the services shall
be referred to as "J -QUAD"
J -QUAD shall serve as consultant planners for purposes of developing the City of
Fayetteville, Arkansas's Homeless Needs Assessment in accordance with U.S.
Department of HUD regulations.
J -QUAD has a background, experience and expertise in Consolidated Plans, Fair
Housing, Affordable Housing, Neighborhood and Revitalization Planning, Zoning and
Development, Homeless Assessments, Development Feasibility Studies, and is willing to
provide such services to the City based upon this background, experience and expertise.
The City desires to have said services provided by J -QUAD.
Therefore, the parties agree as follows:
1. DESCRIPTION OF SERVICES. Beginning on January 22, 2007, or upon
execution of this Agreement, J -QUAD will provide the following services (collectively the
"Services"): as outlined in Attachment One: Scope of Work.
2. TERM FOR AGREEMENT. The term of this agreement shall be for a period of
four months from the execution of this Agreement.
3. PAYMENT. The City of Fayetteville will pay a firm fixed price fee to J -QUAD in
the amount of $18,400 for services provided under this contract. This fee will be billed by
J -QUAD at the hourly rates specified in Attachment One for actual hours worked. This
fee will be invoiced monthly for itemized services rendered and performed in accordance
with this Agreement. Payments shall be payable within 30 days of receipt of an itemized
invoice from J -QUAD by the City. Upon termination of this Agreement, payments under
this paragraph shall cease; provided, however, that J -QUAD shall be entitled to payments
for periods, or pro rata payment for partial periods, that occurred prior to the date of
termination and for which J -QUAD has not been paid and during which period services
were rendered in accordance with this Agreement.
4. TERMINATION. This Agreement shall automatically terminate upon completion
by J -QUAD of the Services required by this Agreement or six months following the
commencement of this agreement. Either party may terminate this Agreement at any

time, with or without cause, by giving the other party 30 days written notice as prescribed
in Section 6 of this Agreement.
5. RELATIONSHIP OF PARTIES. It is understood and agreed by the parties that J -
QUAD is an independent contractor with respect to the City, and not an employee of the
City of Fayetteville. The City will not provide fringe benefits, including health insurance
benefits, paid vacation, or any other employee benefit, for the benefit of J -QUAD. J -
QUAD shall act solely as independent contractors in performing the Services referenced
herein and shall have no right or authority to act for the City and will not enter into any
contract or other agreement, or incur any debt, liability or obligation of any nature in the
name of, or on behalf of, the City of Fayetteville.
6. NOTICES. All notices required or permitted under this Agreement shall be in
writing and shall be deemed delivered when delivered in person or deposited in the
United States mail, postage prepaid, addressed as follows:

Such address or contact person may be changed from time to time by either party by
providing written notice to the other in the manner set forth above.
7. ENTIRE AGREEMENT. This Agreement contains the entire agreement of the
parties and there are no other promises or conditions in any other agreement whether oral
or written. This Agreement supersedes any prior written or oral agreements between the
parties.
8. AMENDMENT. This Agreement may be modified or amended if the amendment
is made in writing and is signed by both parties.
9. SEVERABILITY. If any provision of this Agreement shall be held to be invalid
or unenforceable for any reason, by a court of competent jurisdiction, the remaining
provisions shall continue to be valid and enforceable. If such a court finds that any
provision of this Agreement is invalid or unenforceable, but that by limiting such
provision it would become valid and enforceable, then such provision shall be deemed to
be written, construed, and enforced as so limited.
10. WAIVER OF CONTRACTUAL RIGHT. The failure of either party to enforce
any provision of this Agreement shall not be construed as a waiver or limitation of that
party's right to subsequently enforce and compel strict compliance with every provision of
this Agreement.
11. APPLICABLE LAW/VENUE This Agreement shall be governed by the laws of
the State of Arkansas.
ADDITIONAL PROVISIONS
12. ACCESS TO RECORDS. The local government, HUD, the Comptroller General
of the United States, and any of their duly authorized representatives, shall have access to
any books, documents, papers and records of the Consultant which are directly pertinent
to this contract for the purpose of making audit, examination, excerpts, and transcriptions.
It is expressly understood that upon receipt of substantial evidence of the Consultant's
refusal to comply with this provision, the City of Fayetteville will have the right to
terminate this contract without prior notice.
13. RETENTION OF RECORDS. The Consultant shall retain all records relating to
this contract for five years after the City of Fayetteville makes final payment and all other
pending matters are closed.
14. FEDERAL STATUTORY REQUIREMENTS. When applicable, the Consultant
and the City of Fayetteville shall comply with the provisions of applicable Federal Law.
15. ATTACHMENT ONE — SCOPE OF WORK AND BUDGET
This Consultant Agreement has been duly executed on this 22 day of January 2007.

J-QUAD's proposed cost to provide the: Homeless Needs Assessment is $18,400. This
quote is based on 260 hours (as detailed below) at $65 per hour, plus $1,500 projected
travel expenses, reimbursable on an as incurred basis. The quote includes printing costs
for any and all reports submitted to the City of Fayetteville, but does not include bulk
printing costs of the Directory of Service Providers for bulk distribution.
