HomeMy WebLinkAbout145-06 RESOLUTIONRESOLUTION NO. 145-06 A RESOLUTION FOR ADM 06-2228 APPROVING ENCROACHMENTS INTO THE CITY'S RIGHT-OF- WAY FOR THE PURPOSE OF CONSTRUCTING A BASEMENT ON THE SOUTH SIDE OF THE EAST SQUARE DEVELOPMENT PROJECT INTO MOUNTAIN STREET, AS DESCRIBED AND DEPICTED IN THE ATTACHED EXHIBIT • NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS' Section 1. That the City Council of the City of Fayetteville, Arkansas hereby approves encroachments into the City's right-of-way for the purpose of constructing a basement on the south, of the East Square Development project into Mountain Street, as requested by East Square Development, LLC. Plans for the basement are attached hereto marked Exhibit "A," and made a part hereof. Section 2. Placement of the basement shall be approved by the City. Pate, Director of Current Planning d'` Date: August 18, 2006 Subject: Basement Encroachment on East Square Development (ADM 06-2228) RECOMMENDATION Planning Staff recommends approval of a resolution allowing encroachments into the City's right-of-way for the purpose of constructing a basement on the south side of the East Square Development project on Mountain Street in downtown Fayetteville. BACKGROUND The East Square Development project is located on College Avenue between Mountain and Center Streets just east of the square in downtown Fayetteville, and is the site of the old Mountain Inn that has been demolished in the past year. As part of the new Renaissance Hotel being built at this site, the applicant would like extend a basement ten feet from the hotel under the sidewalk along Mountain Street. During the construction planning for the Renaissance Hotel it was determined that a laundry facility was needed in the basement. Access to the basement for laundry equipment installation/replacement is required through an areaway which will allow oversized equipment that does not fit in elevators or stairways. This areaway would be built below the sidewalk on Mountain Street as shown on the attached drawings. The areaway would be uninhabited space exclusively for equipment access and would be open to the basement of the hotel. This areaway would be capped by a 5" thick pre cast panel with an architectural finish to match the adjacent sidewalk. When it becomes necessary to replace laundry equipment, the sidewalk panels will be lifted out by embedded flush hardware. The pre cast panels will be flush with the sidewalk and will not impede pedestrian traffic. Because of the tight site limitations in this urban area the only space forthis access is on the south side of the hotel as proposed. The areaway will encroach approximately ten feet into the existing right-of-way for Mountain Street. The approved parking garage to the west has an approximately 50% greater encroachment into Mountain Street. Because the requested encroachment is fully below grade no visible changes from the street would occur. BUDGET IMPACT None. RESOLUTION NO. We gained approval at that time for the parking structure to be located with an encroachment into the right of way on Mountain Street. In the further development of the planning for the Renaissance Hotel tower it has beenfound necessary to locate the laundry facility in the basement of the tower. Access to the basement for laundry equipment installation/replacement is required through an areaway which will allow oversized equipment which does not fit in elevators or stairways. In an attempt to plan for the long life of the building, we are requesting permission to build an areaway below the sidewalk on Mountain Street as shown on detail 1/A2. The areaway will be an uninhabited space — exclusively for equipment access - open to the basement of' the hotel and will be capped by a 5" thick pre cast panel with an architectural finish to match the adjacent sidewalk. When it becomes necessary to replace laundry equipment, the sidewalk panels will be lifted out by embedded flush hardware. The pre cast panels will be flush with the sidewalk and will not impede pedestrian traffic. Because of the tight site limitations the only space for this access is on the south side as proposed. The areaway will encroach approximately ten feet into the existing ROW on Mountain St. The approved parking garage to the west has an approximately .50% greater encroachment into Mountain St. Because it is fully below grade no visible changes from the street are proposed.
