A RESOLUTION TO APPROVE A TRADE AND PURCHASE OF
LAND, A BUDGET ADJUSTMENT OF $105,500.00 AND THE
BANKING OF 2.64 ACRES FOR FUTURE PARK LAND
DEDICATION REQUIREMENTS
WHEREAS, the City of Fayetteville owns a swath of property totaling .75 acres along the
north side of Joyce Boulevard in Johnson, Arkansas that was acquired for the Joyce Street extension,
but is excess now and not needed for corporate purposes; and
WHEREAS, Tracy Hoskins owns a 7.39 acre parcel along Scull Creek that would be useful
to the city for the connection of the Scull Creek Trail and for park purposes; and
WHEREAS, Tracy Hoskins owns parcels of land on the north side of the excess City of
Fayetteville property along Joyce Boulevard and desires to trade portions of his property along Scull
Creel(for this excess City property and then sell or bank the remainder of the 7.39 acres as parkland.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby agrees to trade
the 75 acres of excess City Property along the north side of Joyce Boulevard (shown on Exhibit A)
for 2.25 acres out of the 7.39 acre parcel owned by Mr. Tracy Hoskins along Scull Creek (shown on
exhibit B).

Section 2: That the City Council of the City of Fayetteville, Arkansas hereby agrees to
purchase 2.5 acres of the 7 39 acre parcel owned by Mr. Hoskins for $40,000.00 per acre, plus
closing costs for a total of about $105,500.00, and agrees to the budget adjustment in the amount of
$105,500.00 attached as Exhibit C.
Section 3: That the City Council of the City of Fayetteville, Arkansas hereby accepts the
banking of the remaining 2.64 acres of the 7.39 acre parcel as park land for Tracy Hoskins'
subsequent residential development obligation within this park quadrant pursuant to U.D.C. § 166.03
(K)(1)(i)•

Re: Scull Creek Trail / Hoskins Agreement
After learning of the unease of some Council members concerning the median break and
questions about the park value of the 2.5 acres of the total 7.39 acres that the City was to
receive in the trade for Scull Creek Trail corridor and green space, the developer has
requested that this item be tabled indefinitely.
Staff will continue to work with this developer and Council to hopefully reach an
agreement.

RECOMMENDATION
Approval of the trade of .75 acres of City of Fayetteville owned property north of Joyce
Blvd. at a rate of 3:1 for 2.25 acres of property owned by Mr. Tracy Hoskins located
north of Shiloh Drive along Scull Creek. In addition, approval of the purchase of an
additional 2 5 acres of the same parcel owned by Mr. Hoskins at $40,000/acre (the
current Parks & Recreation Division cost per acre for money in lieu) plus closing costs
and approval for Mr. Hoskins to bank the remaining 2.64 acres for future parkland
dedication requirements resulting in the acquisition the 7.39 acre parcel to become park
land and trail corridor for Scull Creek Trail.
BACKGROUND
The City of Fayetteville owns four parcels of land which were acquired for the
construction of Joyce Blvd east of Gregg Ave. The city has no use for this property as it
is narrow and unbuildable. The only value of the property is to the adjoining property to
the north. Mr. Hoskins is purchasing the adjacent property to the north and desires to
acquire this property. In order to accommodate the design of the project and utility
locations, Mr. Hoskins may acquire the two remaining tracts to the west. If these tracts
are acquired, Mr. Hoskins would like to reserve the right to trade for the .48 acre remnant
of city property shown on the attached map as tract Z Mr. Hoskins also is requesting a
median break as shown on the attached map.
Mr. Hoskins owns property 7.39 acres adjacent to Scull Creek north of Shiloh,
immediately north of the section of Scull Creek Trail recently paved on the Washington
Regional Medical Center property. Scull Creek Trail is identified on the Fayetteville
Alternative Transportation and Trails Master Plan and is currently the highest priority
trail for the City of Fayetteville. A 0.6 mile section is under construction from the South
side of Fulbright Expressway under Appleby Street and south to Gordon Long Park. In
the future, this 12' wide multi -use trail will continue south along Scull Creek to the
Walton Arts Center parking lot where it will connect to the recently completed section of
Frisco Trail. To the north, Scull Creek Trail will pass under Fulbright Expressway
through an existing box culvert and continue north along Scull Creek to connect to the
existing Mud Creek Trail at Steel Boulevard In order to make this connection, access

must be obtained from Mr. Hoskins. In an effort to acquire this important corridor, staff
proposed a combination land trade, land acquisition and banking of park land. After a
series of discussions, this proposal is acceptable to Mr. Hoskins.
DISCUSSION
Access through Mr. Hoskins' property for Scull Creek Trail is essential to completing the
connection from existing Mud Creek Trail south to the first section of Scull Creek Trail
currently under construction. The 1.23 acres of land along Joyce Boulevard was left over
from the process of acquiring land for extending Joyce Blvd. to Gregg St. and has no use
for the City of Fayetteville or its citizens. The trade of this unneeded land along Joyce
Blvd. will provide a much needed trail corridor and adjacent green space for recreation
and alternative transportation. This proposal is consistent with the ideas from the City
Plan 2025 of providing enduring green networks within the City of Fayetteville. In
addition to insuring land for Scull Creek Trail, this proposal will also provide needed
park land for the residents of the surrounding area. Currently there are no parks within 1/2
mile of this property. Additionally this land will provide space for trail parking and trail
head amenities including informational kiosks, picnic tables, and benches.
Of the five remnant parcels left over from the construction of Joyce Blvd., the City of
Fayetteville owns four totaling 1.23 acres and one is privately held. This privately owned
parcel isolates the one remaining .48 acre city owned parcel at the corner of Joyce Blvd.
and Gregg Ave. Mr. Hoskins would like to trade for the three contiguous tracts totaling
.75 acres and obtain an option to trade from his banked parkland for the .48 acre tract
nearest to Gregg. at the same 3:1 ratio.

For reference, if Mr. Hoskins were interested, which he has indicated he is not, the City
of Fayetteville could purchase approximately 2.08 acres of the 7.39 acre parcel from Mr.
Hoskins for parkland and trail corridor for Scull Creek Trail. The price for the land
would be based on the current park land dedication cost per acre of $40,000 per acre.
With this scenario, no additional parkland would be obtained.

Section 3: That the City Council of the City of Fayetteville, Arkansas hereby
accepts the banking of the remaining .81 acres of the 7.39 acre parcel as parkland for
Tracy Hoskins' subsequent residential development obligation within this park quadrant
pursuant to U.D.C. §166.03 (K)(1)(i).
Section 4: That the City Council of the City of Fayetteville, Arkansas hereby
agrees to allow a median break along Joyce Avenue to access Tracy Hoskins' property
north of Joyce Boulevard at a location and design acceptable to the Engineering Division.

Approval of the trade of 1.36 acres of City of Fayetteville owned property north of Joyce
Blvd. at a rate of 3:1 for 4.08 acres of property owned by Mr. Tracy Hoskins located
north of Shiloh Drive along Scull Creek. In addition, approval of the purchase of an
additional 2.5 acres of the same parcel owned by Mr. Hoskins at $40,000/acre (the
current Parks & Recreation Division cost per acre for money in lieu) plus closing costs,
approval for Mr. Hoskins to bank the remaining .81 acres for future parkland dedication
requirements and the granting of a median break along Joyce Blvd. at a location and
design that is acceptable to the engineering division resulting in the acquisition of a 7.39
acre parcel to become park land and trail corridor for Scull Creek Trail. The final
acreage of land for the trade will be based on a boundary survey of the property north of
Joyce Blvd.

Mr. Hoskins also is requesting a median break as shown on the attached map. This
median break has been reviewed by the City of Fayetteville engineering division and is
acceptable as long as the developer's engineer provides site distance calculations
showing that the location will meet the sight distance requirements.

The land does have a blanket utility and drainage easement on the entire 7.39 acres. This
easement does not preclude the possibility of development of the site as it can be
modified through a process of vacation. In addition to this utility and drainage easement,
the City of Fayetteville has a 25' wide water/sewer easement traversing the site from
north to south and SWEPCO has an overhead power line easement along the south
property line.

Re: Hoskins Agreement on Joyce
After reviewing the request made by Mr. Hoskins, the proposed median curb cut is acceptable
based on the following condition. It will be the responsibility of the developer's engineer to
provide sight distance calculations showing that the location would meet the required sight
