RESOLUTION NO. 129-06
A RESOLUTION FOR ADM 06-2178 APPROVING
ENCROACHMENTS INTO THE CITY'S RIGHT-OF-
WAY FOR THE PURPOSE OF CONSTRUCTING
ENTRANCE AND DINING CANOPIES ON THE
SOUTH AND WEST SIDES OF 112 WEST CENTER
STREET, AS DESCRIBED AND DEPICTED IN THE
ATTACHED EXHIBIT
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby
approves encroachments into the City's right-of-way for the purpose of constructing canopies
on the south and west sides of 112 West Center Street, as requested by the Group Group, Inc.
Plans for the canopies are attached hereto marked Exhibit "A," and made a part hereof.
Section 2. Placement of the canopies shall be approved by the City.
Section 3 In consideration of the encroachment into public right-of-way, the Growth
Group, Inc shall: (a) replace the sidewalk along the Center Street side of the building; (b)
add a brick band maintaining the details of the DDEP Improvements adjacent to the curb; (c)
reduce the curb height from 12" to 6" and appropriate transition be made subject to
Engineering Division approval; and (d) plant three street trees in structured soil (or similar)
and protective tree grates along the 9' sidewalk in front of the building along Center Street,
the species and location of which to be approved by with the City's Urban Forester.

Subject: Canopy Encroachment on EJ Ball Building (ADM 06-2178)
RECOMMENDATION
Planning Staff recommends approval of a resolution allowing encroachments into the City's
right-of-way for the purpose of constructing canopies on the south and west sides of the EJ Ball
Building at 112 West Center Street in downtown Fayetteville.
In consideration for this intrusion into the right-of-way of Center Street and the public alley on
the west side of the EJ Ball Building, staff recommends that: (1) the deteriorated sidewalk on the
Center Street side of the building be replaced; (2) a brick band matching the details of the DDEP
Improvements be added adjacent to the curb; (3) the problematic curb height be reduced from 12"
to 6" and appropriate transition be made subject to Engineering Division approval; and (4) three
street trees be planted in structured soil (or similar) and protective tree grates along the 9'
sidewalk in front of the building along Center Street, the species and location of which to be
approved by the City's Urban Forester.
BACKGROUND
The EJ Ball Building is located at 112 West Center Street on the square in downtown
Fayetteville. The applicant would like to renovate this building. The ground and first floor
would be extensively remodeled on the interior as well as the exterior. Additionally, the exterior
glass will be replaced, the exterior masonry will be cleaned, and a new covered terrace along with
a glass roofed entrance canopy is proposed on the south side of the building. Staff finds that the
terrace and canopy will provide a previously lacking human and pedestrian scale to the structure,
and will be an improvement to downtown. The canopies for this renovation will need to encroach
into the City's right-of-way on Center Street and the public alley along the south side of the
building. A site plan, cross-sections, and architectural renderings depicting these encroachments
and the proposed renovation are attached.
The request is to allow encroachment into the City's right-of-way in the amount of 9' at a height
of approximately 17' above the sidewalk for the entrance canopy on Center Street, a 3' dining
canopy on Center Street at a height of approximately 13' above the sidewalk, and a 3' dining
canopy on the alley adjacent to the west side of the EJ Ball Building at a height of approximately
17' above the alley.

Subject: Growth Group Building Renovation
To Whom It May Concern:
Group
Please allow us to introduce ourselves to you. We are Growth Group, and we are the developer
of the currently named EJ Ball Plaza, located at 112 W. Center St. in downtown Fayetteville. We
are in the process of renovating the building for Growth Group Building, LLC, an entity which
purchased the building in February 2006. Located on the historic downtown square in
Fayetteville, Arkansas, the Growth Group Building contains approximately 54,000 square feet of
mixed use space spread across seven elevations.
Since the building is in a place where many see and utilize its features, the renovations are very
important. We are in the design stage and soon to be construction phase of putting the building
through major renovations. The ground floor and first floor will be extensively remodeled on the
interior as well as the exterior. Additionally; the exterior glass will be replaced, the exterior
masonry will be cleaned, and a new covered terrace along with a glass roofed entrance canopy
will be added on the south side of the building. This terrace and canopy will provide a previously
lacking human scale to the structure.
To gain the benefits of these additions, the work will need to encroach some of the City
thoroughfares; specifically, the 9'-0" entrance canopy encroachment at Center Street, the 3'-0"
dining canopy encroachment at Center Street, and the 3'-0" dining canopy encroachment at the
alley to the west of the building, perpendicular to Center Street. We are requesting permission to
encroach into this air space. In consideration for this intrusion into the city's airspace, we would
offer to replace the deteriorated sidewalk on the Center Street side of the building, add the brick
band adjacent to the curb, and reduce the problematic curb height from 12" to 6".
We are excited about this project and what it will add to the ongoing renovation of the downtown
area. This project and its features will add immensely to the future continued utilization of the
building, and hopefully will serve for many years to come. Thank you for your consideration in
this matter.
