The owner is Reserve, LLC. and Jorgensen and Associates is the engineer. Phase one of the development contains 117 single family units. The requirement for park land is 2.81 acres and money in lieu is $64,935. The Boys and Girls Club and Dale Clark park are located within a half mile service area of this development, however given the number of units that will be added in all of the phases, park land is recommended. Updates to the Park Land Dedication Ordinance was approved by Council on May 2nd 2006 and have been in effect since June 2, 2006; however, the Mountain Ranch development was presented to Parks and Recreation Advisory Board in 2004 under the previous ordinance which requires a resolution by City Council to allow the project to dedicate anything other that land for their Park Land Dedication requirements. The previous Park Land Dedication Ordinance states if a major development is over 40 acres or 100 units, the requirement is land. •..However, if the Parks and Recreation Advisory Board determines that a neighborhood park is not feasible or advisable, it may recommend to the City Council that a cash contribution pursuant to our ordinance be accepted in lieu of land dedication. The City Council will either accept the recommendation for a cash contribution or return the subdivision plat to the Parks Board with instructions or further study. • (Unified Development Ordinance No. 166.03K) The development was presented to the Parks and Recreation Advisory Board on November 8th, 2004. DISCUSSION Parks and Recreation Advisory Board made a recommendation to accept land for the dedication requirements with the final location to be determined by Park Staff after full development. It was determined that park land in a subsequent phase would best fit the needs of the development, making a Resolution by the Council necessary for this phase. The park land dedication requirements for Mountain Ranch Phase One and Phase Two will be met with the construction of Phase Two of the development. Phase two will include a land dedication of approximately 0.78 acres for trail corridor along Shiloh Drive as shown in the Fayetteville Alternative Transportation and Trails Master Plan. Additionally, the developer will construct the trail. Cost for the construction will be credited towards the park land dedication requirements for phases one and two which is approximately $63,547. Park Land Dedication requirements for the development should be met as recommended by Parks and Recreation Advisory Board regardless of the ownership of the property. RECOMMENDATION The Parks and Recreation Staff and PRAB recommend the dedication of land and money in lieu in the for the Park Land Dedication requirement of Mountain Ranch Phase One. A B PASSED and APPROVED this 6th day of July, 2006 PROVE QNDRA/SMIT,ri' J€iClerk Y, Mayor PARKS AND RECREATION ADVISORY BOARD Meeting Minutes November 8, 2004 Opening: The regular meeting of the Parks and Recreation Advisory Board was called to order at 5:34 p m. on November 8, 2004 in Room 326 of the City Administration Building located at 113 West Mountain Street, Fayetteville, Arkansas by Chairman Colwell. • Present: - Parks and Recreation Advisory Board members Colwell, Eads, Hill, Mauritson, Bailey, Marley, Shoulders, and Pawlik Holmes; City staff Wright, Jumper, Gipson, Weber, Hatfield, Edmonston, and Audience. 1. Park Land Dedication: Alison Jumper, Park Planner Development Name. Mountain Ranch Engineer: Crafton Tull and Associates Owner: Tom Terminella Location: South of Hwy. 16, West of I-540, near the intersection of what will be Rupple Road and Persimmon. Park District: SW Units• 233 Single Family Total Acres: 115.31 Land Dedication Requirement: 5.59 acres Money in Lieu Requirement: $129,315 Existing Parks: Dale D. Clark Park (8 acres); Boys & Girls Club Developer's Request: Land dedication of approximately 5.6 acres. Staff Recommendation: Land dedication of approximately 5.6 acres; the pond shall be filled and made usable as flat land, street frontage and visibility shall be provided when the second phase is developed. All costs associated with removal of the pond and returning the land into a dry condition shall be the responsibility of the developer. Justification: Due to the number of homes that will be built in this area, a neighborhood park would be appropriate. Jumper reviewed the map of the proposed park land, developer's request, and staff recommendation. During the second phase of this development the developer has agreed to gain street frontage for the park. November 8, 2004 / 1 Mauritson asked if there will be connectivity to the park from Rupple Road. Hatfield replied yes because there is potential to gain other land making street frontage available. Mr. Terminella states that his main concern is that staff looks at this development on a regional level. He also thinks there should be waterways on the property. Mr. Terminella explained there are certain opportunities in the Western Quadrant. He stated there are developers willing to work together to reach a mutual agreement on land dedication to create a larger park like Gulley Park. He asked if Park Staff can come up with an agreement on what other lands can be added to this dedication is he allowed to "bank" land. Edmonston replied this has been allowed in the past and would not be a problem in this development as well. Pawlik Holmes stated this is what Parks and Recreation would like to accept. MOTION: . Mauritson moved to accept park land dedication requirements of 5.59 for acres with this phase of the development, with the final location to be determined by staff and developer after full development. Eads seconded the motion. The motion was approved 7-0-1 with Colwell, Mauritson, Marley, Eads, Bailey, Shoulders, and Pawlik Holmes voting 'yes' and Hill abstaining from the vote. November 8, 2004 / 2 PARKS AND RECREATION ADVISORY BOARD Meeting Minutes May 1, 2006 Opening: The regular meeting of the Parks and Recreation Advisory Board was called to order by Vice Chairman Jay Davidson at 5:35 P.M. on May 1, 2006 in Room 326 of the City Administration Building located at 113 West Mountain Street, Fayetteville, Arkansas. Present: Parks and Recreation Advisory Board members Bailey, Davis, Bitier, Burke, Langsner and Davidson were present; Colwell was absent; Trail Coordinator Mihalevich and Transportation Manager Gulley; Park Staff Coles, Jumper, Edmonston, Whitlock and audience were in attendance. 1. Park land and trail corridor are needed in this area according the Parks and Recreation Master Plan and the FAIT plan. Park land for a neighborhood park is anticipated to be dedicated with phase three of this project which is on the western side near Rupple Road. Additional park land is anticipated to be dedicated for future phases on the south border of this property near Old Farmington Road. Davis asked if the developers will work with the City to meet requirements for the trail construction. Jumper said they would be working with Mihalevich on design and location and the on-site construction will be coordinated with Gulley's crew Gulley explained the need for the developer to tie in the construction of the trail area with the construction of the entry to the development is critical to the progress of the project and with the other priorities of the City staff it was more cost effective to let the developers handle the project with City guidance. Bitler asked if the 3.48 acres has been dedicated or is that part of the future development. Jumper said the final plat has not been submitted so we will wait until a variance is processed since it's over 100 units. Bitter asked if it's in the future and not guaranteed. Jumper responded that is the case. She said we'd see each phase as it comes through. The developer has an overall plan and will be doing it in phases as they can Davidson asked if there's a time frame for Phase 3. Hafemann, representing Reserve LLC, said it's in the future depending on how well each phase processes. Jumper said there is talk of a neighborhood park in Phase 3 also. May 1, 2006/ 2 Bitler asked if we could take land outside of that which is being developed. Jumper said we can't require it. If the owner/developer wants to deed it to the City they can, but the City can't require it. Edmonston explained some developers will bring all phases at one time and bank the required land dedication to draw from with each phase as developed. This developer wants to take care of each phase as it's developed. Bitler asked if there's any concern about eventually acquiring the land. Edmonston said the Boys and Girls Club is across the street from the proposed development and the new school on Rupple will provide indoor and outdoor opportunity for activity and play areas for the surrounding areas. PRAB Motion: Davis moved to accept Staff recommendation to accept .64 acres for a 20' trail corridor along Shiloh and accept money -in -lieu for the remaining requirement. Langsner seconded the motion The motion carried 6-0-0 with Colwell absent for the vote. A second motion to recommend a waver to accept park land and money -in -lieu for a future phase was made by Davis with second by Langsner. Vote carried 6-0-0 with Colwell absent for the vote. May 1, 2006/ 3 FAY,ETTEVILILE PARKS & RECREATION • MEMORANDUM Date: June 29, 2006 To: City Alderman From: Connie Edmonston, Park and Recreation Director Subject: Mountain Ranch Agenda Item — July 6, 2006 There were questions asked at the Agenda Session that I wanted to clarify conceming the Consent Agenda 2 —Park Land Dedication for Mountain Ranch Phase One. The developer will be constructing the trail along Shiloh Drive which will be 1700 1.f. or .32 miles. It will be part of our trails system adjacent to the Highway I-540 corridor. The developer submitted a cost to build the trail was reviewed by the Transportation Division. It was determined to allow the developer to build the trail and to credit the trail construction cost from the Park Land Dedication fee requirement.
