• RESOLUTION NO. 5 3- 0 5 A RESOLUTION ORDERING THE RAZING AND REMOVAL OF A DILAPIDATED AND UNSAFE STRUCTURE OWNED BY MOHSEN AND RHONDA KHODABANDEH LOCATED AT 1101 INDIAN TRAIL IN THE CITY OF FAYETTEVILLE, ARKANSAS WHEREAS, Mohsen and Rhonda Khodabandeh are the record owners of the real property situated at 1101 Indian Trail, City of Fayetteville, Washington County, Arkansas, more particularly described as follows: Part of Lot 1 & Part of Lot 2, Block 3, Rochier Heights Addition (WC Parcel Number 765-10089-000), and, WHEREAS, the City Council has determined that the structure located on said property is dilapidated, unsightly, unsafe, and detrimental to the public welfare; and, WHEREAS, Mohsen and Rhonda Khodabandeh, having been properly served with a Violation Notice in hand by the Fayetteville Police Department, and given thirty (30) days to correct said violation, have refused to repair, or raze and remove said dilapidated, unsightly, and unsafe structure. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That, by the authority granted pursuant to A.C.A. §14-56-203, and in accordance with the provisions of Ordinance No. 3948 of 1996, Mohsen and Rhonda Khodabandeh are hereby ordered to raze and remove forthwith, the dilapidated, unsightly, and unsafe structure located on the aforementioned real property. The manner of removing said structure shall be: dismantle by hand or bulldozer, and haul all debris to a landfill. Section 2. That if, Mohsen and Rhonda Khodabandeh do not comply with this order, the Mayor is hereby directed to cause the dilapidated, unsightly, and unsafe structure to be razed and removed; and a lien against the real property shall be granted and given the City, pursuant to A.C.A. §14-54-904, for the costs associated therewith. BACKGROUND Service Request #15980, Case #2817: The Fire Marshal's office contacted Code Compliance about a possible unsafe building on the property owned by Mohsen and Rhonda Khodabandeh. The property is located at 1101 Indian Trail. On October 10, 2004, the Fayetteville Fire Department responded to structure fire at 1101 Indian Trail. The next day, the Fire Marshal's office sent us a Property Assessment stating that the fire damage coupled with the structure's deterioration has made the structure unsafe. The Building Safety Director has also inspected the site and determined the structure is unsafe to occupy. An Unsafe Buildings Notice of Violation was sent to the owners on October 12, 2004, but was returned unclaimed. The Police Department delivered the Notice of Violation on December 16, 2004. The notice was signed by Mohsen Khodabandeh. By ordinance the owners were given until January 17, 2005 to acquire a permit and make repairs or to demolish and remove the buildings. DISCUSSION This parcel contains a multi-level structure with heavy fire damage. The building is secure but has deteriorated to a point were it is no longer safe. There is not a current building permit on this structure. BUDGET IMPACT Contracting the raze and removal of the property would cost approximately $6,000.00. The cost would be billed to the property owners. If payment is not received, the city will place a lien on the property for the amount of the raze and removal. ..r" 3 -05 RESOLUTION NO. Firefighters arrived on the scene and found a working fire. Firefighters brought the fire under control and confined the fire to the upstairs apartment. The fire caused extensive damage to the upstairs apartment and water damage to the downstairs apartment. The upstairs apartment was occupied and the downstairs apartment was vacant. The electric meter and gas meters were removed for safety purposes. An examination of the interior and exterior showed that the structure's deterioration and Lire damage has made the structure unsafe. The owner should assess the property and consider cost of repair verses removed before any repairs are made to the structure. The electric and gas meter should not be returned back to this structure until a master plumber and electrician examine the structure.
