A RESOLUTION APPROVING A PAYMENT TO REIMBURSE
THE ARKANSAS HIGHWAY AND TRANSPORTATION
DEPARTMENT (AHTD) IN THE AMOUNT OF $330,000.00 FOR
RIGHT-OF-WAY ACQUISITION FOR THE WIDENING OF
GREGG AVENUE BETWEEN TOWNSHIP STREET AND THE
FULBRIGHT EXPRESSWAY; AND APPROVING A BUDGET
ADJUSTMENT IN THE AMOUNT OF $360,000.00.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby approves a payment to reimburse the Arkansas Highway and
Transportation Department (AHTD) in the amount of $330,000.00 for right-of-
way acquisition for the widening of Gregg Avenue between Township Street and
the Fulbright Expressway.
Section 2. That the City Council of the City of Fayetteville, Arkansas
hereby approves a budget adjustment in the amount of $360,000.00.
PASSED and APPROVED this 15th day of February 2005.

Justification of this Increase:
The funding is needed for the payment to the AHTD for
ROW.
Justification of this Decrease:
The $360,000 comes from project funds remaining in
2004. This adjustment is in advance of the normal re -
budgeting process that will be before City Council on
March 1, 2005. -
The funds budgeted in 2004 will go back to the Use of
Fund Balance.

Subject: Approval of a payment to the Arkansas Highway and Transportation
Department for right-of-way acquisitions and utility adjustments in the amount
of $330,000 for the widening of Gregg Avenue between Township Street and
Fulbright Expressway.
RECOMMENDATION
The staff recommends that the City Council approve a payment of $330,000 to AHTD for
land acquisition and utility relocations for the Gregg Avenue widening project between
Township Street and Fulbright Expressway.
BACKGROUND
The City has adopted a resolution with the Arkansas Highway and Transportation
Department to enter into an agreement for the widening of Gregg Avenue between
Township Street and Fulbright Expressway. AHTD will construct the new roadway at
their cost in exchange for the City reimbursing AHTD for right-of-way acquisitions and
utility relocations. Once the project is complete, the City will accept for future
maintenance the entire section of Highway 180 from N. College to the Fulbright
Expressway, which includes Township Street between N. College and Gregg Avenue,
and Gregg Avenue from Township Street to the Fulbright Expressway. Any
improvements to Township Street will be the responsibility of the City.
DISCUSSION
The City's cost share portion of this project has already been budgeted for in two separate
2004 CIP projects: 02129 (Gregg Avenue Waterline Relocation) and 04010 (Gregg
Avenue Right -of -Way). The waterline design is already well underway by contract with
Garver Engineers, and the right-of-way costs are addressed in this current agenda request.
BUDGET IMPACT
This $330,000 expenditure has been budgeted in the 2004 CIP as Project #04010 (Gregg
— Fulbright to Township ROW). The entire 2004 budget of $360,000 has been carried
forward to 2005 and is available for this payment to AHTD.

Reference is made to my December 21, 2004 letter regarding right of way acquisitions and utility
adjustments for the subject project. The amount requested in this letter inadvertently included
funds for the relocation of the City's water facilities. Relocation of the water facilities will be
handled by the City at no cost to the Department.
The amount due for utility adjustments has been revised to $185,000. The cost estimate for
right-of-way acquisitions remains unchanged at $145,000. As previously agreed, the City is
responsible for all costs relative to right-of-way and eligible utilities. In order for the Department
to proceed, please submit a check in the amount of $330,000 (made payable to the Arkansas
State Highway and Transportation Department) to this office.

A RESOLUTION SUPPORTING THE WIDENING
OF ARKANSAS HIGHWAY 180 (GREGG STREET)
BETWEEN U.S. HIGHWAY I-540 (BYPASS) AND
TOWNSHIP STREET, URGING THE HIGHWAY
COMMISSION TO AUTHORIZE SAID WIDENING,
AND FOR OTHER PURPOSES
WHEREAS, the portion of State Highway 180 (Gregg Street) between U.S.
Highway I-540 (Bypass) and Township Street is an arterial thoroughfare in
Fayetteville, and
WHEREAS, State Highway 180 was omitted from the Highway
Improvement Program of 2001-2003 leaving any improvements to said highway
years in the future; and
WHEREAS, the City of Fayetteville, recognizing this significance of this
highway to the economic well-being of the new Washington Regional Medical
Center, Medical Park, and north area of Fayetteville, believes that innovative
approaches should be taken immediately to ensure essential improvements are
made to this highway; and
WHEREAS, the Street Committee of the City Council of the City of
Fayetteville, Arkansas unanimously recommends that the City agree to purchase
right-of-way for the widening of Gregg Street and agree to assume maintenance
of Gregg Street after its widening by the Arkansas Highway Department.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. State Highway Commissioner Jonathan Barnett is hereby
authorized to ask the Arkansas Highway Commission to pursue a Minute Order
seeking immediate assistance for the widening to four lanes with turn lanes at
important intersections between U.S. Highway 1-540 (Bypass) and Township
Street pursuant to the following conditions:
a. The City of Fayetteville will agree to acquire the necessary
right-of-way; and
The City of Fayetteville assumes responsibility for the
relocation of all utilities; and
c. The City of Fayetteville agrees to accept the highway as a
City street when completed.

WHEREAS, IN WASHINGTON COUNTY, on Highway 180, Section 2,
(Gregg Avenue) from Township Road to Futrall Drive, the City of Fayetteville has requested
that an improvement project be programmed; and
WHEREAS, the City of Fayetteville has adopted a resolution agreeing to the
following conditions:
1. The City will reimburse the Department for right-of-way acquisition and
relocation of all utilities.
2. The City agrees to accept the entire section of Highway 180 Section 2 from
Highway 71B Section 16 to Shiloh as a city street upon completion of the
improvements.. This will include the portion of Highway 180 (Township
Road) between Highway 71B Section 16 (College Avenue) and Gregg
Avenue.
NOW THEREFORE, the Director is authorized to proceed with surveys, plans
and construction as funds become available.
FURTHERMORE, it is ordered that upon completion of this project, Highway
180, Section 2, along Township Road and Gregg Avenue from Highway 71B Section 16 to
Shiloh, will no longer be a part of the State Highway System. This change will become
effective upon notification from the Chief Engineer.
